Subject: Legislative Actions Negatively Impacting County Fiscal Sustainability
Dear Legislative Leaders:
The members of the Washington State Association of Counties have spent the last five years trying to
advance proposals to enable counties to continue providing the constitutional and statutory
obligations placed upon them by the state. In this short session, our expectations are modest, laying a
foundation for a more impactful conversation during next year’s biennial budget process but also
hoping that the Legislature will “do no harm” to counties and your shared constituents who rely on the
public health, safety, and justice programs and services counties provide.
Having seen the result of your actions after two major cutoffs, we are deeply concerned that the
results of this legislative session will in fact be a “net loss” for county programs and services.
The measures listed on Table 1 (see page 2) will have a significant negative fiscal impact on counties,
particularly if taken cumulatively. We acknowledge that some of the following proposals have been
amended to slightly ameliorate the cost to counties. However, without mitigating the impacts of these
bills, counties will be forced to reduce programs and services that are constitutionally required or
legislatively mandated by the state.
Aside from the policy implications of these measures, it is simply irresponsible to continue to pass
additional costs of this magnitude on to counties without additional resources to pay for them.

HB 2633 ‐ Occupational Disease Presumption Local Gov’t costs based on additional claims is
$23 million in FY 2019 and $53 million for FY
2019‐23.
Local Gov’t costs based on LEOFF 2 contributions
are estimated at $3.4 million for FY 2019 and
$144.8 million for FY 2019‐FY 2043.
HB 2262 ‐ Wrongful Death 26 counties alone experienced $21 million in
wrongful death claims in the last 5 years, and the
state estimates that the bill will increase claims
by 20%.
HB 2511/SB 6340 ‐ PERS/TRS Pension COLAs The local gov’t impact for FY 2019 is $11.1
million.
The 10‐year local gov’t impact is $147.6 million.
HB 1655 – Industrial Insurance for Post‐ There is not a separate local gov’t fiscal note for
Traumatic Stress Disorder additional claim costs. The fiscal note estimates
that total claim costs from previous years would
be $45.4 million‐$124.6 million and going
forward per year would range from $2.8 million‐
$7.6 million.
The actuarial analysis just provides a range of
various scenarios, so the LEOFF impact on local
governments ranges from $4.5 million‐$12.2
million from 2017‐2042.
HB 1783 ‐ Legal Financial Obligations Potential County Revenue Loss:
17‐19 = $925K
19‐21 = $1.6M
21‐23 = $2.4M
Potential County Expenditures:
2017 = $2.4M
2018 = $915K
2019 = $356K
HB 1476 ‐ Septic Management Plans $2.5 million for 12 counties, every five years.
HB 2852 ‐ Attorneys’ Fees on Public Works No fiscal note requested.
Contracts
SB 6002 ‐ Voting Rights Act Fiscal note identified indeterminate increased
litigation costs.
As you can see, all of the bills that would have a negative impact on county services are moving this
session.
There are numerous proposals available to you that would assist counties in providing required
services, as outlined below in Table 2.

However, as you can see, most of the measures that would have a positive impact on county finances
have stopped moving and appear to be dead. We are very concerned that costly bills appear to be
headed for passage, while bills that would begin to mitigate these new costs have stalled.
I will be following up this letter with a request to meet with each of you about what can be done to
keep this session from having such a negative impact on the county programs and services that are
constitutionally required or legislatively mandated by the state.
