the ITAR .

The ITA R contained a list of defense articles and defense services w hich w ere

subjectto controlby these regulations. The listwascalled the United StatesM unitions List
(t<USM L''),Title22,CodeofFederalRegulations,Part121.1.
N o defense articles or defense services m ay be exported or othenvise transferred

from the U nited States to a foreign country w ithouta license orw ritten approvalfrom the United

StatesDepartmentofState,DirectorateofDefenseTradeControls(%CDDTC''),accordingto Title
22,Code of Federal Regulations,Part 123.1. The ITAR also prohibited attem pted exports,re-

exports,transfers,trans-shipm ents,and diversions from foreign countries ofpreviously exported

defense articles or services withoutState D epartm ent authorization pursuantto Title 22, Code of

Purpose ofthe C onspiracv

lt was the purpose of the conspiracy for the defendants to unjustly enrich
them selvesby unlaw fully exporting defense articlesfrom the U nited Statesto Russia and to evade

the applicable prohibitions and licensing requirem ents ofthe AECA and ITA R and detection by

the United StatesG overnm ent.

M anner and M eans

4. ln furtherance of the conspiracy and to effectthe purpose thereof,the follow ing

m anner and m eans,am ong Others,Were used:

A. The co-conspirators would use electronic mail(email) to communicate
betw een Russia and the United States.

M A K AR ENK O w ould place an order fordefense articlesincluding night-

vision rifle scopes,m onoculars,and am m unition prim ers from N EV ID O M Y .

N EVID O M Y w ould procure the defense articles from U nited States

vendors and receive the defense articles in Brow ard County,Florida.

D. NE VID O M Y would ship the defense articles from the U nited States to

M AK ARE NK O in Russia w ithoutobtaining the required licenses from the State D epartm ent's

D DTC.

requesting the purchase of tw o A TN M A RS 4x4 night-vision rifle scopes and explaining that a

United Statesvendorhad refused to sellthe scopesto M A K A R EN K O because they are ffrestricted

from shipping to''M A K AR EN K O 'Slocation in Russia.

On or about April 16, 2013, N EVID O M Y sent an em ail to M A K A REN K O

quotingthepriceandshippingcostsas$11,755 fortheexportoftwo ATN M ARS 4x4night-vision

rifle scopes.

On oraboutApril16,2013,M A K AR EN K O caused a w ire transferto be sentfrom

a bank account in Shanghai,China,to the bank account of N EVID O M Y 'S com pany, Prim ex

Group,lnc.,in the United Statesin the am ountof$11,755 forthepurchase and shipping ofthe
tw o A TN M A RS 4x4 night-vision rifle scopes.

4. On oraboutA pril16,2013,N EV ID O M Y paid a U nited States vendor located in

Huntsville,Texas,$9,599 forthepurchaseoftwo ATN M ARS 4x4 night-vision l'itle scopes.

ln oraround June 2013,N EV ID O M Y exported tw o A TN M A RS 4x4 night-vision

l'ifle scopes from the United Statesto M AK A REN K O in Russia.

account of the California vendor for the purchase of one O D IN 61BW therm al m ulti-purpose

M A IQARE NK O explaining thatthe O D IN 61BW thennal m ulti-purpose m onocular w ould be

delivered w ithin the w eek but because a private Russian courier office w as being audited the

courier office recom m ended ttnot to ship the night vision scopes at this tim e,in order to avoid

$18,036 to be sentfrom a bank accountin Riga,Latvia,to the bank accountofNEVIDOM Y 'S

com pany, Prim ex Group,lnc.,in the Southern D istrict of Florida,part of w hich w as for the

purchase ofthe M A R S 4x4 night-vision lifle scope.

18. On or aboutJune 12,2013,NE VID O M Y sentan em ailm essage to the Arkansas

vendor,attaching an E&ITAR Com pliance Acknow ledgem ent''fonn on behalfofM A K AR EN K O

acknow ledging hisresponsibility to com ply w ith United Statesexportcontrollawsand regulations,

including licensing requirem ents.

scope to Russia.

Transaction 4 - Sellier & BellotFirearm A m m unition Prim ers

On or about July M AIG RENK O sent an em ail m essage to

N EVIDO M Y requesting the purchase of 1,000 large-rifle am m unition prim ers to be placed in a

containerin M iami,Florida,forshipm entto Vladivostok,Russia.

22. On or about August 30, 2013,M A K AR EN K O forwarded an em ailm essage to

NEV ID O M Y describing the am m unition prim ers previously requested.

On oraboutSeptem ber 1,2013,NE VID O M Y ordered 1,000 am m unition prim ers

from the A rkansasvendor.

24. On or about Septem ber 5, 2013, in response to an em ail from the vendor in

A rkansas indicating that the Sellier & Bellot firearm am m unition prim ers had been shipped,

N EVID O M Y replied,asking how m uch they costand stating thathe w ould w ire the paym ent.

25. On or about October 2,2013, NEVIDOM Y attempted to ship a parcel from

H allandale Beach,Florida,to M A K A REN K O in V ladivostok,Russia,containing 1,000 Sellier&

Bellotfirearm am m unition prim ers.

26. On or about N ovem ber 20,2013,after M A K AREN K O received a letter from

United States Custom s and Border Protection indicating that the prim ers had been seized for
