SHOPPING
Shopping for furniture, kitchens, artefacts,
soft-furnishings & everything else for the home – as well as everyday provisioning needs – has come a long way in recent years & Phuket now boasts “big-city” standards. The arrival of Tesco-Lotus & Big C several years ago, changed the face of Phuket residents’“weekly shopping” expedition, both in terms of convenience & choice. Central Festival has further opened up shopping ventures, offering a more cosmopolitan boutique store approach, and Jungceylon, a first of its kind lifestyle centre – shopping, dining, entertainment & fitness – is open. The daily markets are still there for the adventurous. On the more significant question of furnishing your home, convenience is less of a factor. Five years ago Phuket boasted perhaps just one quality furniture outlet. Today there are many. It is more of a buyer’s market than ever before. Similarly for home furnishings, décor & those all-important signature pieces that distinguish your home from everyone else’s. When it comes to furnishing your home, it is well worth the time & effort to shop around. One-stop shopping is a good place to start, but is not the complete answer in today’s Phuket when it comes to expressions of your style. Antique & reproduction antique shops abound; some good, some less good. Take the time to find out which is which; there should be no rush. The same goes for soft furnishings, fitted kitchens… in fact everything. There are choices in every field. Take advantage of them.

What are the Medical Treatment options in Phuket?
For many on the island, this important question will at some stage, need to be addressed. If we get sick, where should we go for treatment?

The answer depends on several factors, plus a basic knowledge of what is available on the island. Friends and other longer term expats can always give opinions and recommendations, and their advice is usually accurate. If in doubt, shop and ask around. For those who live and holiday here, having access to some of the best quality medical care in the country is often taken for granted. Whilst none of us want to get sick, it is a pleasant surprise when Phuket’s healthcare services are used, as they are usually efficient, effective and often of a very high standard. Essentially there are three public hospitals, three private hospitals, plus 110 clinics and over 200 private practices – a vast choice. If you do the math, you will find that the ‘doctor to population’ ratio is well above the Thailand average. Add this to the number of hospital beds, availability of nurses and other support services, and you will see that the island’s facilities are excellent. Vachira Phuket Hospital, Patong Hospital and Thalang Hospital are all operated by the Thai Ministry of Public Health. As public facilities, they are usually busy and waiting times for non-emergency cases can be long and continued on page 12

has recently completed major renovations, opening its new out-patient and room development, in September 2007. This is a medium-sized acute care hospital which has all of the required diagnostic and support facilities, and is a very popular choice for foreigners. • Bangkok Hospital Phuket is also a popular choice, and is part of the Bangkok Hospital Group which operates hospitals throughout Thailand. Located in Phuket Town, just down the road from Vachira Hospital, it has recently upgraded its facilities and opened a new out-patients’ building. It is considered the most expensive of the three private hospitals. For simple ailments, you can choose to use one of the many clinics around Phuket, but you should be aware that these clinics may not have the full array of diagnostic equipment and laboratory services that are available to the larger hospitals. They also often have limited opening hours as the doctors may also work in the larger hospitals, during the day. Emergency cases, are not well handled at the clinics, and should be referred to one of the major private hospitals, or Vachira. All healthcare facilities in Thailand are required by law to make a copy of your medical record available to you upon request, although some will charge you for doing so, especially if it is detailed and contains lots of information. By law, the healthcare facility must keep the original record for at least five years, so if you do change facilities, you can take your medical history with you.

Clients are usually Thai, however foreign patients do use their services, particularly those who do not have any insurance, or cannot afford private care. Vachira Hospital, the largest hospital on the island with over 500 beds is located in Phuket Town. Many specialists work from Vachira Hospital and also consult at other public and private hospitals around the island. That’s why you may see the same specialist treating patients in both the public hospitals and private hospitals, or from their own clinics. Vachira Hospital also participates as a Social Security Fund hospital. This scheme is funded by deductions from employees’ wages. Foreigners are eligible. Patong Hospital is located opposite the police station in Patong, with a busy emergency department. There is a high incidence of accident cases in the Patong area. The hospital does have limited services after hours, but at some times there may be no doctors available. Thalang Hospital, a 60-bed facility, is much smaller and generally treats less serious cases from the northern part of the island. More severe cases would be referred to Vachira Hospital. All of the public hospitals will charge foreigners for healthcare services, and whilst they are cheaper than the private hospital, they are not free.

