RELEASE OF LIABILITY, WAIVER OF CLAIMS ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

On this day of ___________________, I, the deponent, declare that I understand the risk of bike riding & sitting on pillion seat & I am the
sole responsible for the same, ESCAPADES THE REBELLION & Other Partner Company is not responsible for the same. I undertake &
declare that I shall not sue them for any circumstances during the Ladakh/Spiti Bike Trip, which I am going for and they are facilitators
and they have made us aware of the every aspect of the trip.

It is further undertaken by us that the health and other climate and terrain related risks and threats are well known to me. I have made
myself aware of the basic survival and first-air necessities for the Bike-Trip stated herein. I further acknowledge that the ESCAPADES
THE REBELLIONs & other related third parties are not responsible for any unfortunate incident which may occur on the said trip duration,
as the tour company herein are mere facilitators who arrange only and exactly the arrangement and goods expressly agreed for, along
with providing expertise and managing the whole affair.
Any health issue, or trouble which may generate from physical exertion at height and under low oxygen and less facilities, for it being
secluded areas, are and have been expressly disclosed by me to the tour Company and I am solely responsible to carry and attend to
the medical necessities specific to my case.

I undertake that by signing this agreement, I the signee, give up the right to sue or make legally liable, the Tour Company, for any injury
or damages, howsoever caused.

INDEMNITY AGREEMENT BY AND BETWEEN:

ESCAPADES THE REBELLION and its directors, officers, employees, representatives and agents
(Collectively called “the Agents”) and _________________________, the undersigned deponent, of my representative, who hereby signs
this agreement on my behalf i.e. my representatives, heirs and assignees:

1. agree as a precondition to my participation in all events/ trips organized by ESCAPADES THE REBELLION and/or “The Agents”,
including but not limited to: wilderness hiking, trekking, trail running, mountain biking, paddling And/or white water rafting, fixed ropes,
rock climbing, bicycle touring, bicycle day trips, social events and Group travel (collectively referred to as “the Activities”) and in
further consideration of ESCAPADES THE REBELLION Allowing me to do so, that I will be strictly bound by the terms of this Release
of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement (“the Agreement)

2. I acknowledge that “the Activities” involve inherent risks and dangers that may cause serious injury and in unfortunate and rare
circumstances, possible life-threat to participants and customers.

3. I fully understand the risks and dangers associated with my participation in “the Activities” and accept same entirely at my own risk
and cost.

4. I have satisfied myself, and believe, that I am physically, emotionally and mentally able to participate in this program and that with
my equipment, if applicable, is appropriate for use in this program.

5. I understand that all applicable rules for participation must be followed by me unconditionally and that at all times the sole responsibility
for personal safety remains with me and that the agents are mere facilitators of the tour and travel.

6. I will immediately remove myself from participation, and notify the nearest official, if at any time I sense or observe any unusual
hazard or unsafe condition or if I feel that I have experienced any deterioration in my physical, emotional and mental fitness, or that
of my equipment, or exceeded my comfort level, for continued participation in any event or related activity. I indemnify the agents for
any liability on account of their limited role and services and they at no point of time have undertaken to be completely responsible
for my actions and losses if any, resultant thereby.

7. I hereby waive any and all claims which I may have against ESCAPADES THE REBELLION and ”the Agents” and release “the
Agents” from all liability for injury, death, property damage or any other loss sustained by me as a result of my participation in “the
Activities”, due to any cause whatsoever.

8. I hereby grant unconditional and irrevocable consent to the releases or any of its affiliates/assigns to use, edit, adapt/modify, publish,
copyright, assign or transfer, my name, likeness, photograph, voice and any taped or recorded appearance or interview with me
(collectively, the “applicant information”), in all media and types of advertising, publicizing, administration and promotion for the
Ladakh trip, in perpetuity as prescribed by law, or else for a 10-year period of time from the end of the Ladakh trip without
compensation or approval from me.

09. I shall adhere the Rules & Regulation as well as Instruction from Group leader, if in any case they find me risk for the entire trip I will
be asked to stop the ride for the safety of other participants & riders. Any deviation and decision I take on the trip/ tour without the
express permission of the Agents or their representatives, shall be considered abandonment of the tour services by the Agents and
I shall be on my own, with no liability of the Agents.

10. Fees & Advance paid is non-refundable & damage caused, if any, for during the trip to any property or object owned by anyone else,
but by myself, shall be my responsibility & I shall be solely liable to pay and bear the expenses or repair / replacement of the same.
I shall respect the co-participants & shall not be overtly offend and aggressive towards fellow-travelers and 3rd parties. Bike or
Vehicle I am ridding is fit for 2000 KMS of running & I have got it inspected & has required Insurance. I have further collected any
requisite legal or health permit, in furtherance of the trip involved, for the complete period and I shall be solely responsible if I am in
violation of any laws, central or regional.

