1.0 SCOPE
An act to provide for the prevention, control and abatement of air pollution.

2.0 REQUIREMENTS

BSL, SAHIBABAD to apply for "Consent to Establish" prior to setting up
any new facility / modification in the existing facility, which is likely to emit
air pollutants, and "Consent to Operate" before commencement of activities
in the new / modified facility. BSL, SAHIBABAD to also comply with the
Section 21 HOD – Commercial
conditions, as prescribed in the “Consent to Establish” or “Consent to
Operate” for emissions and renew the "Consent to Operate" annually or
before expiry of the validity period in the prescribed Format along with
requisite fees.
Not to discharge air pollutant(s) in excess of the standards prescribed by HOD – Operations,
Section 22
the UPPCB. HOD - Utility
Furnish information to the UPPCB and other designated agencies(Collector
of the district, Divisional Revenue Officer, Health Officer, Executive of
Section 23 local/Municipal authority, nearest police station) of accident or unforeseen HOD – Commercial
act or event in which emissions of air pollutant(s) occurred in excess of the
prescribed standards or are likely to occur.
BSL, SAHIBABAD has to allow entry of the UPPCB or any official
empowered by it to its premises at all reasonable times, for the purpose of
carrying out any of the entrusted functions or for inspecting to ascertain that
Section 24 provisions of the Act are being complied with, or for seizing any control HOD – Commercial
equipment, industrial plant , records, registers, documents or any other
material object if there are reasons to believe that provisions of the Act are
being contravened.
Provide the UPPCB or any officer empowered by it any information to
enable it to implement the provisions of the Act.(including information
Section 25 HOD – Commercial
regarding the types of air pollutants emitted into the atmosphere and the
level of the emission of such air pollutants).
Provide access to the UPPCB or any officer empowered by it, for taking
samples of air or emissions from any chimney , flue or duct or any other
outlet for the purpose of analysis.
Section 26 HOD – Commercial
BSL, SAHIBABAD to ensure that specified emission sampling procedure is
being followed by the UPPCB or any officer empowered by it, in case,
results of analysis are to be used as evidence in legal proceedings.
Right to appeal to the Appellate Authority, in case of grievance against an
Section 31 order by the UPPCB, under the Act, in the prescribed form, within 30 HOD – Commercial
days from the date of order.
Comply with the directions, issued in writing by the UPPCB, within the HOD - Utility
specified time as indicated in the order. The direction may include
1.0) The closure, prohibition or regulation of BSL, SAHIBABAD , operation HOD – Operations,
Section 31A
or process.
2.0) The stoppage or regulation of supply of electricity, water or any other
service