There are three private hospitals, which generally cater to the vast majority of foreigners:
• Mission Hospital is a not-for-profit hospital and is part of the worldwide Seventh-Day-Adventist church group. Some say it is the cheapest of the private hospitals. It is located on Thepkrasattri Road, near the Rajabhat Institute. It is the only other hospital on the island besides Vachira, which will accept Social Security Fund patients. • Phuket International Hospital, sometimes referred to as PIH or Siriroj Hospital, is on the bypass road between Central Festival and Tesco. It

What a spectacular regatta!
“Wow! What a spectacular ending to the regatta,” said Asian Yachting’s Capt Marty – the veteran yachting reporter-guru who covers every yachting event in Asia.
Capt Marty was writing after the last day of the 2010 Six Senses Phuket Raceweek, held at Evason Phuket & Six Senses Spa from 21-25 July, where yachts and crews from all over the world compete across six classes for the top prizes – and 500 sailors mix with island revellers for five nights of 5-star parties. Fast cementing its reputation as the sailors’ regatta on the water – and the absolute best regatta party scene in Asia – Six Senses Phuket Raceweek, inaugurated in 2004 to be ‘different’, captured the island’s imagination this year as Phuket notables descended in droves either to race and party – or just to mix with the sailors and party.

After four days of very mixed winds, ranging from perfect 10-15 knots down to almost dead calm, the racing yachts on the last day were treated to not one, but two squalls rolling over the island into Chalong Bay, bringing winds up to 40 knots with them. Rain-laden black clouds gathered on the horizon as Race Officer Simon James started to get the different classes away on what was planned to be the first of two last-day races. “If I saw that coming at us at home, I’d be dropping the sails and going home,” said Tasmanian sailor, John Bourke, veteran of many Sydney-Hobart races who – like many of the Raceweek regatta crews – had flown into Phuket to find out what racing in Southeast Asia was all about. John, who revelled in the conditions, has vowed to return for Phuket Raceweek next year, if not before.

Those who eschewed the onshore comforts and raced on were in for an added ordeal. Looming over the Kata hills was another ominous black cloud, which descended on the ‘sheltered’ waters without remorse. Again 35 knots or more, this time bringing with it enough rain to create a ‘white-out’, saw ghost-like shapes hurtling around marks, avoiding boats moored in the crowded anchorage as well as unforgiving concrete navigation marks, racing towards each other with collision seemingly inevitable, but always miraculously keeping clear. All-in-all a superb start to a day that was to end with the fabulous gala closing party and prizegiving, where 5-star food, top-class live music and a no-limits free bar combine with the exhilaration of a challenging week on the water and the famous ‘Phuket party mood’ to create THE Phuket social event of the season for Thais and expatriates alike.

It wasn’t long before things started to unfold… the first squall hit just after the racing class had crossed the start line; a newly-launched frisky Phuket 8, Surf Patrol, broached, catapulting two crew members overboard. The Andaman Cabriolet catamaran, Niña, waiting for its own multihull class start, dropped sails and was quickly on the scene hauling the two out of the increasingly heavy swell. The irony of dripping crew shirts proudly boasting ‘Surf Rescue’ was lost on neither the rescuers nor the camera-shy rescued…

