BACKGROUND OF THE STUDY

Across the Philippines, there are only fifty (50) rehabilitation centers; forty-seven (47) of

which are residential while three are out-patient centers (Rappler, 2016). Considering this fact,

the mental health and avenue for welfare of Filipinos are alarmingly scarce compared to the rest

of the world. Given that the Philippines is still a developing country, the need for rehabilitation

centers and mental health institutions are struggling its way to be approved by the senate – in

order to be noticed that mental health is just as important as ones’ physical health.

Along with the recent news of lowering the age of criminal responsibility from 15 years

old to 9, it has been an alarming change of rules for the Philippines and the society in general. It

basically means that there would be an increase in the crime rate for the juvenile delinquents, and

this also implies that the demand for detention cells, centers, and rehabilitation institution

suitable for the children in conflict with the law (CICL) will increase as well.

In line with this, the current need of the country not just exclusive in Metro Manila, but

across the nation itself. There are plenty of CICL across the country and now that the age bracket

was lowered to six years down, it will only increase as time passes by since the qualification of

what they consider as “criminals” is now at the minimal. The population inside the rehabilitation

center in Guimaras slowly increases in number. Thus, it makes the institution more crowded and

unsuitable upon catering the needs of the CICL.

The jail and prisons are obviously not the place for the children. They are young and they

need all the provision and nurturance they could collect from their families and environment.

Unfortunately, the attention and nurturing they could have received from their parents and
guardians will only lessen due to the lowering of age bracket because this simply means that they

shall depart from home upon incarceration.

In this study, the Proposed Rehabilitation Center for the Juvenile Delinquents in

Guimaras will serve as an improved avenue wherein CICL could serve their time of commission,

but at the same time they could still live their childhood as children – where the environment is

refreshing and cleansing itself. It will be a child-friendly institution wherein the facilities are

proposed to cater their primary needs. This way, the CICL could still live a normal life despite

being away from their respective families and neighborhood. It aims to raise them into a well-

functioning individual away from the atrocities of the world, and may it direct them to be a new

person who will be responsible enough to distinguish right from wrong in order to avoid further

misdemeanor.

REVIEW OF RELATED LITERATURE
Rehabilitation Center

As defined by the Medical Dictionary (2009), a rehabilitation center is a facility


providing therapy and training for rehabilitation. The center may offer occupational therapy,
physical therapy, vocational training, and other special trainings which includes reformation of
socialization for individuals who committed acts contrary to the law.

According to the Department of Health (DOH) in the Philippines, the treatment and
rehabilitation centers or the therapeutic community modality is focused more on the four aspects
which is the bio, psycho-social and spiritual aspects of an individual.

Juvenile Delinquents

The Juvenile Justice and Welfare Act (R.A. 9344, Sec. 4, 2006) specifies the age eighteen
(18) and below as the qualifying age for juvenile delinquents in the Philippines. However, it is
not exactly specified on what age or what age bracket delinquency is most salient for the
juveniles. At the present, criminal responsibility is now lowered to age 9 years old.

The Save the Children UK (2004) conducted three researches across the Philippines and
consequently published a book entitled Breaking Rules: Children in Conflict with the Law and
the Juvenile Justice Process – The Experience in the Philippines. Here, it was identified that the
average age of children in conflict with the law (CICL) is 14.4. Far in which if compared to the
National Institute of Justice (2005) data, offenders are usually aged 13 and under. Those who
firstly committed crimes at the age of 13 and under were identified as “young starters” while
those who have committed their first crimes at the age of 15 or higher were identified as “late
starters”.

One of the arguments by Wolfgang and Feracutti (1977) as cited in the study of Gutierrez
and Shoemaker (2007) says that the rate of violence is relatively higher in Western and
developing countries; which evidently qualifies the Philippines. This is mainly because poverty –
an identified major factor affecting the CICL was found as the root cause of survival offending
(Save the Children UK, 2004). Survival offending is the act of perpetrating acts contrary to the
law for the sole purpose of endurance upon impoverishment.
Given that the Philippines is a developing country, it was identified that most juvenile
delinquents belong to the lower socioeconomic status (SES). This statement could be explained
by Robert Merton’s strain and anomie theory of crime and deviance which posits that crime and
deviancy are more prevalent in lower SES compared to other classes due to the position they
hold within the society.
