Subject: Prevention of Cruelty to Animals (Establishment and Regulation of Societies for
Prevention of Cruelty to Animals) Rules, 2001.

Prevention of Cruelty to Animals (Establishment and Regulation of Societies for Prevention of
Cruelty to Animals) Rules, 2001 was introduced without legal provisions of 38-A of the PCA Act,
1960. AWBI asked so many times to all field functionaries but nobody cares then I moved
complaint for Mandatory Injections before Rohini court because Delhi has 11 District but AWBI
with the Director, Department of Animal Husbandry (Govt. of NCT of Delhi) replied as attached.
I came to know via RTI replied by AWBI that they don’t have record about compliance of section
38-A of PCA Act, 1960 during introduction of these Rules, now I came to know the truth,
accordingly moved to the Rohini court with counter of AWBI reply.
Please find attached reply of AWBI for consideration about rejoinder with actual facts in the
interest of natural justice.
Section 38-A of the Prevention of Cruelty to Animals Act, 1960:
Rules and regulations to be laid before Parliament
Every rule made by the Central Government or by the Committee constituted under section 15
and every regulation made by the Board shall be laid, as soon as may be after it is made, before
each House of Parliament, while it is in session, for a total period of thirty days which may be
comprised in one session or in two or more successive sessions, and if, before the expiry of the
session immediately following the session or the successive sessions aforesaid, both Houses
agree in making any modification in the rule or regulation as the case may be, or both Houses
agree that the rule or regulation, as the case may be, should not be made, the rule or regulation
shall thereafter have effect only in such modified form or be of no effect, as the case may be so,
however, that any such modification or annulment, shall be without prejudice to the validity of
anything previously done under that rule or regulation.
Hon’ble Supreme Court of India, passed orders for compliance of Rules made out under the
Prevention of Cruelty to Animals Act, 1960 whereas these rules never been approved by the
Parliament as per section 38-A of the Prevention of Cruelty to Animals Act, 1960.

Hon’ble Minister of Fisheries, Animal husbandry & Dairying (Govt. of India) to place all Rules,
Notifications & Regulations made under PCA Act, 1960 after 30-7-1982, before both Houses of
Parliament as per section 38-A of PCA Act, 1960.
