Discussions are held between the Court and counsel regarding the status of this case
and how to proceed. Counsel advise that the parties are not ready to go forward with
the plea as originally drafted.
The Court notes that the options at this time from the Courts prospective is for the
parties to: 1. The parties can either agree that the original plea will go forward; 2.
Negotiations can continue with the State as to some type of amendment; 3. The parties
can stipulate to set aside the plea and then set the matter for trial; 4. A Motion to
Withdraw can be filed and the state can respond to such.
The Record is clarified that the Defendants are being supervised by probation at this
time.
Response by counsel for State who advises of their position. Counsel states that there
was never an agreement to work release and addresses the options going forward.
SETTING the following on Friday, March 29, 2019, at 9:00 a.m., before the Honorable
Steven F. McCarville.
IT IS FURTHER ORDERED if counsel are going to file a Motion, said Motion shall be
filed by Friday, March 15, 2019 to allow the State an opportunity to respond.
