DEED OF EXTRAJUDICIAL PARTITION AND QUITCLAIM

KNOW ALL MEN BY THESE PRESENTS:

This Deed is entered into and executed by and among Spouses FABIAN ABO and
PURIFICACION F. ABO and children EDMAR ABO, EDWIN ABO, DIONELA ABO-
GUTUAL and NELDA ABO, all of legal ages, Filipinos, and residents of barangay
Balugo, Sibulan, Negros Oriental:

W I T N E S S E T H :
That spouses FABIAN ABO and PURIFICACION FONOLLERA are registered
owners of several parcels of lands located in the Province of Negros Oriental, and two of
which is more particularly described as follows:

1. A parcel of land known as Lot No. 4087-A, Psd-07-03-002658, being a portion


of Lot no. 4087, Sibulan, Cadastre, located in the barrio of Maningcao(now
Balugo), Sibulan, Negros Oriental covered by Transfer Certificate of Title No.
T-21506 with Tax Declaration No. 2002-16-004-0948, consisting of One
Thousand and Twenty (1,020) Square Meters, more or less; and,

2. Lot No. 4903 of Sibulan Cadastre, located in barangay Balugo, Municipality of


Sibulan, Province of Negros Oriental covered by Tax Declaration No.04-0440,
consisting of Two Thousand Six Hundred Twenty Six (2,626) Square Meters,
more or less;

That for and in consideration of the sum of ONE HUNDRED PESOS (Php100.00),
Philippine Currency, in hand paid by the herein grantees and receipt is hereby
acknowledged by the Grantors to their entire satisfactions, and that by virtue of these
presents, the grantors herein do hereby WAIVE all their rights, interests and
participations and QUIT all their claims over the above-described parcels of land, in
favor of their four children mentioned above.

That in order to serve their interest and participations over the aforementioned
parcels of lands, the parties herein have mutually and voluntarily agreed to officially
partition and adjudicate unto themselves the aforementioned parcels of lands and forever
be bound therein in the following manner, to wit:

1. That Lot No. 4087-A, as above-described shall belong to EDMAR ABO,


EDWIN ABO and NELDA ABO in equal shares;

2. That the Concrete house built in Lot No. 4087-A by spouses Fabian Abo and
Purificacion Fonollera where they are now staying, shall belong to NELDA
ABO, including the land where said house was constructed; likewise, the
houses built by Edmar Abo and Edwin Abo built in Lot No. 4087-A shall
belong to them, respectively, including the land where said houses were built;

3. That Lot No. 4903, as above-described shall belong to DIONELA ABO,


including all the improvements found therein

That the parties also declare that these parcels of land are not tenanted nor
worked upon by an agricultural lessee for they were the ones in actual and personally in
possessions of these parcels of land and that this deed is in consonants with the
provisions of the Comprehensive Agrarian Reform Program of the Philippines for these
lands belong to their respective retention limits allowed under the said law.
