COMPLAINT - AFFIDAVIT

I, HYORI A. KAINE, 27, single, resident of Gov. Cuenco

Ave, Banilad, Cebu City after having sworn in accordance with
law, do hereby depose and state that;

1. I am filing a case of slight physical injuries of Desdie S. Samer of

1316 East Capitol Hills, Clavano St., Cebu City

2. On December 9, 2018, I held classes as usual, and shortly before

dismissal at 4:00 o'clock in the afternoon, two (2) intermediate
girls went inside my room and told me that the herein accused
requested to see me at the Guidance Counselling Room. I
acceded to the request, and after dismissal of my class, I
proceeded to the Guidance Counselling Room, about 10 to 15
meters from my own room.

3. Upon my arrival at the Guidance Counselling Room, the persons

present were the accused, Miss Khara O. Kay, guidance
coordinator, Mrs Holiday S. Sale, home economics teacher. I
asked the accused what it was that she wanted, but instead she
went near me and slap me in the face accusing me of being a
paramour of her husband.

4. The accused told me calmly but in menacing manner in

vernacular:

Gidaginot pa gyud nimu akong bana. Mao gyud ka, lalaki ang
imong bisyo. Nagpakaulaw ka dili lang sa imong kaugalingon,
kon dili hasta pa usab sa imong mga kadugo. Maulaw ka, dalaga
ka, way sapayan nako kay minyo ko.

which means in effect:

“You still even took advantage of my husband. You are like that,
men are your vices. You should be ashamed not only to yourself,
but also to your relatives. You should be ashamed of
 yourself; you are an unmarried woman. Don't mind about myself,
because I am already married."

5. Accused further said: "From A to Z, you have done with my

husband. But die bitch". And she attacked me aggressively with
that I brushed myself on the rough wall, pulled my hair and
scratched me everywhere. She inflicted me different abrasions
and contusions that required medical attendance for a period of
four (4) to six (6) days.

6. In view of the foregoing, I am executing this affidavit for filing of

a criminal case for slight physical injuries against DESDIE S.
SALE.
