Greetings of peace!

I am pleased to present the 2012-2013 State of Barangay Report which contains the performance
of Barangay Magdalo along the four (4) performance areas namely: Administration; Social
Services; Economic Development and Environmental Management.

This report shall serve as the basis in the formulation of programs, projects and activities that are
responsive to the needs of our constituents. It will serve as reference in crafting the Barangay
Agenda as embodied in the Barangay Development Plan.

This report also aims to strengthen the partnership of the Barangay with the higher Local
Government Units (LGUs), National Government Agencies (NGAs), Non Governmental
Organizations (NGOs) and stakeholders as it presents a vivid picture of the development
condition of the Barangay. Above all, it aims to increase awareness of the residents on the state of
the Barangay, so that they become more involved and participative in Barangay affairs.

Lastly, on behalf of the officialdom of our Barangay, may I congratulate and thank the
Department of Interior and Local Government (DILG) in coming up with the Barangay
Performance Management System (BGPMS) which will pave the way for the establishment of the
state of governance of the Barangay.

Brief History of the Barangay
HISTORICAL DEVELOPMENT

Since 1990 under the leadership of Mayor Ayong Maliksi and Gov. Johny
Remulla “Barangay Magdalo” was founded. The first Barangay Chairman that was
being appointed by Mayor Ayong Maliksi was Mr. Rudy Vasquez which also
consisted by six councilors, amongst they are: Fe Escalante, Ronald Balalad, Conrado
Litan, Rolando Briones, Ernesto Rafael and Marlyn Asido.

CREATION OF BARANGAY MAGDALO

In 1994, Barangay Magdalo held their first election by which Rudy Vasquez
was duly elected and officially the first Barangay Chairman of Barangay Magdalo.
The first batch of councilors is: Rolito Caberoy, Cita Abudancia, Delia Santos, Elbert
Marasigan, Orlando Marquilencia, Nila Egar and Romy Supilinas.

Once again, in 1997 another election held in this Barangay. The new leader for
this administration was Barangay Chairman Rolito Caberoy followed by his
councilors Romy Supilanas, Dean Sadsad, Orlando Marquilencia, Elbert Marasigan,
Nila Egar, Lorna Alquiros and Aries Concordia but Aries Concordia has to work
abroad so Mario Corpuz replaced his position for this term.

For the third time, Rolito Caberoy still wants to serve Barangay Magdalo and
so the people once again re-elected him as Chairman. The councilors for this term
are: Mario Corpuz, Lorna Alquiros, Orlando Marquilencia, Delia Santos, Elbert
Marasigan, Joselito Nato and Nila Egar.

The state of Barangay Governance Report shows that the Barangay’s overall
total average performance rating is 0.90. The area of Economic Development should
be the top priority for development considering that the total adjectival rating of the
top priorities is 33% to focus on the services areas of Entrepreneurship, Business
and Industry promotions.

In general, the level of effort which had brought about desirable performance
or condition in the areas of Governance and Environmental Management has to be
sustained.

Problematic areas have to be given full consideration. Otherwise, the pace of


development and change will be showed down by the problems. Starting on the
ensuing year, the following initiatives shall be pursued.

The Calendar Year 2013 Budget amounted to ₱ 4,868,782.24. The expenditure


program was distributed as follows.

The Developmental Budget had an allotment of ₱ 928,921.60. Among the


sectors, it received the biggest share of 20% of the total budget.

On the other hand, the total picture of the fund utilization shows that the
barangay incurred 88% expenses of its budget. Overall, it indicates a 12% savings.

Significantly, the barangay spent its financial resources hugely on


Development Projects or 20% of the total budget.

Summarized in this report is the Barangay performance for CY 2013. This
describes the state of Barangay Governance performance in the five performance
areas: Governance, Administration, Social Services, Economic Development and
Environmental Management.

The Barangay garnered an overall performance average score of 0.90 or a
performance level of 4. Despite overcoming the rigorous processes in the
implementation of the different policies and programs in the Barangay, there are still
several issues/ deficiencies which need necessary improvement:

On Administration, where we have nine (9) service areas, it earned an average


performance level of 4. This is attributed to the implemented projects, improvements
of session hall; prioritize projects for the Senior Citizen and Youth of our
Barangay and availability of all services provided by the Barangay
Administration. An average rating of 0.98 was attained which indicates that there
are some factors that affects the rating particularly on revenue generation which
is the current council is doing pretty well to resolve on this issue. Some of the
contributory factors that attributed to the rating were the availability of all services
provided by the Barangay Administration, Financial Accountability and
Customer Service.

