AMENDED CRIMINAL COMPLAINT WILBUR ERNESTO MARTINEZ-GUZMAN, Defendant. MELANIE A. BRANTINGHAM, Deputy District Attorney for Carson City, Nevada, complains and declares, upon information, belief and/or personal knowledge, that WILBUR, ERNESTO MARTINEZ-GUZMAN, the Defendant, above-named, at Carson Township, in Carson City, State of Nevada, has committed the crimes of BURGLARY, a category B Felony as defined by NRS 205.060 (Counts |-III); POSSESSION OF A STOLEN FIREARM, a category B felony as defined by NRS 205.275(1) and (2)(c) (Counts |V-XV); POSSESSION OF STOLEN PROPERTY VALUE $650 TO $3500, a category C Felony as defined by NRS. 205.275(1) and (2)(b) (Count XVI-XIX); PROHIBITED PERSON IN POSSESSION OF FIREARM, a category D felony as defined by NRS 202.360(2)(e) (Counts XX-XXXI); POSSESSION OF STOLEN PROPERTY VALUE LESS THAN $650, a Misdemeanor as defined by NRS 205.275(1) and (2)(a) (Count XXXII-XXXiIII); and FALSE PRETENSES TO OBTAIN MONEY LESS THAN $650, a Misdemeanor as defined by NRS 205.980(1)(b) (Count XXXIV-XXXVI) in the manner following: MM te reaent tra rac a eh on8 oak oR i re Ry PRRNB ee BNBRBRBRVSSS Count | BURGLARY Felony — NRS 205.060) That the Defendant, Wilbur Ernesto Martinez-Guzman, on or about January 12, 2019, at Carson Township, in Carson City, State of Nevada, did wilifully and unlawfully enter any shop, warehouse, store or other building, to wit: Northern Nevada Coin, located at 601 North Carson Street, Carson City, Nevada, with the intent to obtain money or property by false pretenses therein, by pawning or selling stolen jewelry. Count II BURGLARY (“B” Felony — NRS 205.060) That the Defendant, Wilbur Ernesto Martinez-Guzman, on or about January 14, 2019, at Carson Township, in Carson City, State of Nevada, did willfully and unlawtully enter any shop, warehouse, store or other building, to wit: Northern Nevada Coin, located at 601 North Carson Street, Carson City, Nevada, with the intent to obtain money or property by false pretenses therein, by pawning or selling stolen jewelry. Count Ht BURGLARY (“B” Felony — NRS 205.060) That the Defendant, Wilbur Ernesto Martinez-Guzman, on or about January 17, 2019, at Carson Township, in Carson City, State of Nevada, did willfully and uniawtully enter any shop, warehouse, store or other building, to wit: Northern Nevada Coin, located at 601 North Carson Street, Carson City, Nevada, with the intent to obtain money or property by false pretenses therein, by pawning or selling stolen jewelry. wil MM Mit Mit Count Iv POSSESSION OF A STOLEN FIREARM (“B” Felony — NRS 205.275(1) and (2)(c)) That the Defendant, Wilbur Emesto Martinez-Guzman, on or about January 19, 2019, at Carson Township, in Carson City, State of Nevada, did willfully and unlawfully possess a firearm, for his own gain, or to prevent the owners from again possessing his property, to wit: a Savage Sporter Model 23AA, .22 LR rifle with a Weaver scope, belonging to Gerald and/or Sharon David, knowing that it was stolen or under such circumstances as should have caused a reasonable person to know that it was stolen property, all of which occurred at or near Sedge Rd., Carson City, Nevada. Count _V POSSESSION OF A STOLEN FIREARM (“B” Felony — NRS 205.275(1) and (2)(c)) That the Defendant, Wilbur Emesto Martinez-Guzman, on or about January 19, 2019, at Carson Township, in Carson City, State of Nevada, did willfully and unlawfully possess a firearm, for his own gain, or to prevent the owner from again possessing his property, to wit: a Cherry's Inc. GSO NC 7.62x39 rifle, with a bayonet, belonging to Gerald and/or Sharon David, knowing that it was stolen or under such circumstances as should have caused a reasonable person to know that it was stolen property, all of which occurred at or near Sedge Rd., Carson City, Nevada. Count VI POSSESSION OF A STOLEN FIREARM (“B” Felony — NRS 205.275(1) and (2)(c)) ‘That the Defendant, Wilbur Emesto Martinez-Guzman, on or about January 19, 2019, at Carson Township, in Carson City, State of Nevada, did wilffully and unlawfully possess a firearm, for his own gain, or to prevent the owner from again possessing his property, to wit: an Ithaca Gun Co. M-49 .22 LR lever action rifle with wood stock, belonging to Gerald and/or Sharon David, knowing that it was stolen or under such circumstances as should have 3
