INSPIRATOR TRIPARTITE AGREEMENT

This is an agreement between ActionAid International HAITI, 3 Rue Grandoit, Delamas 75,
HAITI, hereafter referred to as AAI H, KAPEGA hereafter referred to as the Host Organization and
Kouame Hyacinthe Leroy CHARLES LUCIEN

Hereafter referred to as the Inspirator.

The agreement covers the posting of an Inspirator to the Host Organization in the following period:
1st February 2018 to 31st March 2019 based on the Terms of Reference attached (appendix 1).

All parties have the following obligations:

 Collaborate on the planning and implementation of the Inspirator placement in the spirit of
mutual confidence and active participation with the aim of fulfilling the objectives.

 Ensure that funds are utilised according to planned activities and approved budget.

AAI HAITI has the following obligations:


1. GENERAL OBLIGATIONS

- Secure the legal set-up in relation to the Inspirator placement.


(Visa, work permit, payment of tax and other related issues).

- Secure that security and emergency plans are in place and known to the Inspirator.

2. OBLIGATIONS TOWARDS THE HOST ORGANISATION

- Programme:

a. Introduce the People4Change M& E process with emphasis on the Host Organisation’s
responsibilities.
(Organisational assessment and TORs, elaboration of TORs and joint assessment)

b. Professional and practical support during the Inspirator placement (Arrange visits if
needed in order to assess and discuss the progress of the planned activities and other
matters related to the Inspirator placement).

- Financial:

a. Make funding available for Inspirator accommodation (at an agreed rate depending on
the location and market values in the local area) and necessary work related transport,
as indicated in the TORs.

- Introduction:

a. Include the Host Organization in the Inspirator induction.

3. OBLIGATIONS TOWARDS THE INSPIRATOR

- Programme:

a. Professional and practical support during assignment.

- Financial and other contractual obligations:


These obligations are described in details in the Inspirator Terms and Conditions
(appendix 2)

a. Ticket going to and from the country


Relocation Subsidy to subsidize certain expenditures in connection with outward
journey and basic furniture and household items.

b. Monthly Allowances (composed of a Home Country Subsidy and a Living Allowance,


transferred to bank account(s) specified by the Inspirator. The actual figures are
enclosed (appendix 3).

c. Leave – 2½ days paid leave per month during agreement period.


Public holidays are to be observed as per the country of service.

d. Compassionate leave – 10 day’s paid leave will be granted upon request in case of
terminal illness or death within the Inspirator’s immediate family (spouse/cohabiting
partner, parents, children and siblings). Travel expenses are the responsibility of the
Inspirator.

e. The possibility to borrow a laptop, if it is needed, during the assignment as Inspirator.

f. Health and other insurance according to Insurance Policy (appendix 4).

- In country introduction1:

a. Introduction to the country.

b. Introduction to AA programme in Jeremie LRP.

c. Discussions on the role of the Inspirator.

d. Introduction to logistics and administrative procedures in AAI DRC .

e. Introduction to the Host Organisation.

f. Introduction to People4Change’s M&E tools to be used for progress reporting during


the placement.

g. Brief local language training, if recommended in the TOR.

The Host Organisation has the following obligations:


1. OBLIGATIONS TOWARDS ACTIONAID INTERNATIONAL DRC:

approved to become an inspirator.

- Fulfil the responsibility of the Host Organisation in the People4Change Programme
Cycle.

a. Clarify the TORs together with the Inspirator within the first month of the arrival of
the Inspirator.

b. Read and comment the Inspirator Progress Reporting.

c. Carry out a joint assessment with the Inspirator.

- Inform the ActionAid office on any changes in the set-up and placement of the Inspirator.

2. TOWARDS THE INSPIRATOR

- Provide suitable accommodation, as per national policy.

- Introduction to the Host Organisation, the work place, fellow colleagues and the local context.
(Based on guidelines prepared by People4Change focal person at the ActionAid office).
Ensure that the necessary working tools (identified in TOR) are available.

- Identify a contact person in the Host Organisation.


This person is responsible for the cooperation between the Inspirator and the Host
Organisation.

- Take the needed precautions and measures concerning the safety and health of the Inspirator
and inform AAI DRC of any urgent issues concerning safety.

The Inspirator has the following obligations:


1. GENERAL OBLIGATIONS

- Treat as confidential any information that comes to the Inspirator’s knowledge in the
pursuance of his/her official capacity, unless such disclosure is the normal course of duties, as
described in the TOR. This obligation of professional secrecy will not cease upon termination
of service. Upon termination of service, the Inspirator has no ownership to any information,
material or the like produced, received or gained from his/her professional functions.

