Box 50 Pala,Califomia 92059-0050 (760) 742-3784 (760) 742-1411 Fax RESOLUTION NO. 01-10 the Pala Band of Mission Indians is a federally recognized Indian Tribe (the "Tribe"); and the Tribe is governed by the Tribal Constitution which establishes a General Council and an Executive Committee, and which were approved by the Commissioner of Indian Affairs; and pursuant to the Tribal Constitution, the General Council is the governing body of the Tribe; and the Tribal Constitution provides the General Council with the power to delegate, by resolution, specific powers and duties to the Tribe's Executive Committee; and the Tribe conducts Class II Gaming within the meaning of the Indian Gaming Regulatory Act at the Pala Casino, which generates revenue that the Tribe wishes to use for the benefit of the Tribe and its members; and the Tribe has developed a plan for the allocation of said revenue, which is consistent with the goals of the Tribe and will benefit the Tribe and its members; and the General Council reviewed and approved a Plan for the Allocation of Gaming Revenues, which must be approved by the United States Secretary of the Interior, Bureau of Indian Affairs (BIA), and delegated to the Executive Committee the authority to amend the Plan, if necessary, to respond to any comments that the BLA may have as part of the approval process; and the Executive Committee has reviewed the comments of the Deputy Commissioner of Indian Affairs regarding the Plan, has amended the Plan in order to respond to the ‘comments, and desires to submit the amended Plan for review and approval. NOW THEREFORE BE IT RESOLVED that the Pala Executive Committee adopts the Amended Plan for the Allocation of Gaming Revenues attached hereto, and authorizes its Chairperson, Robert ‘Smith, to submit said Amended Plan to the Bureau of Indian Affairs for review and approval. Box 50 Pala,Califoria 92059-0050 (760) 742-3784 (760) 742-1411 Fax RESOLUTION NO.01-14 Delegation of Authority to Executive Committee Amending Plan for Allocation of Gaming Revenue WHEREAS, the Pala Band of Mission Indians is a federally recognized Indian Tribe (the "Tribe") by the United States Government; and WHEREAS, the Tribe wishes to be in compliance with the provisions of the Indian Gaming Regulatory Act at 25 U.S.C. Section 2710(b)(3); and WHEREAS, the Tribe is governed by the Tribal Constitution approved by the Commissioner of Indian Affairs which establish a General Council and an Executive Committee; and WHEREAS, pursuant to Article three (3) of the Tribe's Constitution, the General Council is the ‘governing body of the Tribe; and WHEREAS, Article three (3) of the Constitution, among other powers, provides the General Council with the power to enact ordinances and to delegate to the Executive Committee any of its powers under Article three (3); and WHEREAS, the Pala Tribe’s General Council adopted on March 14, 2001, a plan for allocating revenue from the Tribal Government Gaming Casino which must be submitted to and approved by the Secretary, United States Department of Interior, Bureau of Indian Affairs (BIA) and authorized the Tribal Chairman to sign, enter into, and execute all agreements and documents necessary to facilitate the aforementioned; and WHEREAS, the General Council wishes to delegate to the Executive Committee the authority to revise and amend the plan if necessary to respond to comments that the BIA may have as part of the federal approval process. NOW THEREFORE BE IT RESOLVED that the Pala General Council delegates to the Pala Executive Committee the authority to amend the Plan for the Allocation of Gaming Revenues adopted on March 14, 2001, ifnecessary to respond to comments that the Bureau of Indian Affairs (BIA) may have as part of the federal approval process, and authorizes its Chairperson to submit any amended plan to the BIA for approval.