Photo by Rolien Beute At the same time, one of the multihull fleet, Little Soul, having sailed all the way from Bali to join the regatta, lost its mast and drifted across the start line, holding up proceedings for the remaining classes while its sagging mast and tangled rigging was sorted out. ‘Ghost’ ships passing in the white-out. The delay meant the remaining classes got away in relatively calm conditions, on a course heading into the more ‘sheltered’ part of the bay – but not before a number of participants had decided to call it a day, opting for an early beer in the post-regatta bar rather than put fortitude and gear to the test. Nevertheless, the soul of any regatta is the racing and here is what one Phuket Raceweek regular, Keith Garry up from Malaysia on BeauX Esprits, had to say the day after it was all over: “Thanks for a great regatta as usual. This regatta had just about everything in terms of weather and conditions. We had some first time Southeast Asia sailors from West Australia on board who were impressed to say the least with the regatta and the great functions. Important Issues for Property Investors
I am in the process of purchasing a property where the interest available is a leasehold interest. I understand that in Thailand a lease needs to be registered. Could you explain this process to me?
“In Thailand a lease that is over 3 years in length must be registered at the Land Department. If it is not registered then it will possible to enforce only the first 3 years and not any of the remaining years. In order to register a lease the land must be Nor Sor 3 or Nor Sor 3 Kor or Title Deed (Chanote) as it is not possible to register against any other land type. Also, if the land is mortgaged then it will not be possible to register the lease without the bank’s consent. The lessor and lessee will need to provide certain documents to the Land Department including the original copy of the title document, identification documents (such as a copy of passport if the lessor/lessee is an individual or copy corporate documents if a company) and proof of payment of the rent. In terms of proof of payment the Land Department just needs to see that what should have been paid up until the registration date under the terms of the lease has been paid. So, if the lease provides for yearly payments of the rent the Land Department will require proof of payment of the years up to the registration date whereas if the lease provides for payment upfront of the total rent for the entire term the Land Department will require evidence that this payment has been made in full. If your lawyer or representative is to attend the Land Department to complete the registration on your behalf they will need to have a power of attorney from you which is in the Land Department standard form. If you are purchasing an existing lease from the current lessee (on a re-sale) the Land Department will also require that you provide a consent letter from the lessor to this assignment. In terms of timing of registration, the optimum position for a lessee is that registration takes place at the same time as the first lease payments to the lessor. On registration a fee of 1.1% of the full value of the lease is charged which will be calculated on the total rental that is due from the lessee to the lessor throughout the term”. For an apartment project there is no ability in law for a foreigner to own freehold nor is there any mechanism in law providing owners with common ownership of the common areas or a stake in the management. For this reason, in an apartment project you should check carefully how ownership and maintenance of the common parts is dealt with and ensure that you are provided with sufficient rights in the purchase contracts. I am a foreign national. Is it possible for my young children who have Thai citizenship to own land in Thailand?
As long as the purpose of your child owning land is done for legitimate reasons or, in other words, as long as it is not done as a means to allow someone to own land who would not normally be allowed to own land. The Land Department may raise questions to ensure they are satisfied the transfer to your child is being done for genuine reasons. However, it is important to note that if your child owns the land then no transactions involving the land (such as a sale or a mortgage) can take place without a court order which could severely restrict the ability to deal with the land. Once your child reaches the age of majority the restrictions fall away and your child would own the land in the same way as any other Thai adult. (Desmond Hughes – Deputy CEO)

Could you explain to me the difference between a condominium project and an apartment project?
In Thailand the distinction between a condominium and an apartment is a legal distinction. A condominium project may look identical in every way to an apartment project but what defines whether or not it is classed as a condominium is whether it has been registered with the authorities as a condominium. In order to register as a condominium, an application will have been made for this designation which may involve more documents and paperwork needing to be filed in the pre-construction phase than would be the case if the project is to consist of apartments rather than condominiums. Once the construction of a condominium project is finished, or all but finished, an application is made to register the project as a condominium which will involve the submission of a number of documents to the authorities. Once registered the Land Department will issue title deeds for each of the condominium units of which foreigners may acquire the freehold to 49% of the units. The law also
