Public Hearings
1. AN ORDINANCE TO AMEND SECTION 13.5-4(B)(3) OF THE FAUQUIER COUNTY CODE
PROHIBITING REFUSE COLLECTION IN EARLY MORNING HOURS - The current noise
ordinance provisions in the Fauquier County Code prohibit refuse collection and sanitation
services prior to 5:00 A.M. (§ 13.5-4(b)(3)). Due to complaints in residential zones about the
disruption this noise creates to the peaceful enjoyment of their properties, this amendment
would prohibit these services prior to either 6:00 A.M. or 7:00 A.M. (R. Holder Trumbo, Jr., Scott

2. A RESOLUTION TO ADOPT THE 2019-2020 THROUGH 2024-2025 SIX-YEAR PLAN FOR
SECONDARY ROADS (SSYP) AND THE 2019-2020 FISCAL YEAR BUDGET - Pursuant to
Section 33.2-331 of the Code of Virginia, 2014, as amended, a joint public hearing will be held
with the Board of Supervisors and a representative from the Virginia Department of
Transportation (VDOT) to receive public comment on the proposed Secondary System
Construction Program for Fiscal Year 2019-2020 through Fiscal Year 2024-2025. (Christopher T.

3. A ZONING ORDINANCE TEXT AMENDMENT TO ARTICLES 3, 5, 7 AND 15 RELATED TO
SEWER AND WATER PROVISIONS - This text amendment proposes to revise Zoning
Ordinance provisions for sewer and water, to include both public and private facilities. Staff has
sought to clarify the requirements that pertain to sewer and water, provide a uniform naming
convention for types of facilities, and to amend Ordinance sections that conflict with each other.
The proposed Ordinance includes a process for administrative approval for limited waivers of
the requirement to connect to public sewer or water in certain circumstances, as well as the
ability to establish central sanitary sewer facilities to serve multiple lots in certain areas with the
approval of a Special Exception where these types of systems are not currently allowed. The
Planning Commission recommended approval of this text amendment on September 20, 2018.
The Board of Supervisors held a public hearing on January 10, 2019 and March 14, 2019 and

VETERINARY CLINICS AND ACCESSORY KENNELS IN THE PLANNED COMMERCIAL
INDUSTRIAL DEVELOPMENT (PCID) DISTRICT - This text amendment proposes to add
veterinary clinics as a principal permitted use and allow minor kennels as a secondary permitted
use with a Special Permit when accessory to a veterinary clinic in the Planned Commercial
Industrial Development (PCID) District. The Planning Commission unanimously recommended
approval of the text amendment following a public hearing on March 21, 2019. (R. Holder

6. A RESOLUTION TO APPROVE SPECIAL EXCEPTION SPEX-19-010598 - COPPER FOX
LANE PROPERTY - AN APPLICATION FOR A CATEGORY 20 SPECIAL EXCEPTION TO
ALLOW A PRIVATE INDIVIDUAL SEWAGE TREATMENT SYSTEM WHICH DISCHARGES
INTO A DRAINAGE WAY (PIN 6980-97-5249-000, CEDAR RUN DISTRICT) - The request is to
allow a private individual sewage treatment system which discharges into a drainageway
for an existing single-family residence and accessory garage apartment with failing septic
systems. The proposed system will discharge treated effluent into a ditch on the property which
will flow into an existing natural swale and eventually into Craig Run. The Applicant
contends there is no other possible solution for the failing septic system on this property. The
property is located at 10238 Copper Fox Lane, Midland. On March 21, 2019, the Planning
Commission unanimously voted to recommend approval of the application. (Jeremy M. and

7. A RESOLUTION TO APPROVE SPECIAL EXCEPTION SPEX-19-010607 - GREAT MARSH
ESTATE - AN APPLICATION FOR A CATEGORY 9 SPECIAL EXCEPTION TO HOST CLASS
C EVENTS AND A CATEGORY 3 SPECIAL PERMIT TO OPERATE A TOURIST HOME (PIN
6990-50-4480-000, LEE DISTRICT) - The Applicant is requesting a Category 9 Special
Exception to host a maximum of 55 Class C events per year with a maximum of 200 attendees
and a Category 13 Special Permit to operate a Tourist Home. Great Marsh Place, LLC plans to
host weddings, receptions, corporate events and other similar events. The property is located at
6105 Great Marsh Place, Bealeton. On March 21, 2019, the Planning Commission voted
unanimously to recommend approval of the application. It should be noted that the

8. AN ORDINANCE TO APPROVE REZONING AMENDMENT REZN-19-010781 - FOXHAVEN
SUBDIVISION - AN APPLICATION TO AMEND PORTIONS OF A PREVIOUSLY APPROVED
PROFFER STATEMENT (ASSOCIATED WITH REZN-18-008619) WHICH DOES NOT
AFFECT USE OR DENSITY, PIN 6889-54-9297-000 AND 6889-74-2503-000 (LEE DISTRICT)
- The Applicants are requesting changes to the previously approved proffer statement
associated with the Foxhaven Subdivision, none of which affect use or density. The first change
affects how the phasing of development is determined. The second change alters the layout
and design of the internal road network and how connectivity to adjacent roads is achieved.
