COUNTER – AFFIDAVIT

I, VIENA G. FARIO, of legal age, Filipino, single, with residence and

postal address at Sitio Kalipay, Opao, Mandaue City, after having been
duly sworn to in accordance with law do hereby depose and state, that –

1. I am the accused in IS no. 10303432 for the crime of violation of

paragraph 2 of Article 172 of the Revised Penal Code or
FALSIFICATION OF PRIVATE DOCUMENTS;

2. I admit paragraph 3 of the complaint against me.

3. Paragraph 11 is DENIED. The allegation that I fraudulently made

entries in the payroll reflecting Mr. John Doe reporting for work on the
dates where the latter was allegedly absent is not true. True enough,
being the payroll officer, I am responsible for preparing the payroll on
the basis of the working hours reflected in the DTR of each
employee. As such I only compute based on what is in the DTR thus
the reason for the inclusion of the questioned dates in the
computation of Mr. John Doe’s salary. There is also no truth in the
statement of the complainant that I admitted having committed the
allegedly fraudulent act when I was summoned in his office. Truth is, I
was called in the office to explain the discrepancies in the payroll to
which I heeded but I did not admit to the commission of any crime.

4. Paragraph 13 is also DENIED. The security guard may have seen me

punched in a DTR but that does not conclude that I punched-in the
DTR of Mr. John Doe.

5. I am executing this Counter-Affidavit to attest to the truth that I DID

NOT COMMIT THE CRIME OF FALSIFICATION OF PRIVATE
DOCUMENTS in whatever form as erroneously and maliciously
alleged by the complainant.
