Dear Mrs. Zuniga

Please be informed that an incident report was submitted by our quarry inspectors that
last Sunday, dated October 25, 2015 on or about 10:00 p.m. to 3:00 a.m. our quarry inspectors
both on 24 hour-duty in Batangan, Valencia City, Bukidnon reported that about 17 loads of sand
and gravel was transported to AYYU Builders stockyard, wherein, the said transported
aggregates was taken from you quarry site based on the Six (6) DR coupons collected. The
drivers of the first six (6) dump trucks presented 6 delivery receipt coupons, wherein your name
as the permittee was indicated in the DR coupon, while the drivers of 11 remaining dump trucks
failed to carry D.R. coupons. Accordingly, unidentified alleged worker from AYYU Builders
requested the quarry inspectors that he will hand over the Delivery Receipt coupons of eleven
(11) loads of sand and gravel in the morning.

The quarry inspectors, early in the morning, approached the concerned worker to
secure the 11 coupons as promised, but instead, the alleged AYYU Builder worker gave them an
envelope containing three thousand pesos (3, 000.00) and inserted in the pocket (POLO shirt) of
the quarry inspectors. The quarry inspectors opted not to return the money to be used as
evidence against the alleged haulers/trucks drivers/workers of AYYU Builders for bribing them
in exchange of 11 Delivery Receipt Coupons.

In as much as there is a violation of some of the provisions, laws, and regulation under
the small scale mining law, in conusance with the Philippine Mining Act of 1995(R.A. no. 7942),
, and since that your name was involved based on the DR. coupons used/presented, you are
hereby notified to appear in the office of the OIC of Bukidnon Environment and Natural
Resources (BENRO), to be subjected for an inquest regarding the abovementioned incident,
within 5 days upon receipt of this letter. Non-compliance of which may be subjected for a
sanction that may deemed necessary.

Dear Mr. Dumadag,

Please be informed that last Sunday, dated October 25, 2015 on or about 10:00 p.m. to
3:00 a.m. our quarry inspectors both on 24 hour-duty in Batangan, Valencia City, Bukidnon
reported that about 17 loads of sand and gravel was transported to AYYU Builders stockyard.
The drivers of the first six (6) dump trucks, presented 6 delivery receipt coupons, while the

Based on the preliminary investigation conducted by the BENRO investigating team, the
quarry inspectors who were on duty at the time of the incident, disclosed that the request of
the alleged worker from AYYU Builders was allowedconsidering that the AYYU Builders
Stockyard is in the close proximity to the Quarry checkpoint. The quarry inspectors, early in the
morning, approached the concerned worker to secure the 11 coupons as promised, but instead,
the alleged AYYU Builder worker gave them an envelope containing three thousand pesos (3,
000.00) and inserted in the pocket (POLO shirt) of the quarry inspectors. The quarry inspectors
opted not to return the money to be used as evidence against the alleged haulers/trucks
drivers/workers of AYYU Builders for bribing them in exchange of 11 Delivery Receipt Coupons.

As per advice by the BENRO field supervisor, an incident report was made by the quarry
inspectors, and the Bribe money was deposited in the Provincial Treasurer Office.

Thus, in violation of some of the provisions, laws, and regulation under the small scale
mining law, in conusance with the Philippine Mining Act of 1995(R.A. no. 7942), and in
violation under the Revised Penal Code with regardsto the act of bribery, you are hereby
notified to appear in the office of the OIC of Bukidnon Environment and Natural Resources, to
be subjected for an inquest regarding the abovementioned incident, within 5 days upon receipt
of this letter. Non-compliance of such may be subjected for a sanction that may deemed
necessary.

Dear Mr. Ulep,

The Bukidnon Environment and Natural Resources Office (BENRO) headed by Ms. Cecille M.
Egnar, Officer-In-Charge has making an investigation and close monitoring, as per mandate by the
Provincial Governor of Bukidnon Hon. Jose Ma. R. Zubiri, Jr. through Memorandum Order No. 646-A,
Series of 2015 which state the Terms and reference in Strengthening the Management in the inspection
and Monitoring of Extracted and Transported Mineral Resources in various checkpoints in the Province
of Bukidnon, to all issues and concerns which violates some of the provisions, laws, rules and regulation
of the following: Republic Act No. 7160, known as the Local Government Code of 1991, Republic Act No.
7942, An Act instituting a New System of Mineral Resources Exploration, Development, Utilization, and
Conservation of Mineral Resources and Local Revenue Code of Bukidnon. The purpose of such mandate
is to systematize the inspection and monitoring of all quarry operation in some areas in the Province of
Bukidnon.
Last June 2015 up to December of the same year, the BENR Office has been receiving incident
reports, wherein there are already 54 dump truck units operating and transporting minerals that were
reported to have committed Hurdle and other violations under the abovementioned laws. The office
have recorded the plate numbers of the delinquent dump truck drivers the problem is that we don’t
have the means of locating the owners of the said truck units, in which we strongly believe that your
office can be of help.
In connection to this matter, I would like to request your good office that the 54 delinquent
dump truck units with corresponding plate numbers, that they put in to alarm/hotlist by issuing a
memorandum to all the LTO offices here in Bukidnon; that before they can renew their registration in
2016 they must have to clear/settle firstly all their pecuniary obligations and penalties in the office of
the Provincial Administrator, and secondly to secure a certification of compliance in the office of BENRO
presenting all attachments that are deemed necessary, and to be signed by Ms. Cecille M. Egnar, OIC.

Attached herewith are the list of Plate Numbers, Description of the truck, date and time of the
incident, issues/violations committed.
