LARRY LEWIS, being first duly sworn upon his oath, deposes and states the following:

1. Your Affiant is a sworn law enforcement officer employed by Ogden City PD.
Your Affiant is personally acquainted with the facts in this case.

2. On 6-13-18 at approximately 1628 hours, Ogden Police Officers responded


to a gunshot wound at 630 East 23rd Street. Upon arrival, officers located
victim D.S. in the east parking lot, with gunshot wounds to his body. D.S.
was transported to McKay Dee Hospital where he died as a result of his
injuries.

3. There were several witnesses working near the scene of the shooting in the
north end of the parking lot. They saw two Black males standing in the
parking lot arguing, one being the victim and the other being the suspect. At
least one witness describes the suspect as being quite a bit shorter than the
victim. They stated there was a Black female standing near a silver vehicle
parke,d in the southeast comer of the parking lot. The unknown Black Male
got into the vehicle and D.S. walked over to the vehicle and continued to
speak with the unknown Black male. The unknown Black male got out of
the car and appeared to pull a gun from his waistband and fired several
shots'at D.S. at almost point blank range. At least one of the witnesses
stated the unknown Black male then got back into a Silver, Hjrundai,
Veloster and exited the parking lot going westbound on 23rd Street. The
other witnesses were not positive what type of vehicle it was but described it
as a Silver, hatchback vehicle with the front bumper missing. The witnesses
were not sure if the suspect was driving or the Black Female was driving,
but they were both in the vehicle. The witnesses described the suspect as
wearing a white t-shirt and black pants or shorts.

4. There were three witnesses in a personal vehicle driving by the apartment


complex at 630 East 23rd Street. They were driving home from the library
when they heard gunshots. They described seeing a Black male running
back\yards firing a gun at the victim, and then getting into a silver vehicle
that began driving away from the scene. They followed behind the suspect in
their personal vehicle. The silver vehicle went west on 23rd St, South on
Ogden Ave, and then East on 24th before they lost sight of it. The witnesses
returned to the scene to speak with officers. The driver of the witness vehicle
stated there was a "6 and a "7" in the license plate of the suspect vehicle.
The witnesses believed the Black female was driving the vehicle. The
witnesses described the suspect clothing as being dark, but they couldn't
remember.

5. On May 30, 2018, Officer Slater from South Ogden Police Department made
a traffic stop on a 2016, silver H5mndai Veloster, Utah license plate
W670ZM, driven by Keshaun Puente. The vehicle is currently registered to
17-ye^-old female. Information learned from other interviews and social
me^a is the registered owner is the girlfriend of Keshaun Puente.
6. Ogden Detectives spoke to the grandparents of Keshaun Puente, who live in
the s^e apartment complex the shooting took place at. Keshaun's
grandparents stated that Keshaun left their apartment located at 630 23rd
St approximately five minutes prior to the shooting. They also said Keshaun
is usually driven around by his girlfriend, but did not know her name.

7. Security camera footage from the Weber County Building (2380 Washington
Blvd), shows the Silver Hyundai Veloster going west on 24th Street stopped
at the red light on 6-13-18 at 1630 hours. The video shows the Veloster
missing the front bumper, but the windows are tinted too dark to see
anyone inside. Security camera footage from Autoliv shows the same
Hyundai Veloster traveling south on Pennsylvania Ave on 6-13-18 at 1638
hours. The video shows the damage to the front of the vehicle (missing
bumper). Williams International security camera footage shows the same
vehicle turning right from Pennsylvania Ave and heading west on 31st
Street.

8. The suspect vehicle was later located in North Las Vegas Nevada. The
vehicle was brought back to Utah to be processed by CSI. I assisted CSI in
processing the vehicle. In the glovebox of the vehicle I located Keshaun's
Utah'Birth Certificate. I also located a promise to appear for Keshaun from
Laytoh District Court. I also located a receipt from the Riverdale Wal-Mart
from 6-13-18 at approximately 1600 hours. I later went to the Riverdale
Wal-Mart and had Wal-Mart Asset Protection locate security camera footage
of the Wal-Mart transaction. I was able to identify the suspect vehicle was
brought in to Wal-Mart to be serviced. I identified the 17-year-old female and
Keshaun. At the time Keshaun was wearing black workout type pants and a
white t-shirt.
9. On June 23, 2018, the 17-year-oId female registered owner of the suspect
vehicle was located. I interviewed the registered owner at the Ogden Police
Department. The female stated she drove Keshaun to the apartment
complex 630 23rd Street to see his grandparents. She left in the vehicle and
went to the store. She returned a short time later to pick up Keshaun. She
parked the vehicle in the southeast corner of the parking lot as witnesses
described. She stated Keshaun was waiting for her in the parking lot and
was getting in the passenger side of her vehicle when she heard
approximately three gunshots. She quickly backed out of the parking stall
and fled the area. She stated a vehicle followed them and she drove and was
able to lose the people following them. She stated she and Keshaun were the
only people in the vehicle. She and Keshaun were planning a vacation to
Las Vegas, so that's where they went. She just returned to Utah today, and
stated Keshaun was still in Las Vegas.

10. All the witness's officers spoke to, stated the suspect shot the victim and
got into a silver, hatch back vehicle that was missing the front bumper with
a Black female either as a passenger or driver. Some even stated it was a
Silver, Hyundai, Veloster. The witness that followed the vehicle and stated it
had a "6" and a "7" in the license plate. The suspect vehicle has Utah listing
W670ZM attached to the rear of the vehicle. Several -witnesses stated the
suspect was wearing a white t-shirt and black pants or shorts. Keshaun's
grandfather also stated he was wearing a white t-shirt and black pants or
shorts when he left his apartment approximately five minutes before the
shooting occurred. There is video of Keshaun at the Riverdale Wal-Mart
approximately 25 minutes prior to the shooting wearing a white t-shirt and
black pants. The 17-year-old female puts her vehicle in the parking lot with
Keshaun just prior to the shooting. After hearing the gunshots, they flee the
area -with another vehicle chasing them. They are able to lose the vehicle
chasing them and they get on the freeway and head to Las Vegas. There is
probable cause to believe that Keshaun Puente shot and killed D.S. and fled
the scene in his 17-year-old girlfriend's vehicle.

WHEREFORE,affiant prays that a Warrant of Arrest be issued to best meet the


ends ofjustice.