On Social Services, we obtained an average rating of 0.82 which indicates that


our Barangay is in practice of giving health and nutrition needed by conducting
different medical mission and proper information about any health issues just to
save our constituents. This is credited to the annual free Anti-rabies, free Pap
smear, Operation Tuli, free vaccine for new born and other related matters.

On Economic Development, the Barangay got an average rating of 0.80, out of


4 indicators our Barangay achieve 3 out of 4 which points out on the sustained
effort of the Barangay in Entrepreneurship, Business and Industry Promotion.
Only contributing factor that affect this average is because of the absence of
Cooperative in our Barangay

Also rated is how the Barangay faired in Environmental Management under the
Service Areas of Natural Resources Management and Waste Management and
Pollution Control where it garnered an average rating of 1.00. This is attributed to the
Organized Barangay Ecological Solid Waste Management Committee
(BESWMC, Improvement of Garbage Collection, Maintenance of Sewerage /
Drainage, Availability of Materials Recovery Fund of MRF, and Distributions of
Garbage Can).

With the full cooperation of all sectors concerened paved the way towards the
success of the year under review, CY 2012-2013.

Report Findings
I. Administration

All local government units including the Barangay need to undergo self-
assessment to measure their performance in terms of delivery of services. This
includes the Administrative System and Procedure the Sangguniang uses in running
the affairs of the Barangay. It contains indicators that measure the Barangay’s
performance which include the assessment on the functionality of Barangay
equipment or facilities. There are three (3) sub areas which include Local
Legislation, Transparency and Citizen’s Participation.

 BARANGAY LEGISLATION

Legislation is the heart of governance. This is the foundation of effective


implementation of laws which leads to a better management and development of the
LGU.
One of the basic functions/roles of the Sangguniang Barangay is the
enactment of ordinances and adaptation of resolutions. This process is called
legislation. In order to formulate responsive ordinances/resolutions, there is a need to
have proper structure and process. A monitoring process is needed in order to check
the implementation of ordinances.

 TRANSPARENCY

Public trust should always be given premium/importance by the Barangay


officials. It is necessary that their constituents are informed and made aware of the
operation of the Barangay affairs. We have established public help desk and
information services that enables access to public the information and awareness they
could acquire in terms of the plans, programs, ordinances, enactments and other
related services offered by the local administration.

The indicator contained in the data capture form of the BGPMS reveals

 CITIZEN’S PARTICIPATION

The involvement and participation of the different stakeholders is very


important especially in voicing out their concerns and aspirations for the Barangay.
Their inputs are also vital during planning and formulation of laws. That will provide
us the sound policy – formation of our plans and programs.

Citizen’s participation is one of the important aspects of governance; this is


a manifestation that supreme power is lodged to the citizenry.

The administered BGPMS Data Capture Forms reveals the following


information:

Barangay administration is one of the crucial and essential functions of the
barangay. This includes 6 indicators: Development Planning; Human Resource and
Development; Customer Services; Financial Accountability; Revenue Generation and
Resource Allocation and Utilization.

 DEVELOPMENT PLANNING

Barangay officials and various sectored representative’s work together to chart


the future development of the barangay and address relevant problems and concerns
affecting the community. It is in this activity where programs, projects and activities
are identified and prioritized to ensure judicious utilizations of the barangay funds.

The administered BGPMS Data Capture Forms reveals the following


information:

 REVENUE GENERATION

Laws / ordinances enacted / passed by the Sangguniang Barangay for the


collection of taxes, fees and charges or generate revenues. RA 7160 alllows the
barangay to create, provide other sources of funds for development projects that will
benefit the barangay residents, subject to limitations as provided for by the law.

Results of the BGPMS Data Capture Form revealed the following:

Compliance to mandatory budgetary allocations of barangay ensures that


the vital service functions are funded and the priority development concerns of the
Barangay are implemented.

Further, actual expenditure figures confirm whether the budgetary


appropriation have been disbursed for the intended service functions.

II. Social Services

The Barangay, although the smallest political unit, plays a very


important role in the delivery of basic services to its constituents as provided for in
the Local Government Code. There are three basic services under this performance
area that determines if the Barangay’s program, project and activities are in harmony
with the LGC. The three (3) service areas are Health and Nutrition, Education,
Culture and Sports and Peace, Security and Disaster Preparedness.

 HEALTH AND NUTRITION

Health is wealth. This is the reason why most officials prioritize health and
nutrition services. Although higher LGUs, such as the province and municipality,
provide health and nutrition services, the barangay also is mandated to deliver basic
health and nutrition services to its constituents.

According to the indicators contained in the data capture form of the

Conclusion

As our Barangay Officials are doing their part to promote better


governance, we adopted a mechanism to keep track of the barangay’s productivity
and performance through the Barangay Governance Performance Management
System. It is a self assessment tool to measure the capabilities and limitations of the
barangay in the delivery of essential public service to the people. Result of this report
shall serve as the guiding reference in addressing people’s concern along the five (5)
Performance Areas: Governance, Administration, Social Services, Economic
Development and Environmental Management with the corresponding seventeen (17)
service areas.

