Affiant’s belief is based upon the following facts and information which Affiant received from: Q Affiant’s personal investigation of this alleged offense. CO ___ a fellow peace officer of the City of Dallas, Dallas County, Texas, who personally participated in the investigation of this alleged offense, providing this information to Affiant, and whose information Affiant believes to be credible. On October 4, 2019, Suspects Thaddeous Charles Green, 8/M [EL and Michael Mitchell, 6/1 committed the offense of Capital Murder, Texas Penal Code 19.03, when ‘they shot and killed Complainant Joshua Xavier Brown, 8/M [EEE during a robbery that occurred at 4606 Cedar Springs Road, Dallas, Dallas County, ‘Texas. On October 4, 2019, at approximately 10:33 p.m., Dallas Police officers responded to a shooting call at 4606 Cedar Springs Road. Upon arrival, patrol officers found Complainant Joshua Xavier Brown lying in the parking lot of the apartment complex. Dallas Fire and Rescue transported Complainant Brown to [EE Hospital, where he died as a result of multiple gunshot wounds. Witnesses at the offense location stated they heard arguing and yelling and then they heard 3-4 gunshots. When the witnesses came outside they found the Complainant on the ground. One witness informed officers after hearing the gunshots she observed a light gray sedan flee the area at a high rate of speed. Patrol officers found a holster in the Complainant's waistband; however, they did not locate a gun on the Complainant. ‘On October 7, 2019, Detectives discovered Suspect Jacquerious Mitchell, 8/M QB, was shot on October 4,2019, and transported to EE Hospital. The original police report for Suspect J. Mitchell stated he was shot during a robbery near Harry Hines Boulevard by unknown males. The accounts of the robbery were given to responding patrol officers by Suspect Michael Mitchell. On October 7, 2019, Detectives B. Tabor, #7687 and S. Sayers, #7157, went to MB esr! and interviewed Suspect J. Mitchell regarding the robbery in which he was reported as a victim. Suspect J. Mitchell stated he and Suspect Thaddeous Green, along with Suspect Michael Mitchell, left Louisiana to come to Dallas to buy marijuana from a person he did not know. Suspect J. Mitchell stated his cousin, Suspect Green, made all the arrangements with the person they were buying the marijuana from Suspect J. Mitchell stated they were in a rented Kia and Suspect Green drove to the offense location. Suspect J Mitchell stated they pulled into an apartment complex that he was not familiar with and Suspect Green got out of the vehicle and started talking to someone in the parking lot. Suspect J. Mitchell stated while he was sitting in the car, he could hear Suspect Green and the unknown male arguing and fighting with each other. Suspect J. Mitchell stated he got out of the vehicle to see what was going on and as soon as he walked up, the unknown male pointed a gun at him and told him to get back into the car. Suspect J. Mitchell stated the unknown male shot him and as he fell back into the car, he heard two additional gunshots and Suspect Green, in a panic, ran back to the car and drove off. Suspect J. Mitchell stated Suspect Green got into the car with the same handgun and black bookbag that the unknown person originally had on him before the shooting occurred. Suspect J. Mitchell stated he believed the black bag and handgun belonged to the unknown male and the bag contained marijuana. Suspect J. Mitchell stated he was driven to a clinic and later transported to [EEEHospital for his gunshot wound. Suspect J. Mitchell stated he was directed by Suspect Green to lie to the police about the location he was shot, and Suspect Michael Mitchell told him to say he was with Martin Demon during the robbery, which was a made-up name to protect the identity of Suspect Michael Mitchell. The interview with Suspect J. Mitchell was non-custodial and Suspect J, Mitchell was not under arrest or being detained at the time of the interview. (STATE OF TEXAS __|_ AFFIDAVIT FOR ARREST WARRANT COUNTY OF DALLAS Detectives were able to view IIEEEHospital surveillance video and later identify Suspect Michael Mitchell as the person who entered the hospital with Suspect J, Mitchell as he was being brought into the emergency room by Dallas Fire and Rescue. Detectives also observed a silver vehicle that pulled into the [NN Hospital parking lot that appeared to be associated with Suspect J. Mitchell and Suspect Michael Mitchell. The vehicle was a 2020 silver Kia, 26 FEE wich was confirmed to be a rental car, rented from Alexandria, Louisiana, on October 4, 2019 and returned on October 6, 2019. The vehicle was a 2020 silver Kia, MN 2c BE which was confirmed to be a rental car, rented from Alexandria, Louisiana, on October 4, 2019 and returned on October 6, 2019.
