DEED OF WAIVER OF RIGHTS

KNOW ALL MEN BY THESE PRESENTS:

That this Deed of Waiver of Rights is being executed this _____ day of
_________________, 2018 in _______________________________________, by:

I, CELERINO CATANI, of legal age, Filipino, and a resident of Bacuag, Surigao del
Norte, after being sworn in accordance with law, hereby declare that:

1. That I am one of the surviving heirs of CELERINA VDA. DE CATANI who died
on February 10, 1998 at Bacuag, Surigao del Sur;
2. That prior to her death she owned a parcel of land which was inherited
from her parents more particularly described in Transfer Certificate of Title
No. T-397the and Tax Declaration No. 2705 covering an area of 28,093
square meters situated in Soyok, Poblacion, Bacuag, Surigao del Norte;
3. That without my knowledge, she sold the above-mentioned parcel of land
on August 4, 1995 to NOE C. ELIZAGA with an area of 18,049 square meters
and ROSARIO L. KIWITT with an area of 10,044 square meters;
4. That on January 20, 2014, Transfer of Certificate of Title No. 160-
2014000013 was issued in favor of ROSARIO L. KIWITT and NOE C. ELIZAGA;
5. That, from the time of sale (1995) up to the year 2007, real property taxes
of the above-described parcel of land covered by Tax Declaration No. 2705
and payable to the local government (LGU) continue to accumulate
because of the delay in the transfer of title, the LGU sold the property in a
public bidding;

6. That I purchased the above-described property and paid the taxes and fees
in the public bidding conducted by the LGU that caused the issuance of Tax
Declaration No. 9788 dated April 26, 2007;

7. That the buyer NOE C. ELIZAGA, whose portion of the property covered by
TCT No. 160-2014000013 was affected by the issuance of Tax Declaration
No. (TDN) 9788, wants the cancellation of said TDN and issuance of a new
one in his favor because of the fact that the portion was already sold to him
and a title was issued;

8. That the buyer NOE C. ELIZAGA is willing to reimburse the amount paid
during the public bidding and all other expenses related to the issuance of
TDN 9788, and I execute this DEED OF WAIVER OF RIGHTS in his favor for
the cancellation of TDN 9788 and the issuance of a new Tax Declaration;
9. That I, the undersigned, do hereby WAIVE, TRANSFER AND CONVEY ALL MY
RIGHTS, INTERESTS AND OBLIGATIONS over said parcel of land covered by
Tax Declaration No. 9788 in favor NOE C. ELIZAGA, by affixing my signature
herein below with his acceptance of the same who hereby assume any
obligations that may arise with the transfer of said parcel of land;
