other land dated 25 June 1980 made between (1) Mortonhall Park Limited
(Vendor) (2) The Royal Bank of Scotland Limited (First Mortgagee) (3)
Alexander Richard Trotter (Second Mortgagee) and (4) Ross and
Outchester Farms Limited (Purchaser) contains the following covenants:-

THE Purchaser for itself and for its successors in title HEREBY
COVENANTS with the Vendor and its successors in title for the benefit
of the adjoining land of the Vendor and each and every part thereof
capable of being benefitted thereby and of the existing undertaking of
the Vendor that the Purchaser and its successors in title will not use
the description "Waren" in connection with any Caravan Park or similar
business carried on upon the property hereby conveyed by the Purchaser
or its successors in title.
2 (01.06.2001) The land tinted pink on the filed plan is subject to the
following rights reserved by a Conveyance thereof together with other
land dated 30 October 1980 made between (1) Ross and Outchester Farms
Limited (Vendor) and (2) Robert Alder Short Gladstone (Purchaser):-

EXCEPT AND RESERVING in fee simple to the Vendor and its successors in
title the owners and occupiers for the time being of the Vendor's
adjoining land and of every part thereof

(a) the unimpeded access of light and air at all times hereafter over
the said pieces of land hereby conveyed to any buildings of whatever
height and in whatever position they may be placed which have hitherto
been erected or shall hereafter (but not later than the expiration of
the period of eighty years from the date hereof which shall be the
perpetuity period applicable hereto) be erected or stand on the
Vendor's adjoining land or any part thereof and to all windows and
appertures which may from time to time (but not later than the
expiration of the said perpetuity period) be made in any such buildings
notwithstanding the said buildings and windows and appertures may from
time to time (but not later than the expiration of the said perpetuity
period) be altered in position height or otherwise and the Purchaser
hereby covenants with the Vendor that no building erection or structure
shall hereafter be erected built or placed upon the pieces of land
hereby conveyed or any part thereof which shall in any way obstruct or
interfere with the access of light and air the right to which is
hereinbefore reserved;

(b) the full and unrestricted right at any time hereafter and from time
to time to erect or permit to be erected any buildings or other
erections and to alter any building or other erection now standing or
hereafter to be erected on any part of the Vendor's adjoining land in
such manner as to obstruct or interfere with the passage of light and
air to any building which is or may be erected upon any part of the
land hereby conveyed and so that all privileges of light and air now or
hereafter to be enjoyed over any part of the Vendor's adjoining land by
or in respect of the land hereby conveyed shall be deemed to be so
enjoyed by the license or consent of the Vendor and not as of right;

(c) full right and liberty to enter upon the land hereby conveyed and
every part thereof for the purposes of inspecting repairing renewing
relaying and cleansing all sewers pipes cables and drains (including
field drains) now in under or upon the land hereby conveyed the Vendor
or other the person exercising such right doing as little damage as
possible to the property entered upon and restoring the surface and
making good all other damage without unnecessary delay at its or their
own expense or paying compensation in lieu thereof; and

(d) all quasi-easements and other rights in the nature of easements now
used or enjoyed over the land hereby conveyed and which would be
implied by statute or by reason of severance and take effect as

easements in favour of a purchaser of the Vendor's adjoining land if
the same had been conveyed to such purchaser and the property hereby
conveyed had been retained by the Vendor.
3 (02.08.2001) The land edged blue on the filed plan is subject to the
rights granted by a Deed dated 22 December 1995 made between (1)
Berwickshire Estates Limited and (2) Garry Gibson.

4 (19.11.2002) The parts of the land affected thereby are subject to the
leases set out in the schedule of leases hereto.
The leases grant and reserve easements as therein mentioned.