11. I am completely capable to drive/ride as per the route in hilly as well as pain terrain. If in case of any health issue or physical condition
during the ride/tour/event I shall immediately show the signal if riding at that time and halt if serious or required & report to the Bike
Marshal / organizing team. The Team of Agents herein/ tour operator shall do their endeavors to get the health and other facility as
is available in the vicinity at my own cost. But I understand that the trip/ tour for all the other members cannot be stopped / aborted
unless necessary for the safety of other group members.

12. I will also ensure that I don’t carry any illegal substance, narcotic substance, weapons, etc. This trip strictly instructs to follow the basic
rule of riding any vehicle, and not under influence of alcohol & any other substances. If I cause problem to any other participants,
disturb the peace and tour for other travelers and customers of the Agents, the Agents reserve the right to immediately direct/ instruct
me and my co-traveler/ pack member, to abandon the trip/ tour and return travel on my/ our own expense and arrangement and I
shall no longer be treated as a the tour customer or member of the complete group of traveler under the arrangement of the Agents.
In this case, fee paid by me to the Agents shall be non-returnable.

TERMS & CONDITIONS:

Booking Conditions:
Deposit of INR 10,000/- is required to confirm the booking and subject to clear all the amount 15 Days before the trip date.
Security Deposit Conditions:
Security deposit Required of INR. 10000/- per bike (For F.I.T.) & one original ID proof. Security Deposit is refundable if there is no damage
done on bike.
Cancellation Conditions:
In Case of cancellation for group from ESCAPADES THE REBELLION due to any unavoidable reason, then we will try to adjust client in
another group departure. If, final cancellation is done from ESCAPADES THE REBELLION after trying for adjustment then we will
refund only 100% amount paid until then. In case of cancellation from client side after registration, no refunds shall be processed.
Liability Clause:
Responsibility of the Client – ESCAPADES THE REBELLION is not responsible in case of any physical or fatal injuries.
ESCAPADES THE REBELLION is not responsible for the vehicle damages as they are vis major. If the body, clutch plates or riding gears
gets further damaged because of rough riding, then the client will be charged for it.
In case of other vis major too, the Agent/GCT cannot be held liable.
Trip Extension Conditions:
Trip extension if unforeseen circumstances necessitate a trip extension or if the participants decide to extend the motorbike tour, additional
costs will be charged to client.
If any destination is miss due to unforeseen circumstances like road block/snowfall/rain/ETC so ESCAPADES THE REBELLION has the
right reserve to take final decision of trip extension.

Unexpected disruptions:
ESCAPADES THE REBELLION organizes guided motorcycle tours in some of the wildest areas on EARTH; accordingly the weather and
environment can be unstable especially in the Himalayas. ESCAPADES THE REBELLION is not responsible for changes in the itinerary
or program that are a result of roadblocks, landslides, monsoon, heavy rain or snow fall and any natural crisis/Disasters political issue
,strike, ILP issue etc.
ESCAPADES THE REBELLION is the professional company and we will visit only that area which is cover in ILP issued by Administration
of Ladakh,if any area we committed in route plan and for reasons beyond our control, we do not get permission by authorities to visit that
place, ESCAPADES THE REBELLION has the right to change the destination without prior information to Client.

Rights Reserve Conditions:
ESCAPADES THE REBELLION holds the rights to refuse / remove client while on a tour. In case of not following the rules of ride /
command of team leader / Argue with Group leader / unacceptable behavior with other group members etc. No amount is refundable in
that situation.
Participation Conditions:
To participate as a rider, an individual has to be equal or above the age of 18 years at the time of the tour and be in possession of a valid
motorcycle driving license or international driving license (for foreigners). Be in good health condition and have at least 2 or 3 years of
experience in riding a motorcycle.
As a pillion, an individual has to be equal or above the age of 12 years at the time of the tour, in good health condition and with at least
some motorcycle co-riding experience.
GROUP CONDITIONS:
A minimum of 10 numbers of participants is required to start a tour.

Dispute Resolution:
The dispute resolution shall be by Arbitration under Arbitration and Conciliation Act, 1996. And the seat of Arbitration by Sole Arbitrator,
mutually appointed, shall be at: Leh - Ladakh, region in the Indian state of Jammu and Kashmir.
For other purposes, the legal jurisdiction shall be that of Leh- Ladakh, Jammu and Kashmir, for the operation and place of business of
undersigned Tour Company is that of Leh- Ladakh, Jammu and Kashmir.

I have completely read and fully understand the conditions herewith and I sign this document voluntarily and without
inducement.
