STUDY LEAVE CONTRACT

This CONTRACT is entered into by the Department of the Interior and Local
Government, herein referred to as the GRANTOR, represented by ARTEMIO B.
CANEJA, CESO V, OIC-Regional Director, DILG Region VIII, and SHERYL ARCALES-
RAPATAN, LGOO II, DILG Region VIII- Province of Samar, herein referred to as the
GRANTEE, in connection with her study leave, in line with her attendance to Bar
Review Classes.

The GRANTEE shall be authorized to avail of the study leave on a full time basis
for a period not exceeding six (6) months on official time. Any extension shall be
chargeable to her vacation leave credits. Should her vacation leave credits be
insufficient to cover the period of extension, she shall be on vacation leave without pay.

The parties hereby agree to the following terms/conditions and obligations:

That the GRANTEE shall:

1. Enter into a contract with the Department and live up to its stipulated terms
and conditions;

2. Enroll in a review center or any reputable institution and be responsible for

the payment of tuition and other fees;

3. Submit a Certification of Admission to the Personnel Section, Finance and

Administrative Division, DILG Regional Office, from the Review Center and
proof/certification that she shall take the BAR Exam on November, 2019;

4. Refund in full the salaries and allowances received during the period of the
study leave in case the GRANTEE fails to complete the Bar review and/or
fails to take the examination regardless of reasons, except for death and
permanent disability;

5. Report to the office immediately upon completion/termination of the study

grant and vacation leave;

6. Render the required service obligation of two (2) years in DILG reckoned
from the date of her reinstatement after the study leave and vacation leave;

7. Not go on leave of absence for more than one (1) month while serving the
required service obligation unless on emergency cases and/or reasonable
circumstances, subject to the discretion of the agency head;

8. Refund to the Department the full amount incurred for the GRANTEE’s
salaries, allowances, incentives and bonuses received while on scholarship
once the GRANTEE fails to comply with any of the foregoing conditions
through the GRANTEE’s fault or willful neglect, resignation, voluntary
retirement, or other causes within the GRANTEE’s control.

That the GRANTOR shall:

1. Terminate the GRANTEE’s study leave grant in case of breach of contract;

2. Pay the GRANTEE’s salary, allowances and other benefits such as Personnel
Economic Relief Allowance (PERA), 13th month pay and cash gift, etc.;

3. Relieve the grantee of all official duties and responsibilities for the duration of
the grant.
