I believe there is probable cause to charge the defendant with these charges because:
On 11/24/2018 I observed a suspicious vehicle parked in the corner of the parking lot at Footprinter Park in Provo. The vehicle
began to accelerate away as I approached before I activated my overhead lights. I contacted the driver, Michael Boyd, and
informed him the park was closed. A male was seated in the front passenger seat with his seat reclined back and no seat belt
fastened. Michael admitted he did not have a valid license and provided a Utah ID Card. A record checked showed a suspended
license. I advised the driver I could smell the odor of marijuana and asked him to exit the vehicle. He initially refused before
exiting along with the passenger. As soon as Michael stood up, I observed a bag of marijuana on the floor between his feet and
the seat. In the center console there were several plastic bags, a container with what I recognized to be marijuana oil residue,
another with “dab” a marijuana concentrate, 15 pills containing what I recognized to possibly MDMA, $401 cash in multiple
denominations, a scale with marijuana residue and numerous other items of paraphernalia. The MDMA was field tested and
showed positive. Several more bags of marijuana were found in a bag located in the back seat behind the driver. Several of the
bags were labeled with individual weights. The total gross weight of the marijuana located was 180.8 grams, which based on my
training and experience is more than an individual user amount. The marijuana was also field tested and showed positive for
THC. The “dab” had a weight of 1.3 grams

When advised he was being placed under arrest, Michael asked how we could prove the drugs belonged to him. I commented on
some of the items being in his bag with items with his name on them. Michael advised the items did not belong to the passenger.
I placed Michael under arrest and transported him to the jail where he was read the chemical testing admonition. He initially
refused, but later consented after being read the refusal and right to counsel admonitions. Blood and urine tests were conducted
by forensic nursing. A preliminary urine test showed positive for THC, methamphetamine, amphetamine, and cocaine. Michael
said he had not used meth but stated it was probable because of “Molly” or MDMA that he tested positive for methamphetamine
and due to his Adderall prescription, he tested positive for amphetamines.

Michael was convicted on 2/13/18 of class A charge for possession of a controlled substance with intent to distribute.