We assure you that we have geared or plans, programs, and accomplishments


for the year that has passed on the way to the achievement of a more advantageous
state in the future, and that the community will keep on to get better, and that all
leaders shall become more devoted to public service true to their sworn duties and
responsibilities and attentive of what is favorable to the public.

Completely aware of that visualization, and in the perspective of our mission,

CREATING THE BIDS AND AWARDS COMMITTEE OF THE BARANGAY


GOVERNMENT OF BARANGAY MAGDALO Imus City, PURSUANT TO REPUBLIC
ACT NO. 9184.

WHEREAS, Republic Act No. 9184 (R.A. 9184), entitled “An Act Providing for
Modernization, Standardization and Regulation of the Procurement Activities of the Government
for other Purposes”, was signed into law on January 10, 2003, and took effect on January 26, 2003,
and it’s Implementing Rules and Regulations Part-A (IRR-A) took effect on October 8, 2003;

WHEREAS, Section 4 of R.A. 9184 provides that it shall apply to the procurement of
infrastructure projects, goods and consulting services, regardless of source of funds, whether local
or foreign by all branches and instrumentalities of Government including local government units;

WHEREAS, pursuant to Government Procurement Policy Board (GPPB) Resolution No.


01-2004 dated March 10, 2004 adopted and confirm the Bids and Awards Committee (BAC)
composition in LGUs, including the barangays;

NOW, THEREFORE, I Orlando C. Marquilencia, Punong Barangay of Barangay


MAGDALO, Imus City, do hereby order.

SECTION 1. There is hereby created a Committee to be known as the Bids and Awards
Committee (BAC) of this Barangay to be composed of the following:

1. At least five (5) but not more than seven (7) regular members of the
Sangguniang Barangay, except the Punong Barangay; and

2. The Punong Barangay, being the local chief executive, shall designate
thru an office order the members of the BAC and it’s Secretariat for one (1) year
term. The members shall elect among themselves who shall act as the Chairman and
Vice-Chairman.

SECTION 2. The committee created is charged with the task provided for in the IRR-A of
R.A. 9184;

SECTION 3. A majority of the BAC composition as designated shall constitute a quorum


for the transaction of business, provided that the presence of the Chairman or Vice Chairman shall
be required.

SECTION 4. The Chairman or in his absence, the Vice-Chairman, shall preside at all
meetings of the BAC. The decision of at least a majority of those present at a meeting at which
there is quorum shall be valid and binding as an act of the BAC.

SECTION 5. The Chairman or, in his absence, the vice-chairman, shall vote only in case of
a tie.

SECTION 6. This order shall take effect immediately.

AN ORDER MANDATING THE DEVELOPMENT OF A CITIZEN’S


CHARTER FOR BARANGAY MAGDALO, CITY OF IMUS, CAVITE AND
CREATING THE TASK FORCE FOR THE PURPOSE AND
APPROPRIATING FUNDS THEREFORE
WHEREAS, Republic Act No. 9485 otherwise known as Anti-Red Tape Act of 2007
declares that it is the policy of the State to promote integrity, accountability, proper management
of public affairs and public property as well as to establish effective practices aimed at the
prevention of graft and corruption in the government;

WHEREAS, R.A. 9485 mandates the barangay governments to set up service standards to
be known as Citizen’s Charter in the form of information billboards to be posted at the main
entrance of offices or at the most conspicuous place, or in the form of published materials written
either in English, Filipino, or in the local dialect;

WHEREAS, the leadership advocates the promotion of good barangay governance through
clear, transparent, accountable and responsive public service delivery;

WHEREAS, the leadership is aware of the benefits of having a Citizen’s Charter as it


improves service delivery, reduce vulnerability to graft and corruption, provide a basis for assessing
the performance of the barangay officials and staff, as well as feedback mechanism to determine
client satisfaction, equal treatment of clients, availability of complaints and redress mechanism, and
opening of opportunity for people participation on service improvement, among others;

WHEREAS, it is the leadership’s desire for Barangay MAGDALO and its residents, to reap
the said benefits through the establishment of its own Citizen’s Charter.

