= w.r.ww. & PULP ACT, 1971 = Qs Ans.: es (Maharashtra Recognition of Trade Unions & Prevention of Unfair Labour Practices Act, 1971) Is it right that Sales Representatives are also entitled for benefits of MRTU & PULP Act but are not entitled for the benefits of Industrial Disputes Act? Yes. This is because Sales Promotion Employees as defined under Sales Promotion Employees (Conditions of Services) Act, 1976 is as under, "Sales promotion employee" means any person by whatever name called (including an apprentice) employed or engaged in any establishment for hire or reward to do any work relating to promotion of sales or business, or both, but does not include such any such person -- . Who, being employed or engaged in a supervisory capacity, draws wages exceeding sixteen hundred rupees per mensum. or . Who is employed or engaged mainly in managerial or administrative capacity. The above definition of Sales Promotion Employees covers Sales promotion employees for all industries including Pharmaceutical Industry. As MRTU & PULP Act is made applicable to all Sales Promotion Employees, Sales Representatives for any industry including Pharmaceutical Industry, are entitled for the benefits of this Act. Industrial Disputes Act is applicable to Medical Representatives only by virtue of Section 6 (2) of the Sales Promotion Employees (Conditions of Services) Act, 1976. Since Sales Promotion Employees (Conditions of 0:2: Ans.: 0.3.: Ans.: Services) Act, 1976 is made applicable only to Pharmaceutical Industry. Sales Representatives are not entitled for the benefits of Industrial Disputes Act. Can field workers (Sales & Medical Representatives) demand recognition of their union and approach labour and Industrial Courts in respect to unfair Labour practices of the employer ? Yes. Sales Representatives can invoke any of the provision of MRTU & PULP Act like Medical Representatives. Is MRTU & PULP Act applicable to Medical Representatives ? Yes MRTU & PULP Act is made applicable to all Sales Promotion Employees subsequent to the amendment of the act in the year 1999 through which Sales Promotion Employees as defined under Sales Promotion Employees (Conditions of Services) Act, 1976 are covered under the definition of the term "Employee" under MRTU & PULP Act, kk & OPPURTUNITY - In the. middle of difficulty lies Oppurtunity RISK - There are no short-cuts to any place worth going
