Thank you for your letter. Board members, not staff, establish Agency policy, and
elections administration since June 2017 has continued consistent with directives
previously issued by the Board. Where the Board would otherwise have considered
particular matters, the Superior Court sitting in Wake County has ensured appropriate
and timely review of petitions, protests, and complaints. See e.g. Anderson v. State
Board, 17 CVS 12072; Furgiuele v. State Board, 17 CVS 15132; Hines v. State Board, 17
CVS 15132; In re Ellis, 17 CVS 14762 and 17 CVS 15056; In re Disposition of Requests
for New Elections, 17 CV 15517.

I have enclosed the current elections scheduled for your reference, and Agency staff will
continue to perform clerical and administrative tasks necessary to meet deadlines
established by statute or imposed by an order of our courts.1 Operation of day-to-day
functions regarding elections, campaign finance, ethics compliance remain ongoing. The
Agency’s civil staff continue in service to our State consistent with Board policies and will
undertake no effort to avoid any order effectuating the decision of our Supreme Court.