NOW THEREFORE, by virtue of the powers vested upon me as the local chief executive
of Barangay MAGDALO, hereby order the following:

SECTION 1. Formulation of a Citizen’s Charter for Barangay Magdalo. Barangay Magdalo


shall establish an official document, a service standard, or a pledge that communicates, in simple
terms, information on the services that is provides to its constituents. The said document shall
describe the step-by-step procedures for availing a particular service, and shall include the

b.Identification of the frontline services offered, and the recipients of such services;
c.The step-by-step procedure to obtain a particular service;
d.The officer or employee responsible for each step;
e.The maximum time to conclude the process;
f.Document/s to be presented by the client, with a clear indication of the relevancy of said
document/s;
g. The amount of fees, if necessary;
h. The procedure for filing complaints in relation to requests and applications, including the
names and contact details of the officials/channels to approach for redress;
i. Allowable period for extension due to unusual circumstances; i.e. unforeseen events
beyond the control of the barangay government; and
j. Feedback mechanisms, contact numbers to call and/or persons to approach for
recommendations, inquiries, suggestions, and complaints

SECTION 2. Creation of the Task Force on Citizen’s Charter Preparation. A Task Force on
Citizen’s Charter Preparation shall be created to take the lead in the formulation, writing and
packaging of the Citizen’s Charter. The Task Force shall be composed of the following:

d. If feasible, institute hotline numbers, short messaging services information
communication technology and other mechanisms by which the clients may adequately
express their complaints, comments or suggestions; and
e. Institute a one-stop shop or walk-in service counter or special lanes for pregnant women,
senior citizen and persons with disabilities.

SECTION 4. Sanction. All concerned barangay officials, whether elective or appointive, shall also
be held responsible and accountable for the implementation of this Act and shall be held
accountable to the public in rendering fast, efficient, convenient and reliable service. Failure of all
concerned barangay officials to act accordingly shall be penalized pursuant to Section 1, Rule VIII
of Implementing Rules and Regulations of R.A. 9485, to with:

(a) Light Offense –


(1) Refusal to accept application and/or request within the prescribed period
or any document being submitted by a client;
(2) Failure to act on an application and/or request or failure to refer back to
the client a request which cannot be acted upon due to lack of requirements/s
within the prescribed period;
(3) Failure to attend to clients who are within the premises of the office concerned
prior to the end of official working hours and during lunch break;

(4) Failure to render frontline services within the prescribed period on an


application and/or request without due cause;
(5) Failure to give the client a written notice on the disapproval of an application or
request; and
(6) Imposition of additional irrelevant requirements other than those listed in the
first notice under Rule VI, Section 1 (6).

Penalties for light offenses:

WHEREAS, Republic Act. No. 7610 otherwise known as Special Protection of Children

WHEREAS, Executive Order No. 310 series 2000 authorizes the adoption and
implementation of the Philippine National Strategic Framework for Plan Development for Children
2002-2025 for “Child 21”;

WHEREAS, DILG Memorandum Circular no. 2002-126 dated August 8, 2002 mandates
the compliance with the directive to the attainment of the goals and objectives of Child 21 and
ensures that Local Council for the Protection of children (LCPC) at all levels is organized and made
functional especially in the barangays;

7. Prepare and submit to the local sanggunian through the LDC the annual BDRRMC Plan and
budget, the proposed programming of the BDRRMF:
8. Conduct continuous disaster monitoring and mobilize instrumentalities and entities of the
barangay, CSOs, private groups and organized volunteers, to utilize their facilities and
resources for the protection and preservation of life and properties during emergencies in
accordance with existing policies and procedures;

12. Maintain a database of human resource, equipment, directories, and location of critical
infrastructures and their capacities such as hospitals and evacuation centers;
13. Develop, strengthen and operationalize mechanisms for partnership or networking with the
private sector, CSOs, and volunteer groups;
14. Take all necessary steps on a continuing basis to maintain, provide, or arrange the provision
of, or to otherwise make available, suitably-trained and competent personnel for effective
civil defense and disaster risk reduction and management in its area;
15. Organize, train, equip and supervise the local emergency response teams and the ACDV s,
ensuring that humanitarian aid workers are equipped with basic skills to assist mothers to
breastfeed;
16. Respond to and manage the adverse effects of emergencies and carry out recovery activities
in the affected area, ensuring that there is an efficient mechanism for immediate delivery of
food, shelter and medical supplies for women and children, endeavor to create a special
place where internally-displaced mothers can find help with breastfeeding, feed and care for
their babies and give support to each other;
17. Within its area, promote and raise public awareness of and compliance with this RA 10121
and legislative provisions relevant to the purpose of this Act;
18. Coordinate other disaster risk reduction and management activities;
19. Establish linkage/network with other LGUs for disaster risk reduction and emergency
response purposes;
20. Establish a Barangay Disaster Risk Reduction and Management Operations Center;
21. Prepare and submit, through the LDC, the report on the utilization of the BDRRMF and
other dedicated disaster risk reduction and management resources to the local Commission
on Audit (COA), copy furnished the regional director of the OCD and the Local
Government Operations Officer of the DILG; and

SECTION 3. Secretariat. The chairman of the Council will designate the Secretariat which
will provide administrative and technical support services to their respective BDRRMC members.

