CFMEU MEMBER UPDATE REGARDING ONE KEY


• One Key Workforce (OKW) has gone into administration – the Union is representing members’
interests during this process.

• The Union’s compensation deal for members employed under One Key agreements is still in
place.

One Key Workforce (OKW) – one company within the One Key Group – has announced it is going into
administration due to financial insolvency.

CFMEU Mining and Energy National Legal Officer Adam Walkaden will attend the OKW creditor’s
meeting in Brisbane on 12 September to represent members’ interests, which include claims for
outstanding entitlements.

Members affected by the OKW administration are advised to accept new offers of employment within
the One Key group once your employment with OKW is terminated. However, employees should not
resign their employment as this may limit any potential claim under the Fair Entitlements Guarantee
Scheme.

The Union has reached a settlement for members employed by a number of One Key companies,
including OKW. Whilst there have been some recent legal issues that have held up the compensation
that will flow from that agreement, we are confident these will be resolved in the near future.

A little-known Canberra law firm called Adero has lodged an appeal against the Fair Work Commission’s
approval of the FES Coal agreement. Our assessment is that the appeal is unlikely to be successful and
the agreement will stand.

Adero is trying to cash in on the Union’s legal success in challenging substandard conditions for labour
hire workers arising from the recent Federal Court cases run by the Union involving One Key and
Workpac. It is disappointing they are challenging an agreement that will deliver substantially better
conditions and job security.

This remains a complicated legal matter because of the voluntary administration of OKW and the legal
interference by Adero. However, we will continue to work through the outstanding matters and fight for
the best interests of affected members.
