FAQ
How Do I Know If I Need A Criminal Defense Lawyer?
Anyone who wonders if they need a defense attorney should consult with one as soon as possible. There are no
negative consequences from contacting a lawyer too soon; waiting too long could cost you everything.
What Should Someone Do If He Suspects He Is Under Investigation?
The most important thing to remember is not to answer any questions, consent to any kind of search, or talk about
the situation to anyone other than your defense attorney.
What Should I Do After I Am Arrested?
It is always imperative to ask for an attorney and remember to remain silent and not answer any questions or make
any statements. Politely inform the officers or investigators that you do no intend to talk to them and nothing will
change your mind. After arrest, you will be booked into the county detention center. You may be immediately given a
bond amount or you may have to wait to appear in front of a judge. After posting bond, immediately consult with a
criminal defense attorney to begin working on your case.
What Is The Difference Between A Misdemeanor And A Felony?
Typically, misdemeanor charges are less serious offenses that are punishable by a year or less in jail and a small
fine. Misdemeanors are often exclusively handled in separate courts such as municipal or state courts. Conviction of
a misdemeanor will have a minimal impact on your life as you will retain your basic civil rights. A felony is a more
serious offense that is punishable by more than a year in a jail or prison and substantial fines. A felony conviction
may result in losing your right to vote, serve on a jury, own or possess a firearm, and obtain gainful employment.
Why Should I Hire A Lawyer That Specializes In Criminal Law?
Legally, any attorney who has completed law school and passed their state’s bar exam can practice law and
represent you in court. However, not all attorneys have the training and experience to effectively defend you in a
criminal matter. Like doctors, most attorneys have areas of expertise that they focus on. For example, if you needed
heart surgery, you should most likely consult a cardiologist, rather than an asthma specialist. Likewise, if you are
accused in a criminal matter, you need a criminal defense attorney as opposed to an attorney who specializes in
family or real estate law.

Criminal Mischief
Criminal Mischief Attorney – Shahin Zamir
Criminal mischief is defined in Section 28.03 of the Texas Penal Code as occurring whenever a person “intentionally
or knowingly” damages someone else’s property. This can include vandalism to property whether public or private.
Attorney Shahin Zamir has defended numerous criminal mischief cases. If you have been charged with criminal
mischief, contact the Law Office of Shahin Zamir at 713-228-8900.
Penalties Of Criminal Mischief In Texas
Criminal mischief is typically considered a misdemeanor, with the range of punishment varying based upon the
amount of property that was damaged. There can also be additional penalties if the criminal mischief involves
tampering with a water supply or using a firearm or explosives. Some of the penalties for criminal mischief may
include:
 Fines ranging from $500 to $10,000
 180 days to 2 years in jail
 Probation
 Community Service
Those Charged With Criminal Mischief
If you have been charged with criminal mischief, the State of Texas would like nothing more than for you to enter a
guilty plea without going to trial. By getting you to give up your right to a trial, prosecutors can wrap up the case
quickly and become heroes in the eyes of the property owner. In cases where there is shoddy evidence to begin with,
it might be difficult to prove these charges in a court of law. Prosecutors would like to have you believe there is no
other option but to accept the deal they have laid out or face even more severe consequences.
How A Criminal Lawyer Can Help
In cases where a plea bargain is your best option, the State of Texas is unlikely to give you a fair deal unless you are
represented by an aggressive defense attorney. Shahin Zamir will examine the evidence against you to determine if you
should plead guilty or ask for a trial. If the evidence is overwhelming and a guilty plea is best option, he will
aggressively negotiate with prosecutors in order to reduce the punishment drastically. Some of the strategies
performed to reduce or eliminate criminal mischief charges are:
 Disputing the state’s evidence
 Confronting witnesses and finding weaknesses in their story
 Looking at case law to see how similar situations have been handled in the past
 Determining if there are mitigating circumstances that would result in a lesser sentence
Attorney Shahin Zamir believes that every defendant deserves the best possible representation. For a free case

Animal Cruelty
Houston Animal Cruelty Lawyer – Shahin Zamir
Law enforcement officials in Texas review hundreds of animal abuse complaints each day, and they are not alone in
this regard. Activists and even civil judges in Texas also deal with situations related to the harming of animals. The
laws that prohibit and prevent animal abuse in the Lone Star State are not only complex but also open to intricate
interpretation.
Call today for a free case review: 713-223-8900.
Torturing animals, in essence, is a punishable offense; however, it may not always result in criminal charges.
Depending on certain circumstances, animal abuse cases can be tried in civil or criminal court divisions. According to
the Texas Penal Code, Harming animals may consist of activities such as:
 Cruelty
 Animal rights infringement
 Experimenting on animals
 Illegally slaughtering animals
Animal Harming Laws
Texas law makes a fine distinction between domesticated animals and wildlife. Cats, dogs and dairy cows are
generally considered to be domesticated; parrots that were caught in the wild but later kept in a cage as pets are also
domesticated. In Texas, torturing animals that have been domesticated is a crime. Activists who protect the rights of
animals may file complaints in civil court when they see criminal charges dismissed without prosecution.
Animal abuse complaints can be filed by many different parties, and the legal interpretation of these cases can
become complicated. For example, a cat that was once domesticated but then became a stray may be classified as a
wild animal, which means that harming that cat will not result in criminal charges or jail time. Nevertheless, a civil
complaint may be filed against the alleged attacker, who may be sentenced to pay restitution.
Arrested For Animals Rights Infringement
Defendants who are arrested for alleged cruelty to animals should not take matters lightly. Torturing animals could
land a defendant in jail for up to two years. Several defenses can be raised, and many of them involve taking a close
look at how the alleged abuse was reported. Complaints are sometimes filed out of an emotional response, which is
the main reason defense attorneys carefully analyze these cases. Proving animal cruelty is not always a cut-and-dry
affair, and this is something that prosecutors are often aware of.
