Terms of Sale
1. Payments:
Payment must be made during the period listed within the letter of quotation
and invoice.
2. Prices:
Rates offered are only valid for 30 days from the date of quotation issuance
and subject to change without prior notice. All sales are governed by the
current available prices on the purchase date; accordingly, purchase orders
must reflect those prices.
3. Late deliveries:
All quotations and lead times have been prepared based on raw materials
and manpower availability. The seller will not accept any responsibility for
losses arising from late deliveries, whether the cause is lack of raw materials
or any other causes beyond the control of the seller.
4. Responsibilities:
Materials sold are produced in accordance to the highest quality standards,
and have been developed by an array of local and international experts.
Consequently, the seller guaranties products free of manufacturing defects.
Conversely, since the seller has no direct control over the implementation or
application of its products, the seller does not bear responsibility or provide
guarantee on applied materials.
5. Damages caused during transportation of the goods, shortages, etc.:
In instances where the seller is responsible for insuring product shipments by
land/air, the insurance will cover all marine/weather damages in accordance
to international shipping terms (all dangers). This includes damages incurred
by wars, strikes and riots.
6. Packaging:
Unless otherwise stated, materials are packaged in sealed containers.
Packaging is subject to change by the seller without prior notice.
7. Return of non-defective goods:
The buyer can refund or replace sold materials within 3 days of materials
receipt. This is under the following conditions: the materials have not been
used, are in the original packaging (without removing the labels), and were
not tailor-made for the buyer. Additionally, a copy of the purchase invoice
must be submitted.
8. Return of defective goods:
The buyer can refund or replace defective materials (as a result of
manufacturing or packaging defects) within 7 days of materials receipt. This
is under the following conditions: materials were defected due to misuse or
application deviation from instructions stated in product technical datasheet.
Additionally, a copy of the purchase invoice must be submitted.
9. Alternative conditions:
These terms and conditions apply to all sales, unless there is a written
agreement between the seller and the buyer noting otherwise.
10. Arbitration:
In the case of a dispute in which the contracted parties have not been able to
resolve, the issue shall be arbitrated in accordance to the applicable laws in
the Kingdom of Saudi Arabia.
