Dear Mr. Uldricks,

The Ohio Attorney General’s Office, Bureau of Criminal Investigation (BCI), has
received your records request, in which you requested the following:

• results into the matter involving The Lakewood Observer, it's owner, Jim
O'Bryan and a fraudulent document posted on their website on November 3rd 2017. The
fake document detailed the results of an investigation conducted by the "Public Integrity
Unit" and was printed on Ohio Attorney General letterhead.
This public record request would include but is not limited to any police reports, emails,
interview transcripts, video and notes, computer logs, etc.

Your request is being denied. Upon review of our records in the manner in which they are
maintained, it has been determined that BCI does not have any records responsive to your
specific request. BCI did not investigate the above mentioned matter, the Cuyahoga County
Sheriff’s Office is investigating this matter, which is still an open investigation. At this time any
of their records potentially responsive to your request are investigatory work product in a
criminal law enforcement matter that has not concluded, and are therefore confidential law
enforcement investigatory records (CLEIRs) pursuant to R.C. 149.43(A)(1)(h) and (A)(2).
CLEIRs are exempt from disclosure under the Public Records Act to the extent that their
disclosure would create a high probability that investigative work product (and other exempt
matters) would be revealed. R.C. 149.43(A)(2)(c). The work product exception to the Public
Records Act applies to the entire investigative file until the law enforcement matter has
concluded. Since BCI did not investigatie this matter, you will want to request the above
mentioned records from the Cuyahog County Sheriff’s Office, one there investigation has been
completed.
