´ Islam and women¶s rights is not a new issue. It has been extensively debated all over the world. Some literatures provide better explanation than mine but I will try ,not merely copy-pasting from random websites,to explain µWOMEN¶S RIGHTS IN ISLAM¶ Before started writing this article,I asked the particular guy who challenged Muslims to prove that Islam protects women¶s right(or something like that),what did he mean by the infamous term,¶right¶to get some ideas of his concept regarding the matter.but to my disappointment,he didn¶t give me clear description of his version of µright¶ but merely saying ³something as simple as choice, like to marry or to divorce´ and he further added somewhere else, ³rights of women in Islam are all thanks to infidelism´. The main obstacle in coming to term regarding this issue is the understanding of the word µright¶.So until both parties agreed to the same concept of µright¶ this problem can never be put to an end. According to the Oxford dictionary, µWomen¶s Rights are the rights,that promote a position of social and legal equality, of women to men..they are the rights, claimed for the women, EQUAL to those of men, as regards to suffrage that right to vote, as regards to property, etc¶. But the most important point that I want to emphasize here is,¶right¶ does NOT mean pure freedom to do THINGS AS ONE PLEASES. Islam believes in equality of men and women ± µEquality¶ does NOT mean µidenticality¶. It is a well known fact that men and women can never be exactly equal. It is even proven by law of nature.Men will never,in his life,ever, suffer the pain of labour,men will never in ever know the pain of dysmenorrhoea. Men will never in ever need to wake up in the middle of a sound REM sleep to breastfeed a crying child.Men will never in ever suffer the pain of engorged breast filled with milk. But amazingly,never in history did anyone protest against in µinjustice¶ and µinequalities¶.Why is that? Besides,it is a proven fact that men have higher IQ as compared to women in general while women have higher EQ. In a web page where µatheists all over the world¶ apparently µgathered to show inhumanity of Islam¶,the common issues often(and repeatedly) raised regarding their µconcern¶ of women¶s rights in Islam are: Two female witnesses equal to one man. Women get only half of inheritance as much as men Women are µless intelligent¶ than men Women have no right to be fashionable/women have to wear hijab/women have to wear veils 5. In a nutshell,the basic idea is ISLAM OPPRESSES WOMEN. Even with negation and explanation of these issues,it will eventually make no difference because we both know,in the end,everybody will continue believing what he chooses to believe and what has been incepted into his µintelligent¶ mind although not knowingly ,misguided. DO NOT confuse laws of Allah with man-made laws. Unfortunately, just because a µMuslim country¶ implemented µabsurd laws¶ like women cannot drive cars or women MUST wear veils,does not necessarily mean it is a direct order from God.Infact,nowhere,in His Holy Book,did He mention that. Understanding the meaning of al-Quran is not as easy as reading the direct translations like you are reading comic books,or simply quoting a particular verse,or viewing IslamIsBullshit.com for reference. Even established tafsirs written by famous tafsir scholars may have wrong interpretations of the meaning as most of Quranic verses are ambiguous(because God wants us to search for knowledge!)and the standard of language used is incredibly high and literally poetic. Please be mindful that there is a branch of study regarding asbaabul nuzul (reasons behind revelation) of particular aayat (verse) or surah(chapter) in Quran which sadly.most people aren¶t aware of. Non believers (and even believers themselves) mostly don¶t even bother to learn Arabic language first before making another person¶s interpretation or rumors as reference instead of the real Quran. Eventhough this is not the main concern of this article,but I would like to briefly clarify some doubts because in order to accept the content of a book,one must first have confidence in the authenticity of the book itself. The most disturbing eyesore that especially requires clarification is the accusation that Quran was written by Muhammad,and that he plagiarized some information from Torah and Gospel. (note:Torah and Gospel are words of Allah indeed,but some parts have been modified by irresponsible parties while some parts retained,,thus the New and Old Testaments of today are NOT the original version of Torah and Gospel).For non believers specifically those who don¶t believe in God ,the only option left is Muhammad as the writer of the Holy scripture,and they somehow have to believe in the speculation or otherwise they have to succumb to the µexistence of God¶ thus sacrificing their¶beliefs¶. But Muhammad wasn¶t the writer. 1.he was an illiterate ,thus he could not write,save reading other books or scriptures 2.he had never received any proper formal education,thus the knowledge revealed in the Quran was not known by him beforehand.
