In response to the opinion of the European ParliamentØ(Ï) delivered on 23 October 1997 on the
proposal for a European Parliament and Council Directive amending European Parliament and
Council Directive 95/2/EC on food additives other than colours and sweeteners COM(96) 303
final — 96/0166(COD) and in accordance with the second paragraph of Article 189a of the
Treaty establishing the European Community, the Commission has decided to amend the
above mentioned proposal as follows:

The following entry is added to Annex IV, 12th section (concerning E 442), 3rd column:

In Annex VI, the first note is replaced by:

Formulae and weaning foods for infants and young children


may contain EØ414 (acacia gum, gum arabic) and EØ551 (silicon
dioxide) resulting from the addition of nutrient preparations
containing not more than 150 g/kg of EØ414 and 10Øg/kg of
EØ551, as well as EØ421 (mannitol) when used as a carrier for
vitamin B12 (not less than 1 part vitamin B12 to 1Ø000 parts
mannitol). The carry over of EØ414 in the product ready for
consumption should not be more than 10 mg/kg.

Formulae and weaning foods for infants and young children


may contain EØ301 (sodium L-ascorbate), used at QS level in
coatings of nutrient preparations containing polyunsaturated
fatty acids. The carry over of EØ301 in the product ready for
consumption should not be more than 75 mg/l.

The maximum levels of use indicated refer to foodstuffs ready


for consumption prepared following manufacturers’ instructions.

In Annex VI, part 1, the 2nd note is replaced by:

2.ÙIf more than one of the substances EØ322, EØ471, EØ472c and
EØ473 are added to a foodstuff, the maximum level laid down
for that foodstuff for each of those substances is lowered by
the amount present of the other substances in that foodstuff.