- Agree to be contacted by the ActionAid office in Inspirator’s country of residence after


placement, for knowledge sharing and transfer purposes.

2. OBLIGATIONS TOWARDS ACTIONAID INTERNATIONAL DRC

- Comply with the Acts and Regulations in force in the country and the rules and instructions
provided by AAI DRC.

- Fulfil the responsibility of the Inspirator in the People4Change M& E process.

a. Clarify the TOR together with the Host Organisation within the first month of the
placement.

b. Write a progress report and carry out a joint assessment two times during the
placement with the Host Organisation and ActionAid.

c. Participate in the final debriefing.

- Provide the following documents:

a. Copy of passport

b. Documents necessary to secure legal status in the country of service:


(Each country to identify necessary documents such as birth certificate, CV, diplomas,
references, criminal record)

c. Satisfactory Medical History, if required.

3. OBLIGATIONS TOWARDS THE HOST ORGANISATION

- Make his/her services available in accordance with the TORs (appendix 1).

- Adhere to the rules and regulations in the Host Organisation, including working hours and
days, line of communication etc.

- Respect, honour and integrate him/herself into the organisation and the community at large.

- Consult before he/she is travelling during free time due to security reasons. This means
provide the Host Organisation with information on where he/she is going, how he/she plans
to travel and for how long he/she will be away.

- Stay in the accommodation provided by the Host Organisation.

- Inform if he/she becomes ill during his/her stay or if other problems related to health arise.

TERMINATION:
The agreement is time limited and shall terminate on the date agreed between the parties without
any further notice or warning by any of the parties. The agreement can as an exemption be
terminated on the following conditions:
 AAI DRC or the Host Organisation can terminate the agreement with one month’s notice as of the
first of a month if it can be justified in:
 Poor performance: If it is documented that the Inspirator fails to fulfil the tasks indicated
in his/her terms of reference or if the Inspirator lacks support from the partner
organization.
 If the placement for the Inspirator is no longer available or due to unforeseen
circumstances at the work place.
 The political situation in the country or other circumstances affecting the security or the
working situation for the Inspirator.
 Failure to obtain proper legal work permit in country of service
 Changes in the Inspirator’s health or family situation.
 In order to utilize the poor performance justification, it is the responsibility of the partner
organization and/or the national ActionAid to ensure that attempts have been made to change the
situation leading to termination, before the final decision is made. Formally, it shall be ensured
that:
 A warning meeting is held with possible participation of a colleague/employee
representative.

Reasons for the warning is exposed and understood by the Inspirator, a description of
expected changes is given and indicator for that as well as deadline for changes is given.
 A Hearing of the Inspirator is carried through.
 Minutes of the meeting shall be available and distributed to the Inspirator and to the
national ActionAid.
 Statement of changes or no-changes at deadline date. If the Inspirator does not meet the
expectations described in the plan by the deadline, ActionAid will dismiss the Inspirator
in accordance with 1 months advance notice beginning on the first day of the month. The
notice period will not be applicable in case of gross misconduct (see below section)
 In the event of termination, the Inspirator is entitled to payment until the ending date.
 The Inspirator can terminate the agreement if this is necessary due to serious health or personal
problems. The Inspirator is entitled to terminate the contract by giving 1 month notice as of the
first day of the month. However, it is preferable that the Inspirator gives notice earlier, allowing
more time to prepare for his/her departure.
 Inspirators should note that if they decide to terminate their contract within the first two months
of placement without the consent of the national ActionAid office, the Inspirator will forfeit
his/her right to a paid ticket back to his/her country of residence. Additionally, if the Inspirator
should choose to terminate his/her contract after the third month and up to one month before the
contract ends for any other reasons than health problems, the Inspirator will be required cover
half of the return ticket.
 In the event of a breach of agreement, the agreement can, however, notwithstanding the
aforementioned rules be terminated forthwith

DISPUTE:
All disputes or claims arising in relation to this agreement that are not solved through direct
consultations between the parties involved shall be referred to the AAI DRC Director for his/her final
decision.

SIGNING THE AGREEMENT:


The terms and conditions of agreement are confirmed by the signatures below.

The agreement should be signed in three copies to confirm receipt of the Chapter on Terms and
Conditions Inspirator – People4Change Manual and likewise confirm that the conditions stipulated
therein and in the present agreement, including the Values and Policy Compliance Statement are
accepted.

Values and Policy Compliance Statement

PURPOSE This statement applies to all ActionAid staff including volunteers and interns. It serves as
an acknowledgment of values and key policies that guide desirable behaviour in ActionAid. We expect