3.he was nick named Al-amin for his honesty eversince childhood,thus possibility for him to suddenly start lying at the age of 40 is highly doubted. 4.when Allah said´we spread the earth´ he should have cleared the misunderstanding when some people regard it as µFLAT¶ but he didn¶t know it beforehand because he WASN¶T THE ONE WRITING IT.(I guess I have to write a different article regarding this one ) 5.Quran was revealed to the Arabs whom literacy level was extremely poor.Though highly ignorant,they were very good at memorizing.Thus conservation of the Quran at that time was mainly done via memorization and repetition of recitation in prayers(Muslims pray 5 times a day)..This was one of the reasons why Quran was revealed little by little based on asbaabul nuzul and the whole process of revelation took 23 years.Besides,most surahs are beautifully rhymed as if to assist the process of memorization eg: (al Ikhlas) ³Qul Hua Allahu Ahad. Allahhus Somad. Lam Yalid,wa lam Yulad. Walam yaqullahu kufuan Ahad.´ Most sahabah memorised the whole Quran and they corrected each other by listening to each other¶s recitation consistently. Thus the claim that Quran is simply hearsay of hearsay of myth and so on is NOT TRUE thus NEGATED. 6.Now coming to your favorite part,logic.Why would someone address himself as YOU instead of ME when writing his own book? 2:219 they asked YOU regarding khamri(intoxicated drink) and gambling« 2:222 they asked YOU regarding menses«. 52:40 or do YOU ask for payment« And many many more.(again,please read the whole Quran if you want to find the answer,and NOT Ihate Islam.com) Whenever he used µI¶ the verse would start with ³SAY´ eg 109:1 Say´ o disbeliever, 109:2 I will not worship what you worship 109:3 Nor will you worship what I worship «. 7.if Muhammad were to be so extremely intelligent and genius, why didn¶t he bother to mention the author name in his book with something like,say, author:Muhammad THE GREAT.Name any great author of renowned book that does not include his name in the book.Instead,never did he ask for any money or payment and instead of worshipping him,he asked the followers to worship Allah and he was willing to die and nearly murdered for the sake of Allah. 8.The process of making Quran into a book only started after the death of Prophet Muhammad pbuh under the ruling of Abu Bakr. 9. This can go on forever but I think I have to stop for now and start focusing on the real topic,WOMEN RIGHTS IN ISLAM.and Muhammad DEFINITELY ,ABSOLUTELY wasn¶t the writer of Quran.
So if someone asks,´what is the proof that God exists?´ Let¶s answer them now:Quran. After deep thinking I come to realize that the major challenge to accept something as true or false is the initial µmindset¶. For instance,some people regard being half naked or even naked in public as an individual right while dressing modestly(especially wearing headscarf) is an individual¶s choice and a discrimination against human¶s rights(apparently women only) if some µHoly orders¶ make it an obligation. While some people regard dressing modestly as a responsibility and being half naked in public as a disgrace to human dignity and belittling human¶s pride thus shall not be considered as one¶s right. Again I would like to remind you that by µhaving rights¶ does not mean one has freedom to do anything as one pleases and abiding by rules and regulations,if they are reasonable and intended for good cause, does not make one lose his or her rights. A simple analogy,if a school regulates that each student is required to wear green uniform, do you or do you not go objecting this nonsense regulation claiming it is the student¶s right to wear any colour that he/she wants? Islam does not oppress women,instead it freeds women from oppression of her soul,pride and dignity.During jahiliyah(ignorant) age before the revelation of Quran,Makkans loved their wine and the revelry it brought.It helped them satisfy their passionate search for pleasure and to find that pleasure in the slave girls which they traded and who invited them to ever increasing indulgence.Women were treated inhumanely and regarded as µsex toy¶,ranked lowly in society nor could they claim any rights. Not only that,having a girl as child was regarded as a disgrace in society to the extent that they would rather bury the female baby alive just to µshow face¶ in the society again(now this is what you can call barbaric,people!). But Islam changed and put a curb to this immoral and cruel traditions and lifted women to a much higher level,comparable to men.Even a chapter in Quran itself was named AnNissa(Woman)!Yet sadly in today¶s apparently µmodern society¶,many people accuse Islam as oppressing women,does not treat women fairly etc etc!such groundless allegation! Points to be noted: Approximately one fifth of the world¶s population, consists of Muslims. There are different Muslim societies - Some may be close to Islam, some may be far away from Islam. The µWomen¶s rights in Islam¶ should judged according to the authentic sources, and not what individual Muslims do, or what the Muslim society does. The authentic sources of Islam, are the Qur¶an, which is the word of God, and the authentic Sunnah, and the traditions of our beloved Prophet (peace be upon him). Qur¶an will never contradict itself, nor will the authentic Hadith contradict itself« neither will these two authentic sources, contradict each other.
Sometimes the scholars differ, and many a times, these differences can be removed by analyzing the Qur¶an as a whole, and not just by quoting one particular Verse. Because if one particular verse of the Qur¶an is ambiguous many a times the answer is given somewhere else in the Qur¶an - Some people quote one source and neglect all the other sources.
