TRAFFIC PENALTY TRIBUNAL

2008/09

INTRODUCTION
This report presents information on Traffic Penalty Tribunal activity for the
period 1 April 2008 to 31 March 2009. It is the first time that annual
statistical information has been published in this stand-alone format and
it is proposed that the Tribunal’s annual statistics will be published this
way in the future.
2008/09 represented a period of legislative change in civil parking enforcement with the
introduction of the Traffic Management Act 2004. However it should be borne in mind that the
statistics in this report will also include cases that were decided under the Road Traffic Act 1991
which was replaced by the new legislation on 31st March 2008.
Over forty new councils commenced civil parking enforcement during 2008/09 and this is
reflected in table 6 by the number of penalty charge notices (PCNs) issued when compared to
2007/08. Taking councils who have been in the scheme since 2006/07 or longer, 47% of those
councils issued less PCNs in 2008/09 than in 2007/08, 23% issued more and the remaining 30%
of councils could not be compared as they had not been enforcing long enough for a meaningful
comparison to be made.
Whilst the number of appeals increased in 2008/09, the rate of appeal per PCN did not change
significantly. The proportion of motorists’ appeals that were not contested by the enforcing council
increased slightly whilst the proportion of appeals allowed by the Adjudicator remained static.
Appeals against parking PCNs issued by Welsh Councils are detailed within the report which also
includes information on appeals received in respect of PCNs issued by the relatively small number
of English councils undertaking civil bus lane enforcement and/or clamp and tow-away.

APPEALS – A 10 YEAR OVERVIEW
In the year ending March 2009 some 12,423 parking appeals were received
by the Traffic Penalty Tribunal which reflects an increase of just over 11%
on the previous year. During the year ending March 2009 coinciding with
the introduction of the Traffic Management Act 2004, over 40 new councils
commenced civil parking enforcement. The Traffic Penalty Tribunal aims to
acknowledge 95% of appeals within two working days and during 2008/09
was able to do so in 96% of appeals.

constant over 2007/08 and 2008/09: signs and lines, pay and display tickets

TRIBUNAL HEARINGS BY TYPE 2008/09
The Traffic Penalty Tribunal operates three hearing types: postal (where the
Adjudicator considers only documents without the attendance of the parties),
personal and, more recently, telephone hearings. The chart below sets out
the proportion of appeals by hearing types. This compares to 2007/08 when
hearings comprised 34% personals, 65% postal and 1% telephone hearings.

and then presents appeals activity by individual councils. In March 2008,
the Traffic Management Act 2004 introduced the requirement for local
authorities to specify the enforcement authority including two tier authorities
(counties and districts). Two tier authorities are included in alphabetical order
by county and are highlighted by an orange border to the table.

APPLICATIONS FOR REVIEW
Paragraph 12 of the Schedule to The Civil Enforcement of Parking
Contraventions (England) Representations and Appeals Regulations 2007
largely replicates the procedure for review of an Adjudicator’s decision
previously provided in The Road Traffic (Parking Adjudicators) (England and
Wales) Regulations 1999, applicable to appeals concerning Penalty Charge
Notices issued under the Road Traffic Act 1991.
The review application is a two stage process. Firstly, the Adjudicator has to
determine whether the application falls within the narrow grounds for review
set out in that paragraph. If it does not then the application will be refused.
If, however, one or more of those grounds is made out then a review of the
Adjudicator’s decision will be carried out. In such cases, the review will be
determined on the basis of representations from both parties in relation to that
application. On review, the Adjudicator’s decision may be upheld, revoked
or varied.
During 2008/9 the Traffic Penalty Tribunal received post-decision
correspondence in respect of 369 cases (248 from appellants and 121
from councils), of these 64 were accepted as an application for review from
appellants and 48 from councils. In 27 of 64 cases (appellants) the original
adjudicator decision was upheld on Review. In 19 of 48 cases (councils) the
original adjudicator decision was upheld on Review.

THE PATROL JOINT COMMITTEE
PATROL stands for Parking and Traffic Regulations Outside London. The PATROL Adjudication Joint
Committee has been established to enable Councils having Civil Enforcement Area Orders to exercise
their functions under Section 81 of the Traffic Management Act 2004 and Regulations 17 and 18 of the
Civil Enforcement of Parking Contraventions (England) General Regulations 2007. These functions are
exercised jointly with other councils in accordance with the requirements of Regulation 16 of the Civil
Enforcement of Parking Contraventions (England) General Regulations 2007.
The functions exercised by the PATROL Joint Committee on behalf of its constituent councils are
appointing independent adjudicators to the Traffic Penalty Tribunal, a function which is formally
delegated to the Chief Adjudicator and subject to the consent of the Lord Chancellor, providing
these adjudicators with administrative staff and accommodation and providing hearing venues.
Its remit in relation to the Tribunal is limited to these matters. Further information on the Traffic
Penalty Tribunal can be found in the Adjudicators’ Annual Reports which are available on the
tribunal’s web site at www.trafficpenaltytribunal.gov.uk. 
PATROL operates a public information web site www.patrol-uk.info which aims to provide motorists
who are not yet at the point of appeal to the Traffic Penalty Tribunal with access to common
information supplied by all member councils on the civil enforcement process for both parking
and bus lanes. In addition, the web site links to individual member council web sites for local
information. The web site has an accompanying leaflet “Don’t Ignore Parking Penalties – Pay or
Challenge!” which takes the reader through the various stages of the civil enforcement process and
answers a series of frequently asked questions, copies are available on request.
