CONPLAN 3501 DSCA

• Provides developed, all-hazards concept of operations for


support provided within the auspices of the NRF
• DOD response is scalable and tailored to the event and
requests for support from civil authorities
• Two primary COAs:
– Notice Events (NSSEs, special events, hurricanes, etc.)
– No Notice Events (earthquakes, terrorist attacks, etc.)
• Not just a disaster response plan. Includes support for pre-
planned events, support to HS and LE, etc.

CONPLAN 3501-08 Mission Statement:


When directed, USNORTHCOM conducts Defense Support of
Civil Authorities operations within the Operational Area to
support civil authorities during special events and to mitigate
the effects of a disaster.

Anticipated Tasks

Limitations

• CDRUSNORTHCOM must receive an RFA from primary


Government agency to employ assigned forces and certain pre-
identified forces as defined by the SecDef-approved Joint Staff
DSCA EXORD. SecDef approval is required for the deployment of
additional forces (EXORD Category 4)
• Federal forces can only be placed under the command of Title 10
authorities
• In accordance with United States Code, Title 18, Section 1385
(Posse Comitatus Act), Title 10 military personnel shall not be
employed to enforce or execute civil law, except as otherwise
provided by law
• Intelligence collection on U.S. persons is restricted by Executive
Order 12333 and DOD policy
• There are four mobilization sections contained in Title 10, United
States Code (U.S.C.) Section 12301 thru 12304. These sections
restrict the ability to rapidly mobilize reserve forces, including
the National Guard, for DSCA events, unless the event involves
WMD or a terrorist attack

Key Facts

• DOD earthquake response will be in support of


the larger Federal effort, IAW the National
Response Framework
• CDRUSNORTHCOM is the supported Commander
in USNORTHCOM AOR
• USNORTHCOM must receive an approved RFA to
conduct DSCA operations
• CDRUSNORTHCOM has authority to conduct
specific DSCA missions granted by Standing
DOD DSCA EXORD

Assumptions

• Catastrophic earthquake requires Federal (including DOD)


support
• Title 10 forces in the vicinity of the incident will respond
under immediate response authority. Upon SecDef approval
and CJCS EXORD execution, CDRUSNORTHCOM will request
OPCON of any T10 forces that remain in the JOA
• The National Guard will respond in a State Active Duty (SAD)
or Title 32 status
• Agreements between and among the states, to include EMAC,
will be used for state to state assistance
• DOD facilities in the affected area will not be immediately
available for use
• Global force rotation will cease; CONUS units will be available
for employment
• Dual status command structure will not be used