Sex is Not the Criteria to Enter Paradise: The greatest misconception that the West has about Islam, is that they think« µParadise in Islam, is only meant for the male - it is not meant for the female¶. This misconception can be removed by quoting from Surah Nisa,4:124 which says, µIf any of you do deeds of righteousness, whether it be male or a female and has faith, they shall surely enter Paradise and not the least injustice shall be done to them¶ A similar thing is repeated in Surah Nahl, 16;.97 which says« µIf any of you perform good deeds, be it a man or a woman and is a believer, We shall give you good life and We should reward you for all your good works¶. Once, one of Prophet¶s wives, Umm Salamah, complained to him that the Qur'an was addressed only to men, and then a long passage was revealed to the Prophet* addressed clearly to men and women in every line, which states clearly the equal responsibilities and rewards for Muslim men and women. For Muslim men and women - for believing men and women, for devout men and women, for true men and women, for men and women who are patient and constant, for men and women who humble themselves, for men and women who give in charity, for men and women who fast (and deny themselves), for men and women who guard their chastity, and for men and women who engage much in God's praise - for them has God prepared forgiveness and great reward.(Qur'an 33:35)
Regarding marriage (clarifying issue number 5,6,8) ±refer first page Rights to choose husband The Quran states that women should not be possessed against their will in marriage. They should receive their dowry (to them, not their parents) much like an engagement ring is given in western society. Furthermore, women should be the selector of who she chooses as a husband. This is evident by the Quranic command, ³O ye who believe! Ye are forbidden to inherit women (against their will)«´ (Quran 4:19)
There¶s a Hadith in Sahih Bukhari, Volume 7, Book 62, Number 69, which says µthat a lady she was forced by her father to marry against her wishes¶ - And she went to the Prophet and the Prophet invalidated the marriage¶. In a debate regarding women¶s right in Islam, the con team argued: ³ In an interesting note, the Qur'an does say that women themselves can be inherited, devolving womanhood to a terminology more suited for property than personhood. There is one catch... they have to be pretty dirty girls. 4:19 - "It is not lawful for you forcibly to inherit the women (of your deceased kinsmen)... unless they be guilty of flagrant lewdness."´ Before I go any further I would like to show you a complete verse of 4:19 ³O ye who believe! It is not lawful for you forcibly to inherit the women (of your deceased kinsmen), nor (that) ye should put constraint upon them that ye may take away a part of that which ye have given them, unless they be guilty of flagrant lewdness. But consort with them in kindness, for if ye hate them it may happen that ye hate a thing wherein Allah hath placed much good.´ (Wow this is taking forever isn¶t it?sorry Khalid,now you know the reason for the late reply) Remember Asbaabul nuzul?The reason for revelation of this verse is because according to the Ignorant Arabic custom(pre Islam era),when a person died,the wife of the deceased would be taken in by or inherited to the husband¶s brother or his other family members,even without consent of the woman.This verse is to prohibit such act and making it UNLAWFUL.Thus it is WRONG to think that Islam regard women as property. Isn¶t it clear that this verse is revealed to protect them instead? Besides,even with the death of her husband or divorce(4:20 And if ye wish to exchange one wife for another and ye have given unto one of them a sum of money (however great), take nothing from it. ), it is prohibited for the husband¶s party to claim back the marital gift or anything that has already been given to her during the marriage period,unless the woman acted conspicuously and outrageously bad or reprehensible or showing obscene manner.Thus the claim is NEGATED! Compulsory Marital Gift for a Woman: When she gets married, she is on the receiving end. She receives a gift - she receives a dower or a marital gift, which is called as µMeher¶. And it is mentioned in the Qur¶an in Surah Nisa, Ch.4 Verse No.4 which says, µGive to the woman in dower, a marital gift¶. For a marriage to solemnize in Islam, µMeher¶ is compulsory.
