DECLARATION OF PATRICK BUSCOVICH IN SUPPORT OF APPEAL NO.

19-116

I, Patrick Buscovich S.E., declare as follows:

1. I am a licensed civil and structural engineer, practicing for more than 40 years in
San Francisco, California. I have extensive experience with the permitting process, complaints,
and Notices of Violation. I have spent 3-5 hours per day at DBI since 1984. I make this
declaration in support of the above-captioned appeal. Unless otherwise stated, I have personal
knowledge of the facts stated herein and, if called as a witness, could and would testify
competently thereto.

2. I am the engineer assisting with the project at 3426-3432 22nd Street, San
Francisco (the “Property”), which is at issue in this appeal. I have also investigated the
permitting history for the Property.

3. The project involved renovating the existing 4-unit building at the Property,
including a foundation/seismic upgrade and interior modifications (the “Project”). According to
the San Francisco Property Information Map, the building at the Property was built circa 1900.

4. On about Wednesday, September 25, 2019, a complaint was made to DBI


regarding the Project. (Complaint No. 201987211.) A true and correct copy of the DBI log of
this complaint is attached hereto as Exh. A.

5. Based on the DBI organizational chart, I believe this complaint was routed by
DBI Deputy Director Ed Sweeney to code enforcement on Thursday, September 26, 2019. On
Friday after 4:00 pm, I met with DBI Chief Building Inspector Mauricio Hernandez. Mr.
Hernandez informed me that nine permits related to the Project would be revoked. When I was
told this, I knew something was going on.

6. On about September 30, 2019, DBI issued NOV No. 201987211 in relation to the
Project. (A true and correct copy of this NOV is attached hereto as Exhibit B.)

7. Each of the violations alleged in the NOV is either unfounded, or minor and
properly correctable via a revision permit. This is what the Appellants seek to do, and what
normally occurs in these circumstances.

8. Also on about September 30, 2019, DBI issued a letter revoking nine permits
related to the project. (A true and correct copy of the letter of revocation is attached hereto as
Exhibit C.)

9. This complaint was processed at an unprecedented speed for a case of this type. I
believe the reason for this haste is that they wanted to issue an NOV before DBI Chief Building
Inspector Patrick O’Riordan, who would normally handle this matter, returned back from
vacation the following week. I was told that the permit would be revoked on Friday, September
27. The permits were revoked on Monday, September 30, 2019, before Mr. O’Riordan returned
from vacation.

10. On about October 1, 2019, a second complaint was lodged. (Complaint No.
201989011, the “Second Complaint”). The description for the Second Complaint notes that on
October 1, 2019, “a folder was delivered on the 3rd floor 1660 Mission St. concerning an
approved plan PA#201807285200. The letter criticizes the approval of PA#201807285200.”

11. I viewed the letter/report at DBI Code Enforcement multiple times. The letter that
was included in this folder, which mysteriously appeared at the third floor of 1660 Mission
Street, purports to be an engineering review of the Seismic/Foundation Permit and Project, but is
unsigned and not on a letterhead. Based on my experience, unsigned engineer reports are not
accepted by DBI.

12. The letter also attached portions of my building plans for the Project, which are
not available to the public. Neither I nor the owner of the Property has authorized DBI to provide
the Project plans to any third party. Absent such authorization, it’s not possible for a member of
the public to get copies of stamped building plans. I am informed and believe that the only
people who have access to these plans are a small group of senior DBI and Planning officials

who can bypass copyright protection rules. Therefore, it appears that one of these senior DBI
officials printed my plans and gave them to an engineer.

13. I am informed and believe that my partner went to DBI Records Management
Office to view documents related to the Property. When DBI staff were logging her request, she
saw a “P. Urrutia” listed as a party who had previously viewed documents for the Property. I am
informed and believe that Mrs. Urrutia lives in Burlingame and is married to Albert Urrutia, who
works with Rodrigo Santos at Santos & Urrutia.

14. I am informed and believe that Mr. Santos is being prosecuted by the San
Francisco City Attorney for actions involving DBI. I have complained about several of Mr.
Santos’ projects, including an illegal and dangerous 14-foot excavation on Eureka Street. A DBI
Senior Inspector subsequently told me to stop complaining about Mr. Santos.

15. Around this time, I was informed that multiple phone calls were made to members
of the Planning Commission regarding this issue, suggesting that the NOV had been issued by
DBI to send a message to Planning Commissioner Dennis Richards to back down on his
investigation of issues involving DBI. I am informed and believe that Mr. Richards has an
ownership interest in the Property.

16. I had multiple meetings with DBI Chief Building Inspector Mauricio Hernandez
and one meeting with Deputy Director Ed Sweeney to discuss the alleged violations. Mr.
Hernandez and Mr. Sweeney made it clear to me that they would come down as hard as possible
on the Project since the alleged violations were so “outrageous.” Based on my knowledge of the
phone calls that had been made, I took this comment to mean that, unless Planning
Commissioner Dennis Richards backed off his criticisms of DBI regarding unlawful work that
had occurred at 3847-3849 18th Street, they would hold up the Project.

17. At another meeting I had with my client and Mr. Hernandez, he said that even if
we won at the Board of Appeals, we would still be back dealing with him. I took this to mean
that Mr. Hernandez intended to obstruct the Project even if the revocation decision is reversed by
the Board.
