FORMAL OFFER:

This Judicial Affidavit will affirm to the truth of the foregoing


statements and to support the petition filed by Bakket N. Bacnang for
the nullity of her marriage under Article 35(2) of the Family code.

“ Art. 35. The following marriages shall be void from the


beginning:

(2) Those solemnized by any person not legally
authorized to perform marriages unless such marriages were
contracted with either or both parties believing in good faith that
the solemnizing officer had the legal authority to do so;

I, SIAK T. CABSAT, of legal age, Filipino and with address at


____________________________, after having been duly sworn,
hereby state and depose that:

PRELIMINARY STATEMENT

The person examining me is Atty. Carr A. Pangabac with address at


#1 Siruc Iti Manga, Turtle Islands, Tawi-Tawi. The examination is
being held at the same address. I am answering his questions fully
conscious that I do so under oath and may face criminal liability for
false testimony and/or perjury.

Q1: What is your relationship with the petitioner, BAKKET N.


BACNANG?
A1: I am her younger sister.

Q2: Do you know the respondent, LAKAY A. BACNANG?


A2: Yes sir.

Q3: How did your know the respondent?


A3: Sometime in November 2001, Bakket told me about Lakay, her
client in her direct selling business. On December 2001, Bakket
introduced Lakay to me. During that time, Bakket told me that
they were already planning to get married but was hesitant to
tell our father about it.

Q4: Why can’t they tell it to your father?


A4: Our father might not approve it because our father wanted
Bakket to study abroad.

Q5: What happened when they decided to get married?


A5: At the time Bakket and Lakay decided to get married, our father
suffered a stroke, which made it more difficult for them to inform
him their wedding plans. In fact, Bakket only told us, her
siblings and our mother, about their plans a few months before
their wedding.

Q6: How did the petitioner and the responded kept their marriage
secret from your father?
A6: In order to keep her marriage from our father, Bakket told us
that it would be held in Lakay’s place in Turtle Islands, Tawi-
Tawi. She also did not invite other people except for her close
friends Nabangloaba Bae and Mayat Isim.

On 21 September 2005, I, together with Bakket’s friends
Nabangloaba Bae and Mayat Isim, and our sister Adingmi,
attended Bakket’s wedding. We decided to leave our mother at
home so that our father would not suspect anything.

Q7: How did you arrive at Lakay’s place?


A7: Since we do not know how to go to Lakay’s place, the couple
rented the van of Kim Bagi, Lakay’s friend as our transportation.
Also, another friend of Lakay, Guy Yem joined us in the van.

Q8: What happened when your arrived at Lakay’s place in Green,


Turtle Islands, Tawi-Tawi?
A8: When we arrived in Turtle Islands, Tawi-Tawi, everything was all
set. The reception area was already decorated, foods were
being prepared and some guests from Lakay’s family were
already present. Then, we all went to the municipal hall of Turtle
Islands, Tawi-Tawi for the civil wedding ceremony.

Q9: Is the Mayor there when you arrived?


A9: No. It was the mayor’s assistant who approached us to inform
that then Mayor Tim Maray left to attend a funeral of a police
officer. Certainly, we were all shocked to hear the unpleasant
news.

Q10: What was the reaction of Bakket and Lakay?


A10: Bakket was so upset at that time. We immediately comforted
her. Nevertheless, Lakay and Bakket insisted to wait for the
mayor only to be told that the latter would no longer come back
as he had other appointments. We were all too stunned to react
on the situation. More so, Lakay and Bakket had decided to
cancel their wedding. In fact, Bakket was already thinking that it
happened because they did not get our parent’s blessings.

Q11: If the mayor is not there, who will officiate the wedding
ceremony?
A11: After a while, a certain Mr. Agra Raman approached Lakay and
Bakket and introduced himself as the mayor’s secretary. Mr.
Agra Raman informed us that he could officiate the wedding
ceremony, in lieu of Mayor Tim Maray. This representation was
supported by the mayor’s assistant.

Q12: Did Lakay and Bakket agree on the proposal?


A12: No. Lakay and Bakket were not easily persuaded by Mr. Agra
Raman’s proposal. They even told him that they were aware
that has no authority to officiate the ceremony.

Q13: Who convinced Lakay and Bakket?

A13: At this point, I know that Lakay and Bakket were already very
apprehensive. Nevertheless, we persuaded them to give in to
the proposal just to finish the ceremony. Also, we were already
starting to create a scene and thus, convinced Bakket and
Lakay to spare themselves from unpleasant rumors.

It was not easy to convince Lakay and Bakket to proceed with


the ceremony. However, everyone emphasized that they should
proceed to avoid inconvenience

Eventually, Lakay and Bakket agreed to proceed with the


ceremony to be officiate by Mr. Agra Raman even if they knew
that it would have no legal effect. This, after they made a
promise, in our presence, to marry in the future and observe
proper wedding ceremony.

Afterwards, we proceeded to the reception venue and then,


immediately left after the celebration. Since Adingmi and I did
not take any photos or videos, I asked Nabangloaba Bae and
Bakket’s sister and brother-in-law for copies of the photographs
and video taken during the ceremony.

Q14: Where and how did you have some photos?


A14: Nabangloaba Bae gave me the memory card for her camera so
that I can download and copy the pictures saved therein. Also,
Lakay’s brother-in-law, Bayaw, gave me a copy of a compact
disc, which contains the video taken during the ceremony.
However, we were not able to print and view the same until
prior to the filing of Bakket’s petition. This, to avoid our father
from discovering the same.

It was only in preparation for this case, that Bakket picked


several photos and still shots from the video taken. She then
asked me to print the same, which I did at Picture Park, Green,
Turtle Islands, Tawi-Tawi.

Q15: I am marking these photos as Exhibits “A-1” to “A-12”. Do you


confirm my action?
A15: Yes, sir.

Q16: What happened next?


A16: Since our father did not know anything about the ceremony, and
that for Bakket and Lakay, there was no valid marriage, the
couple decided to still live separately.

Immediately after they got back to in Blue, Turtle Islands, Tawi-
Tawi, Bakket lived in a dormitory, which is one block away from
Lakay’s place.

Q17: Did they try to live together?


A17: Yes, but it failed when they attempt to live together as husband
and wife. Bakket moved in with me in an apartment in in Red,
Turtle Islands, Tawi-Tawi.

Q18: Why are you executing this affidavit?


A18: I am executing this affidavit to affirm to the truth of the foregoing
statements and in support of the petition filed by Bakket N.
Bacnang for the nullity of her marriage under Article 35(2) of the
Family code.