Harsh Treatment of Women Forbidden in the Quran During the marriage women should be treated with kindness and equity. Every opportunity should be afforded for their comfort in the home, where they have a very demanding job raising children, and the attainment of their education in whatever field they choose. "« Nor should ye treat them with harshness, that ye may take away part of the dower ye have given them...on the contrary live with them on a footing of kindness and equity´ (Quran 4:19) In lieu of this some have pointed to a verse in the Quran in order to show that women are to be beaten by their husbands. " As to those women on whose part you see ill conduct, admonish them (first), (next), refuse to share their beds, (and last) beat them. " (Quran 4:34) This is one of the most controversial verses in Quran because of the word BEAT(pickthall translation even uses the word scourge!) Actually,Quran verse 4:34 refers to specific women (in case of nushuz(disobedience)).It speaks of women who are rebellious and acting in an ill-conduct way. Now if we backtrack to verse 4:19, men cannot be harsh to women unless they're openly lewd. There are 3 steps for a husband to take which MUST be followed in order. First step is to talk to her and counsel her regarding her behavior, if she refuses to listen and keeps doing it then sleep separately(so she knows that her husband disapproves her act) and the final step is to hit her. Now the word used here is "daraba" in Arabic which is better understood as hit rather than scourge. All scholars and all commentaries agreed that it means light and symbolic tap without leaving any mark like using a folded towel,in hope that the wife will realize her mistakes and change her attitude,so that she knows that the husband still cares about her and wants to be with her.If it¶s still not fruitful, a representative from each party is appointed to help settling the problem,to avoid separation between those two. (pls note that God deeply frowns upon divorce as a solution unless there is hardly any other alternative but it does not mean that men have more right to divorce their wives than women do.) And if ye fear a breach between them twain (the man and wife), appoint an arbiter from his folk and an arbiter from her folk. If they desire amendment Allah will make them of one mind. Lo! Allah is ever Knower, Aware. (4:35)
Husbands are expected to treat their wives kindly during marriage and even during and after divorce. Allah says in the Qur'an: ... Live with them on a footing of kindness and equity. If ye take a dislike to them, it may be that ye dislike a thing, and Allah brings about through it a great deal of good. Qur'an 4:19
The Prophet* said: The most perfect believers are the best in conduct and the best of you are those who are best to their wives. (Hadith: Ibn Hanbal) What about a nushuz husband?(Rights to divorve) A husband is considered nusyuz if he treats his wife harshly,refuses to satisfy her sexual need,or denies her rights. According to a hadith: The ruler is a shepherd and is responsible for his subjects, a husband is a shepherd and is responsible for his family, a wife is a shepherd and is responsible for her household, and a servant is a shepherd who is responsible for his master's property. Hadith: Bukhari The wife must defer to her husband in respect for the fact that he maintains and protects her out of his means (Qur'an 4:34), but not if he tries to make her break the laws of Allah. Likewise children's obedience and respect for parents goes only to the limits set by Allah. If the parents try to make them disobey Allah, then it is their duty to disobey the parents. If the husband willfully fails to maintain his wife, she has the right to divorce him in court. If a woman feareth ill treatment from her husband, or desertion, it is no sin for them twain if they make terms of peace between themselves. Peace is better. But greed hath been made present in the minds (of men). If ye do good and keep from evil, lo! Allah is ever Informed of what ye do. (4:128) But if they separate, Allah will compensate each out of His abundance. Allah is ever AllEmbracing, All-Knowing. (4:130) Problems in marriage Some verses were revealed in answer to questions from ordinary women, like the one concerning the practice of divorce by abstinence within the marriage (zihar). A woman complained to the Prophet about this practice, which left the woman with no sexual satisfaction, but still not free to marry another husband and a verse was revealed condemning this practice. Allah has indeed heard (and accepted) the statement of the woman who pleads with thee concerning her husband and carries her complaint (in prayer) to Allah... Qur'an 58:1 Another passage was revealed in answer to a woman's complaint about the way her husband wanted to have intercourse with her (2:223).
How does it view the creation of woman? Is she just a part of Adam and an afterthought? This is what it says, in the first ayah (verse) of Surat an-Nisa - The Women: O Mankind, be conscious of your duty to your Lord Who created you from a single soul, and from it created its mate (of the same kind) and from them twain has spread a multitude of men and women. Qur'an 4:1 `A single soul' is neither male nor female, although it could be understood to mean Adam it is not necessarily so. In fact `soul' is feminine and `mate' is masculine! Not that I'm suggesting that women came first, because in other parts of the Qur'an the creation of Adam is described. But the gender relationship here is ambivalent. And the mate was created from the `soul' not the humble `rib'. They are made of the same soul as men. Their capacity for good and evil is identical with that of men. In 49:13, of the Qur'an we find that it is good deeds and awareness of Allah which make the believer, male or female, noble in the sight of Allah: Indeed the noblest of you in the sight of Allah is the most pious. and in 40:40: Whoever does right, whether male or female, (all) such will enter the garden The works of male and female are of equal value and each will receive the due reward for what they do: Never will I suffer to be lost the work of any one of you, male or female... Qur'an 3:195 Whoever works righteousness, man or woman, and has faith, verily to him will We give a new life that is good and pure, and We will bestow on such their reward according to their actions. Qur'an 16:97 The same duties are incumbent on men and women as regards their faith: For Muslim men and women - for believing men and women, for devout men and women, for true men and women, for men and women who are patient and constant, for men and women who humble themselves, for men and women who give in charity, for men and women who fast (and deny themselves), for men and women who guard their chastity, and for men and women who engage much in God's praise - for them has God prepared forgiveness and great reward. (Qur'an 33:35) I think have tried my best to clarify some issues regarding marriage and a little bit about equality between men and women, but I have yet to clarify other issues (1,2,3,4,7).This is taking forever,ahah! I know!Maybe if I have time,insha allah,I will continue some other time.
