APPLICATION FOR PROBATION

ACCUSED, through counsel, in the above-entitled case


respectfully states by way of application for probation, that:

1) The Honorable Court convicted them of the crime


charged, which carries with it a penalty of imprisonment
from 10 to 30 days, and sentenced them to serve the
penalty of IMPRISONMENT FOR 11 DAYS on 23 November
2017;

2) They have all the qualifications and none of the


disqualifications in order for them to avail of the benefits of
the probation law, to wit:

a) They were not sentenced to serve a maximum


term of imprisonment of more than six (6) years;

b) They were not convicted of any crime against


the national security;

c) They have not been previously convicted by


final judgment of an offense punished by
imprisonment of more than six (6) months and
one (1) day and/or a fine of more than one
thousand pesos (P1,000.00); and

d) They have not been once on probation.

3) They humbly submit their fate to the discretion of the
Honorable Court as they now apply for probation;

4) They shall comply with all the requirements or


conditions of the Honorable Court or the probation officer, if
probation is granted;

5) Should the Honorable Court graciously give due course


to the instant application, they humbly ask that the Office of
the Parole and Probation Board of Cabanatuan City to
conduct the necessary investigation report.

WHEREFORE, premises considered, it so moved that


this Application for Probation by the accused be given due
course.

Other reliefs appropriate under the circumstances be


granted.
