Dear Mr. Blutstein:

Reference is made to your Freedom of Information Law request, received December 1, 2017,
requesting “flight records for the Governor’s use of the Sikorsky S-76D helicopter that was
purchased in June 2017, including records reflecting costs for each flight (e.g., fuel, etc.).”

The records located in response to your request are exempt from disclosure, as release of
these records could endanger the life or safety of the Governor and our Members. See Public
Officers Law § 87(2)(f). Please be advised that information pertaining to the Governor’s use of state
aircraft can be found on the Governor’s past public schedules which can be found at the following
past-schedules. Please consult the websites periodically, as new months will be posted as they
become available.

Pursuant to Public Officers Law § 89(4)(a), any person denied access to a record may appeal
that determination within thirty days. Any appeals must be in writing and mailed to the Records
Appeal Officer, Administration, at the below address.
