My incapacity arose as a result of my active war service in Vietnam. 2 Prior to 23 April 1982 Julia GILLARD and I jointly filled out an Application to Incorporate the Australian Workers’ Union - Workplace Reform Association. Now produced and shown to me and marked "A" is a true copy of the Application form Ms GILLARD and | jointly completed 3, On 23 April 1992 | lodged the Application with the WA Office of State Corporate Affairs. One or two weeks later I received a letter from that Office informing me that the Application had been refused because the entity appeared to be a trade union and was ineligible for incorporation by that Office. 4 Between about 13 May 1992 and 26 May 1992 | was involved in various discussions with Ms Gillard and my boss at the time, AWU WA Branch Secretary Bruce Wilson about how to respond to the refusal to incorporate. Wilson and Gillard were trying to find a way to have the association incorporated by the Office of Corporate Affairs and not under industrial relations legislation like a union. 5. Those discussions with Gillard and Wilson took place in Perth, Kalgoorlie and Melbourne, 6 (On Tuesday 13 May 2014 | appeared before the Royal Commission into Trade Union Governance and Corruption 7. During my appearance Dr Christine Hanscombe QC handed me what appeared to be a letter from “Ray Neal of the Office of State Corporate Affairs” and a memorandum signed "Julia". Now produced and marked with the letters “B* and ‘C’ are that letter and the memorandum as tendered to the Royal Commission and exhibited here: https:/\ leunionroyalcammission,gov.au/Hearinas/ Documents/Evidence13May2014/BlewittMFI7.pdf 8 The evidence | gave to the Trade Union Royal Commission was wholly truthful. 1 had not seen either the memorandum nor the letter at any time prior to my appearance at the Royal Commission ML 10. 11 12, 13, 14, 15, 16, 17. 18, 19, Now produced and marked with the letter ‘D" is a true copy of that part of the transcript of my examination at the Trade Union Royal Commission where | was asked about the letter and memorandum. On 10 September 2014 I watched the proceedings of the Trade Union Royal Commission as it was broadcast live to the internet, | saw Julia Gillard give evidence to the Royal Commission about the same memorandum and letter | was shown (marked “B" and "C" in this affidavit). | saw that Ms Gillard was shown the memorandum and letter at pages 23 and 24 of bites www tradeunionroyalcommission gov.au/Hearings/Documents! Evidence 1 0September2014/GillardMFI1 Tab?Pagess-25 pdf, Now produced and shown to me and marked with the letter “E” is a copy of the transcript of part of Ms Gillard's evidence to the Royal Commission which was about the letter and memorandum. heard Ms Gillard give the following evidence to the Royal Commission, “The advice I gave to Mr Blewit is the advice you see before you on page 24." (ie the in this Affidavit), memorandum marked “ Ms Gillard's evidence was wholly false, Ms Gillard did not give me legal advice to the effect set out in that Memorandum. I never received the Memorandum. | was ever shown it, nor did anyone ever speak to me about it until Tuesday, 13 May 2014 at the Royal Commission, | was present in Melbourne either on the day the memorandum was allegedly written, Le, Thursday 21 and/or the next day Friday 22 May 1992, I was there with Ms Gillard and her then boyfriend Bruce Wilson, Linow Iwas in Melbourne at the time because | have a vivid recollection of going to and setting in Melbourne after my retum fom actve seniee in Vietnam n soos urther recall attending 2 iver ot he EI Carton afer Wilson and I went to Melbourne on Thursday 21 or Friday 22 May 1992 to meet with Gillard to discuss our response to the fact that the Commissioner for Corporate Affairs had refused to incorporate the Australian Workers’ Union Workplace Reform Association. {know that we had discussions at the office of Slater and Gordon on Friday, 22 May 1992 about how to respond to the Commissioner’
