being stranded in the waters of Kapota Village, South Wangiwangi District (Wangsel), Wakatobi

cut trees in a rainforest area can be very destructive. For example, some areas in the forests
around refugee camps in Central Africa (Rwanda and Congo) have really lost all of their trees.
Therefore, there is a need for guidance and counseling to the local population about the
importance of the existence of forests for the lives of all people.

to take refuge.
When, floods or landslides come, those who will bear the risk are humans themselves. It is not

Jakarta (Greeners) - Major pollution in the Jakarta Bay region is mostly sourced from domestic
domestic waste. In fact, from the distribution of the locations that were taken as research
sampling locations by the Ministry of Environment and Forestry (KLHK), only a few regions
with Biological Oxygen Demand (BOD) levels were below the quality standard.

The Director of Coastal and Marine Pollution and Damage Control, the Ministry of

waste distribution coming from upstream 13 rivers in Jakarta. Therefore, the highest level of

Heru explained that the source of pollution was divided into two. First, Point Sources whose
industrial sources are fixed and second, Non Point Sources (household domestic waste) whose
sources can come from anywhere. For these non-point sources , Heru admitted that it was very
difficult to detect it because non-point sources were scattered in many settlements and other
households.

"So point sources are waste from fixed or one point sources such as industry. If the non point
sources are scattered such as settlements, livestock, and others, this is difficult for us to
determine. Well this also accumulates from the upstream of the river which continues to be
carried downstream to eventually pollute the sea. That causes high sea pollution in Jakarta,

Pollution sourced from the point sources itself is divided in two, pollution from organic waste is
52,862.75 tons and inorganic waste is 24,446.06 tons. Whereas non point sources waste, for
organic is 10,875,651.69 tons and inorganic is 9,766,670.00 tons. This waste pile was calculated
in North Jakarta in November 2015.

"If you want to be compared with the same research at the same time but different locations,
compared to Semarang bay and Benoa bay, Jakarta bay is far more severe," he added.

To overcome this problem, the Executive Director of the Jakarta Forum for the Environment
(Walhi), Puput TD Putra suggested to the DKI Provincial Government to build a communal
Waste Water Treatment Plant (IPAL) at several settlement points in Jakarta.

The construction of the communal WWTP is intended to solve the problem of household waste
disposal, from human waste, laundry water, and used bath water. With the presence of communal
WWTPs, at least it can reduce the pollution burden sourced from domestic waste.

"We have emphasized to the Provincial Government and it turns out that they have already
carried out a mapping to build this communal WWTP. It's just that, this is a long-term job and
requires a long time, "explained Puput.
Regarding pollution at the Jakarta Bay itself, Head of the DKI Jakarta Regional Environmental
Management Agency (BPLHD), Junaedi, admitted that the Jakarta bay area had been heavily
polluted. Moreover, solid and liquid waste sourced from 13 rivers in Jakarta empties into the bay
of Jakarta.

"Yesterday we only did research related to dead fish. But if we say that Jakarta Bay is not
polluted, yes, it is not possible, right? Because solid and liquid waste when the rainy season must
be carried into the sea, "he said.

regional governments has drawn various rejections. This policy is considered burdensome to the
community and violates the rules of higher law, namely the Civil Code.

regional government were considered wrong because they prohibited plastic bags, PS-foam or
plastic straws, by reason of reducing plastic waste. Management of waste (plastic) management
should be improved. Especially at this time no one has been able to find a substitute for plastic
bags, as a means of carrying groceries.

"The ban on plastic bags is an instant policy that is not solution. The use of environmentally
friendly bags has not been explained to this day. "What is the replacement of cloth or of what,"

According to him, the main obstacle is changing the behavior of the habit of using plastic bags in
the community. Primarily, for market traders, the government's responsibility is to provide
massive, consistent, and on-target understanding.

middle class traders in the market if given heavy sanctions, fines of up to IDR 25 million would
be a question or not. Users of plastic bags are not a crime behavior that must be rewarded with a

position than the local regulations. In the legal rules of buying and selling practices in Article

On the other hand, according to him, the solution for traders must be concrete. For example,
market traders who depend on the use of plastic bags every day must be clearly a substitute for

Indonesian Retail Entrepreneurs Association (Aprindo) also stated its refusal to ban the use of
plastic bags to shop in several regions. Entrepreneurs reasoned that there was no rule from the
central government that demanded that each region prohibit.

"We do not agree with the prohibition on the use of plastic bags," said Aprindo Chairman Roy
Mandey.

He said there must be central government control in reducing plastic waste. The Ministry of
Environment and Forestry (KLHK) should issue a Ministerial Regulation (Permen) to harmonize
the attitude of the government. While what is happening at this time, the rules for prohibiting the
use of plastic bags in the regions are only based on the regulations of the Governor, Mayor, or
Regent. As a result, consumers become confused about the regulations. A number of regions that
have implemented this policy include Banjarmasin and Balikpapan, as well as in the future
Bogor, Bandung and following the DKI Jakarta, which is planned to take effect in January 2019.

Two Problems with Enforcement of Environmental Law in Indonesia

Deputy Chairperson of the Judicial Commission (KY) Sukma Violetta was a guest speaker at the Quo Vadis Public Dialogue on
Enforcement of Environmental Law in Indonesia organized by the Indonesian Forum for the Environment (WALHI), Monday
(04/06) at Hotel Aone, Jakarta.

Jakarta (Judicial Commission) - Deputy Chairperson of the Judicial Commission (KY) Sukma
Violetta was a guest speaker in the Public Dialogue of Quo Vadis Enforcement of Environmental
Law in Indonesia organized by the Indonesian Forum for the Environment (WALHI), Monday
(04/06) at Hotel Aone, Jakarta.
Sukma explained, even though the Supreme Court (MA) had been quite intense in providing
training to judges related to the environment, but there were two problems in enforcing
environmental law in Indonesia.
First, the guidance of the Supreme Court to maintain the professionalism of judges who are still
lacking. Judges always hide at the independence of judges. Even though independence must be
given a grid, so there are clear limits.
"We misinterpret independence. Even though according to the international principle, the judge's
decision must be logical and appropriate or clearly basic. So, judges should not be arbitrary in
making decisions, "Sukma explained.
Second, continued Sukma, the integrity of the judge. Judges should not only be prosecuted in a
quality that is merely certification. KY receives many public reports each year, and provides
recommendations to the Supreme Court. In fact, there are more than 50 percent of
recommendations that have not been approved by the Supreme Court on the pretext of legal error.
Even though Sukma continued, KY found many misconduct errors, where the proceedings or
decisions were not in accordance with the Act.
"What is happening now is anomalies. In international law,
indeed judicial technical services should not be dealt with. But unprofessional conduct can be acted
upon. What is happening now, the Supreme Court has always rejected KY recommendations for
judicial technical reasons. We are further away to reach the problem of maintaining the
professionalism of judges, "Sukma explained.
Also present were other speakers consisting of KPK Commissioner Laode Syarif, Director General
of Law Enforcement of the Ministry of Environment and Forestry Rasio Ridho Sani, and Prita
Laura as moderator.
On this occasion, Rasio Ridho Sani explained that in the trial of an environmental case, the judge
was more aware because there were many who monitored it, not as they used to.
"Therefore, recently we extended the MoU with KY, and were followed by other institutions. "The
hope is that many will supervise, then justice for environmental law can be upheld," concluded