DESK AND DESIGNATING VAW DESK OFFICER THEREAT

WHEREAS, The State condemns discrimination against women in all forms and pursues by
all appropriate means and without delay the policy of eliminating discrimination against women in
keeping with the Convention on the Elimination of All Forms of Discrimination Against Women
(DECAW) and other international instruments consistent with the Philippine law. The State shall
accord women the rights, protection and opportunities available to every member of society;

WHEREAS, The Magna Carta of Women (RA 9710) enacted on August 14, 2009 is a
comprehensive women’s human rights law the seeks to eliminate discrimination against women by
recognizing, protecting, fulfilling and promoting the rights of Filipino women, especially those in
the marginalized sectors;

WHERAS, Chapter IV, Section 9. Protection from Violence of the same Act provides for
the establishment of a Violence Against Women (VAW) Desk in every barangay to ensure that
violence against women cases are fully addressed in a gender-responsive manner;

WHEREAS, Joint Memorandum Circular No. 2010-2 of DILG, DSWD, DepED, DOH and
Philippine Commission on Women provides the guidelines and procedures pursuant to provision of
the Implementing Rules and Regulations of RA 9710 that there is a need to establish a Violence
Against Women (VAW) Desk in every barangay and designating officer thereat.

NOW, THEREFORE, I ORLANDO C. MARQUILENCIA, Punong Barangay of


Barangay MAGDALO , City of Imus, Cavite by virtue of the powers vested in me by law, do
hereby order:

SECTION 1. Establishment of Violence Against Women (VAW) Desk and Designating Hon.
Lorna B. Alquiros & Nilce S. Cantilero as a VAW Desk Officer thereat.

SECTION 2. Functions of Barangay VAW Desk:

1. Respond to gender-based violence cases brought to the barangay;

2. Record the number of gender-based violence handled by the Barangay and submit a quarterly
report on all cases of VAW to the DILG Municipal Field Office and the Municipal Social Welfare
Development Office;

6. Coordinate with and refer cases to government agencies, non-government organizations


(NGOs institutions, and other service providers as necessary;

7. Address other forms of abuse committed against women, especially senior citizens, women
with disabilities and other marginalized groups;

8. Lead advocacies on the elimination of VAW in the community; and

9. Perform other related functions as may be assigned.

SECTION 2. Functions. The GAD Focal Point System shall ensure and sustain the
Barangay’s critical consciousness in supporting gender and development, women’s empowerment
and responding to gender issues. The GFPS shall take the lead role in direction setting, advocacy,
planning, monitoring and evaluation, and technical advisory in mainstreaming GAD perspective in
LGU programs, projects, activities and processes.

Specifically, the GFPS shall perform the following functions:

1. Lead in mainstreaming GAD perspectives in LGU policies, plans and programs.


Assessment of gender responsiveness of systems, structures and priority needs and
concerns of constituencies and employees and the formulation of recommendations
including their implementation;

2. Assist in the formulation of GAD Code;

3. Lead in setting up appropriate systems and mechanism to ensure the generation,


processing, review and updating of sex-disaggregated data or GAD database to serve
as basis in performance-based and gender-responsive planning and budgeting;

4. Coordinate efforts of different division/office/units of the LGU and advocate for the
integration og GAD perspective in all their systems and process;

5. Spearhead the preparation of Annual and performance based Barangay GAD their
locality and in the context of the LGU mandate and consolidate the same following
the form and procedures prescribed in the Joint Memorandum Circular;

6. Lead the monitoring of the effective implementation of the Annual GPB, GAD Code
and other related policies and plans;

7. Strengthen linkages with other barangay’s and the LGU, concerned agencies and
organizations working on women’s rights and gender development to harmonize,
synchronize GAD efforts at various level of governance;

8. Promote and actively pursue the participation of women and gender advocates, other
civil society groups and private organizations in various stages of development
planning cycle, giving attention to marginalized sector;

9. Ensure that all personnel of the barangay including the planning and finance officers
(BDC, SBM Chairman of Appropriations Committee. Barangay Treasurer) are
capacitated with GAD.

SECTION 3. Establishment and Maintenance of Database. The Barangay shall


spearhead the setting up or maintenance of GAD database to serve as basis for gender responsive
planning, programming and policy formulation.

1. The Barangay Secretary shall maintain a GAD database both manually operated and
shall form part of the Management Information System (MIS) or Barangay Database.

