INSTRUCTION IN CASE OFCLAIM

INSTRUCTIONS TO BE STRICTLY OBSERVED IN CASE OF DAMAGE OR LOSS


UNDER PENALTY OF FORIEITING THE RIGHT TO CLAIM ON UNDERWRITERS

A. DAMAGE(S)
(l) CAREFULLY CHECK THE PACKING and in case oICONTAINER, check its external condition, state ofdooÍs, hinges identification marks and seals according
to shipping documents and invoices.
Apparent Damages
Upon taking delivery note ÍMMEDIAIELY the condition ofthe goods on the receipt provided by the carrier
As soon as the damage is asce(ained, take all necessary steps to minimise the loss.
The goods and packing or containers should be preserved in the condition received until the survey has been completed.
(2) CONFIRM EXCEPTIONS BY SENDING A REGISTERED LETTER OF PROTEST TO THE CARRIER OR RESPONSIBLE THIRD PERSON describing
conditions ofshipment when received, stipulating the damages and holding him liable for them (specimen hereunder).
(3) ASCERTAIN THE EXTENT OF THE DAMAGES
I Damages not exceeding EUR 1.500,-.
- Have ajoint survey held with the responsible representative ofthe Railways, Air or post Office Administration, the Inland Canier or the Shipping Company...
- Apply to the surveyor (overleafl only in case ofdispute arising on the cause and extent ofthe damage.
2 Damages exceeding EUR 1.500,-.
- Apply immediately to the surveyor (overleafl) so that a survey ofgoods may be arranged and the survey repoÍ issued accordingly.
- Call the canier to the survey and mention the place, date and hour where it will take place.
(4) SEND WITHOUT DELAY A COMPLETE FILE TO MARSH
The complete file will include the following documents:
a. Original Certificate of Insurance;
b. Copy commercial invoice & packing list,
c. Original (no photo/copy) of Bill of Lading &/or Road/Rail Way-Bill;
d. Copy of delivery receipt with exceptions (see A. l);
e.Original of underwriters' surveyors'report;
f. Copy ofprotest letter sent to last carriers;
g.Original of carriers' reply if any.
PS Concealed damages
Take exceptions against the carrier by registered letter AS SOON AS THE DAMAGE IS DISCOVERED and at the latest within 3 DAYS of delivery for marine
shipments - and within 7 DAYS for other intemational transport - and proceed as above.

B. SHORT OR NON-DELIVERY
The procedure is easier because no survey is necessary.
(l) Upon taking delivery NOTE IMMEDIATELY the short-delivered packages on the receipt provided by the canier.
(2) SEND A REGISTERED LETTER OF PROTEST
to the canier holding him liable for the short or non-delivery and requiring a CERTIFICATE OF NON-DELIVERY.
(3) SEND WITHOUT DELAYA COMPLETE FILE TO MARSH
The complete file will include the documents mentioned as above (see A.4), the survey repo( (see A.4.e) being however replaced by the CERTFICATE OF
NON-DELIVERY issued by the carrier.

C. SETTLEMENT OF THE CI,AIMS


Loss, ifany, payable after collection from the underwriters through MARSH.

D. GENERALAVERAGE
When a general average is notified to you, please contact MARSH immediately and prior to effecting any deposit eventually demanded by the ship owners.
IMPORTANT
In order not to reach the time-bar (12 months from the date ofarrival ofthe ship at the port ofdestination), the complete file shall be send by the claimant as soon as
possible.
Specimen ofprotest letter to the last carrier which should mandatorily be made in writing
(registered letter or telefax), a copy of which should be attached to the set of claim documents.

3) According to the contract ofcaniage and/or the law we have to hold you responsible for loss and consequences deriving therefrom.

5) For good order's sake, we have to point out that your eventual refusal to participate in ajoint survey will be construed as a full approval ofthe choice of
underwriter's surveyors and oftheir findings, their report being deemed contradictory and binding you in any and all respects.
6) The refusal ofjoint survey and the unclaused delivery receipt eventually demanded can therefore not discharge you ofyour liability.
7) Please consider the present telefax as a protest on behalfand on account ofany party interested in the cargo.