2. Sex-disaggregated reports from local agencies or offices such as; the Department of
Agriculture (DA), Department of Labor and Employment (DOLE), and Department of
Trade and Industry (DTI). The sex-disaggregated data and results for the Community
Based Monitoring System (CBMS), the National Governance Performance Management
System (LGPMS) may form part of the GAD database.

3. The Barangay GFPS shall gather and process sex-disaggregated data and GAD related
information for submission to city.

SECTION 4. Gender and Development (GAD) Planning and Budgeting

1. A Gender and Development Plan of Barangay Magdalo City of Imus, Cavite shall be
formulated annually within the context of barangay governance and ensure gender
mainstreaming in the policies, programs and projects. it shall be integrated in Barangay
Development Plan, the cost of implementation of which shall be at least (5%) of
Barangay Budget Amounting to ₱5,000.00

2. Priority GAD PPA’s shall be considered addressing the emerging issues and concerns
on:
a. Provision on basic services and facilities to protect and fulfill women’s right,
including their right to protection from all forms of violence;

na ginawa ng isang benepisyaryo sa mga patakaran ng Pantawid Pamilya Program alinsunod sa NAC
Resolution No. 9-S-2012;
 Pagsasampa ng naaangkop na kaso sa City Advisory Committee (CAC) laban sa mga alituntunin at
patakaran ng Pantawid Pamilya Program na hindi nasolusyunan ng BAT;
 Ipaalala at tiyakin ng gagamitin sa wastong pangangailangan ng benepisyaryo ang biyayang
natatanggap mula sa programa at;
 Lumikha ng mga alituntunin at kapasyahang di-tataliwas sa mga resolusyon ng National Advisory
Committee (NAC) ng Pantawid Pamilyang Pilipino Program.

Seksyon 3. Mga kaparusahan para sa mga Benepisyaryo na lalabag sa mga alituntunin ng


Pantawid Pamilya Program. – Ang mga sumusunod na kaparusahan ay ipapataw sa sinumang
benepisyaryo na lalabag sa mga alituntunin at patakaran ng Pantawid Pamilya Program na
may kaugnayan sa edukasyon at pang-kalusugan/nutrisyon:

 Matapos ang unang paglabag, hindi matatanggap ng benepisyaryo ang grant sa buwan kung kalian
niya ginawa ang unang paglabag;
 Matapos ang ikalawang paglabag, bibigyan ang benepisyaryo ng written warning ng Provincial
Operations Office batay sa rekomendasyon ng City Link na alinsunod sa mga ebidensya ng
Compliance Verification Form 2 (Education), CV Form 3 (Health and Nutrition);
 Matapos ang ikatlong paglabag, tatlong buwan isususpinde ang benepisyaryo sa pagtanggap ng
buwanang grant;
 Ang isang benepisyaryo ng lalabag sa mga patakaran ng Pantawid Pamilya Program sa ikaapat ng
pagkakataon ay permenenteng tatanggalin sa listahan ng mga benepisyaryo ng programa.

mapapatawan ng kaparusahan ay maaring umapela sa Regional Project Management Office
(RPMO) na matatagpuan sa Alabang, Muntinlupa City na maipapaabot sa pamamagitan ng kanilang
City Links sa loob ng labin-limang araw (15 days) matapos magsimula ang suspension na
pagbibigay ng grant.

Ang nabanggit na apela ay dapt iresolbang Grievance Officer sa loob ng tatlong 3 buwan
mula sa petsa kung kailan ito isinampa alinsunod sa NAC Resolution No. 1-S-2011.

Kung ang apela ay sang-ayunan ng RPMO, ang mga magulang ng mga batanga
benepisyaryo ng Pantawid Pamilya Program ay uutusang dumalo sa isang re-orientation seminar s
kanilang tungkulin bilang benepisyaryo, lumagda sa isang panibagong Oath of Commitment, at
lumahok sa mga counseling sessions na ibibigay ng City Social Welfare and Development Office
(CSWDO) ng Lungsod ng Imus bago bawiin ang mga suspension at ibalik ang sambahayang
benepisyaryo sa programa.

Kung ang apela ay hindi sang-ayunan ng RPMO, ang benepisyaryo ay matatanggal sa programa.

Ang benepisyaryong lumabag sa mga patakaran ng Pantawid Pamilya Program sa apat na


pagkakataon ay permanenteng matatanggal s programa at walang karapatang umapela sa RPMO.

Seksyon 5. Mga Kaparusahan sa mga Benepisyaryo na Lalabag sa mga Alituntunin ng


Pantawid Pamilya Program na may kaugnayan sa pagsusugal at maling paggamit ng grant,
pagsanla ng cash card, paglabag sa mga batas na may kaugnayan sa child labor, drug abuse,
child abuse at labis na pag-iinom ng alak. – Ang mga sumusunod na kaparusahan ay ipapataw sa
sinumang benepisyaryo na lalabag sa mga alituntunin at patakaran ng Pantawid Pamilya Program
na may kaugnayan sa pagsusugal at maling paggamit ng grant, pagsasanla ng cash card, paglabag sa
mga batas na may kaugnayan sa child labor, drug abuse, at labis na pag-iinom ng alak:

 Matapos ang unang paglabag, bibigyan ng verbal warning ng Punong Barangay at ng City Link ang
benepisyaryo hinggil sa nabanggit na paglabag na may paliwanag sa maaaring kahantungan ng
muling paglabag;
 Matapos ang ikalawang paglabag,ipapaliwanag ng Punong Barangay at City Link na
pansamantalang ililipat sa tatlong (3) buwanang cash grant sa isang responsible at nakakatandang
miyembro ng pamilya ng benepisyaryo, o kung hindi man ay sa nakakatandang kamg-anak ng
benepisyaryo. Kung walang kamag-anak na kwalipikado,pansamantalang pamamahalaan ng
CSWDO ang pagbibigay ng cash grant sa mga mag-aaral na benepisyaryo;
 Matapos ang ikatlong paglabag, tatanggalin na ang benepisyaryo mula sa programa at wala ng
karapatang umapela.

Seksyon 6. Pagpapalit ng mga patakaran ng Pantawid Pamilya Pilipino sa mga regulasynng


binanggit at ang bagong patakaran ang ipinatutupad sa Barangay at irerebisa ang resolusyong ito
upang makasunod sa pagbabagong ipinatutupad ng programa sa mga regulasyon ito.

Sekyson 7. Sekretaryat. – Isa sa mga Parent Leaders na kasapi sa BAT ang itatalaga ng BAT
bilang pangkalahatang responsable sa pagkuha ng Katitikan ng Pulong at Pag-iingat ng tala at
dokumento ng BAT.

Seksyon 8. Tagapamahala. – Ang Punong Barangay, o ang kanyang kinatawan, ang magiging
tagapamahala sa lath ng aktibidad at proyekto ng lahat ng cluster ng programa sa Barangay.

Seksyon 9. Pagpupulong. – Ang BAT ay magpupulong minsan sa loob ng isang (1) buwan, o mas
malimit pa kapag hinihingi ng pagkakataon. Sa mga nabanggit na pagpupulong, magbibigay ng mga
mungkahi ang mga miyembro ng BAT at ng kanilang City Link upang maiwasan ang paglabag ng
mga benepisyaryo sa programa at maiatas ang antas ng kanilang pagtupad sa mga nabanggit na
alituntunin ng Pantawid Pamilya Program.

Seksyon 10. Pondo. – Maaaring kunin ng BT ang pondong kailangan para sa pagpapatupad ng mga
proyekto at aktibidades nito mula sa pondo ng barangay o sa pamamagitan ng pondo mula sa
Gender and Development.

Seksyon 11. Pagkakabisa. – Ang kautusang ito ay kagyat na magkakabisa at iiral habang
ipinatutupad ang Pantawid Pamilyang Pilipino Program sa Lungsod ng Imus, Lalawigan ng Kabite.

SAPAGKAT, bilang pangunahing yunit pulitikal, ang barangay ay magsisilbing


nangungunang yunit ng pamahalaan na nagpaplano at nagpapatupad ng mga patakaran, plano,
programa, proyekto at mga Gawain sa pamayanan, at bilang isang porum kung saan ang sama-
samang mga pananaw ng mga tao ay maaaring ipahayag, linawin at isaalang-alang, at kung saan
ang mga hidwaan ay maaaring mapayapang lutasin;

SAPAGKAT, ang Kagawaran ng Interyor at local na Pamahalaan rehiyon 4A


(CALABARZON) ay nagpalabas ng Pang-rehiyong Memorandum Sirkular bilang 2006-03 noong
15 Pebrero 2006 na kung saan ang mga dumaraming bilang ng mga institusyon na nakabase sa
barangay na nagkakasanib-sanib sa bawat isa sa kanilang mga proyekto at programa ay binigyang
diin;

SAPAGKAT, ang lahat ng barangay ay pinagtagubilinan na pagtibayin ang Pinalawak na


Lupon ng Barangay sa Kapayapaan at Kaayusan (Expanded BPOC) at pinalawak ng Konseho ng
Barangay sa Pag-unlad (Expanded BDC) upang mapadali ang pag-iisa ng mga iba’t ibang
institusyong nakabase sa barangay upang pagaanin at patatagin ang balangkas at kaparanan para sa
mas lalong epektibo at mahusay na pagsisikap para sa kapayapaan at pag-unlad;

SAPAGKAT, ang pagkakabuo ng mga pangkat ay halos magkakapareho, bunga nito ang
pagdudulot ng pagsasanib ng tungkulin, di tamang pagkagamit ng tao, material at pananalaping
pinagkukunan, pagkalito, ganon din ang di-tama at sobrang paghihirap ng mga miyembro, lalung
lalo na ang Punong Barangay na kailangan niyang mamuno sa napakaraming pagpupulong at
kaugnay na Gawain na nakakaubos ng maraming oras;

SAPAGKAT, ang pagkakalikha ng napakaraming pangkapayapaan at pangkakayusan at


pangn-ugnayang pangkat sa barangay ay naghahasik ng kalituhaan at kawalang sistema na
magdudulot ng walang kabuluhan sa pagsasakatuparan;

NGAYON DAHIL DITO, Ako, Orlando C. Marquilencia, Punong Barangay ng


MAGDALO, Lungsod ng Imus, Lalawigan ng Kabite, sa pamamagitan ng kapangyarihang
ipinagkaloob sa akin ng Kodigo ng Lokal na Pamahalaan ng 1991, at iba pang umiiral na batas, sa
pamamagitan nito ay ipinag-uutos ang muling pagbubuo ng Pinalawak ng lupon ng Barangay sa
Kapayapaan at Kaayusan at Pinalawak na Konseho ng Barangay sa Pag-unlad, bilang patotoo:

SEKSIYON 1. PAGBUBUO NG EXPANDED BPOC AT BDC. Sa pamamagitan nito ay


itinatakda ang muling pagbubuo ng Pinalawak na Lupon ng barangay sa Kapayapaan at Kaayusan
at Pinalawak ng Konseho ng Barangay sa pag-unlad, kaalinsabay nito ang paghirang sa mga

Ang sekretaryat ng Lupon ng Barangay sa Kapayapaan at kaayusan (BPOC) ay


bubuuin ng mga sumusunod na mga miyembro; 1. Kalihim ng barangay, 2. Ingat-Yaman ng
barangay, at 3. Kinatawan ng Non-Governmental Organization (NGO).

Ang sekretaryat ng Konseho ng Barangay sa Pag-unlad (BDC) ay bubuuin ng mga


sumusunod na mga miyembro: 1. Kalihim ng barangay, 2. Ingat-Yaman ng barangay, 3.
Kinatawan ng Non-Governmental Organization (NGO).

SEKSIYON 4. PAGDARAOS NG PAGPUPULONG. Ang nahirang na opisyal ng


Barangay ay mamumuno sa pagpupulong sa sub-komite upang pag-usapang mabuti ang
kani-kanilang pananagutan at mga proyekto, programa, at aktibidad upang iharap sa Lupon
Tagapangasiwa.

Ang dalawang (2) lupon ng Tagapangasiwa ay magkakaroon ng buwanang


pagpupulong upang tayahin/pag-aralan ang estado /kalagayan ng pagpapatupad, mga
suliranin at mga pananagutan ng iba’t ibang programa, mga proyekto at mga gawain ng sub-
komite upang iharap sa Lupon ng Barangay sa Kapayapaan at kaayusan at sa Konseho ng
Barangay sa pag-unlad.

Ang Pinalawak na Lupon ng Barangay sa Kapayapaan at Kaayusan (Expanded


BPOC) at Pinalawak na Konseho ng Barangay sa Pag-Unlad (Expanded BDC) ay
magkakaroon ng pagpupulong tuwing ikatlong buwan. Ang mga sub-komite ng Expanded
BPOC ay magtitipun-tipon upang alaminang estado/kalagayan ng pagpapatupad ng kanilang
iba’t ibang mga programa, proyekto at mga gawain, at makikipag-ugnayan sa BDC upang
tiyakin na ang mga PPAs ng BPOC ay isasama sa Plano ng Barangay sa Pag-unlad para sa
alokasyon ng pondo at badyet. Ang mga sub-komite naman ng Expanded BDC at
magtitipun-tipon at ang Lupong Tagapangasiwa ng BPOC upang alamin ang
estado/kalagayan ng pagpapatupad ng kanilang iba’t ibang programa, mga proyekto at mga
gawain.

SEKSIYON 5. PAG-UULAT. Ang bawat sub-komite ay magsusumite ng ulat sa


mga Lupong Tagapangasiwa (BPOC at BDC) ukol sa mga usapin ng nakapaloob sa mga
naganap na pagpupulong.

Gayundin, sa palagiang pagpupulong (regular session) ng konseho ng Barangay ay


pamumunuan ng sub-komite ang pag-uulat sa konseho tungkol sa mga suliranin at mga
pananagutan para sa impormasyon/kabatiran at kaukulang aksyon.
