ANNEX:ÙSpecific conditions applicable to officials and other servants of the European


Communities

(Î)ÙThis notice is for competitions COM/A/11/98 (AØ8) and COM/A/12/98 (AØ7/AØ6). Information
common to both competitions is set out in a single column. Where the information differs, it is
presented in two separate columns; the one on the left relates to competition COM/A/11/98 (AØ8) and
the one on the right to competition COM/A/12/98 (AØ7/AØ6).

I.ÙINTRODUCTION

1. General

The Commission is also organising open competitions COM/A/9/98 and COM/A/10/98,


based on tests, to constitute a reserve of Administrators (AØ7/AØ6) and open competition
COM/A/8/98, based on tests, to constitute a reserve of Assistant Administrators (AØ8).

The competition procedure is split into two phases: preselection, and written and oral tests.

Candidates must specify on their application form the number of the competition they wish
to enter and may apply for only one of the five parallel competitions (COM/A/8/98,
COM/A/9/98, COM/A/10/98, COM/A/11/98 and COM/A/12/98) (the competitions will
be held at the same time), failing which they will be disqualified. Transfer from one
competition to another is not permitted.

Candidates must choose one of the two fields (one only) covered by the competition for
which they are applying. This must also be specified on their application form, failing which
they will be disqualified.

Competitions COM/A/11/98 (AØ8) and COM/A/12/98 (AØ7/AØ6), to which this notice


refers, are being organised to recruit Assistant Administrators and Administrators in the
fields of law and European public administration. Many of the procedural aspects are
common to both competitions.

Candidates must have a university degree that could give access to doctoral studies.
Candidates for competition COM/A/12/98 must also have at least three years’ professional
experience. Candidates for competition COM/A/11/98 must have obtained the first degree
giving access to the competition after 4 May 1995.

The reserve lists will be drawn on to fill vacancies as and when funds become available.

2. Equal opportunities

5. Recommendations

Before completing their application form and the required enclosures (optical reader form
and letter in support of their application), candidates are asked to read the notice of
competition and the accompanying Guide carefully. They contain useful information on
eligibility, on how to fill in the application form and on the arrangements for the
competitions.

6. The closing date for the submission of applications is: 4 May 1998.

II.ÙFIELDS COVERED BY THE COMPETITIONS/NATURE OF DUTIES

Candidates must choose one of the two fields covered by the competition for which they are
applying. This must be specified on the application form and cannot then be changed.

Duties will include the tasks listed below by way of example:

— Law

A devising, drafting and analysing Community legislation;

A taking part in the negotiation of international agreements;

A studying cases and drafting decisions, for example in the area of competition law;

A examining and monitoring national legislation for conformity with Community law;

A investigating alleged infringements of Community law, complaints, etc.;

A preparing the Commission’s case in court proceedings, mainly before the Court of
Justice or the Court of First Instance.

— European public administration

A preparing, developing and implementing Community initiatives, including working on


case studies, producing reports and drafting Community acts, and taking part in
consultations and negotiations within the Commission, with business and other interest
groups in the Member States, and with the other Community institutions;

A taking part in international negotiations, implementing bilateral and multilateral


agreements, and managing commercial or development policy instruments;

A administering and implementing Community policies and action programmes in various


fields of activity such as the single market, external relations, social affairs, agriculture,
structural policies, transport, the environment and information;

A managing human resources, including training, and managing and monitoring financial
resources.

III.ÙELIGIBILITY

The competitions are open to candidates who, on the closing date for the submission of
applications, satisfy the following requirements.

A. GENERAL CONDITIONS

Article 28 of the Staff Regulations of Officials of the European Communities provides that
candidates must:

—Ùbe nationals of one of the Member States of the Communities and enjoy their full rights
as citizens;

—Ùhave fulfilled any obligations imposed on them by the laws concerning military service;

—Ùmeet the character requirements for the duties involved.

B. KNOWLEDGE OF LANGUAGES

Candidates must have a thorough knowledge of one of the official Community languages
(Danish, Dutch, English, Finnish, French, German, Greek, Italian, Portuguese, Spanish or
Swedish) and a satisfactory knowledge of a second of these languages. Knowledge of
languages must be indicated on the application form and the optical reader form; no
supporting documents are required. Once specified, candidates may not change the
languages in which they wish to take the tests.

C. SPECIAL CONDITIONS

Only candidates with a university degree that could give access to doctoral studies will be
considered. If they are in doubt, candidates should check the level of their degree with the
competent national authorities. As a general guide, a table showing examples of degrees is
annexed to the Guide.

The selection board will allow for differences between Member States’ education systems.

showing their duration and nature must be provided.

IV.ÙADMISSION TO COMPETITION, PRESELECTION TESTS AND WRITTEN TESTS

1.ÙThe appointing authority will draw up a list of candidates who have submitted their
applications as required and satisfy the general conditions set out at III.A and B above and
will send this list with the candidates’ files to the chairman of the selection board.

2.ÙCandidates who have failed to submit a signed application form together with the required
enclosures will not be admitted to the competition.

3.ÙThe selection board will draw up a list of candidates who meet the condition set out at
III.C.1 above on the basis of the information provided by candidates on their application
form and are therefore to be admitted to the competition and the preselection tests.

4.ÙEach candidate will be informed by letter whether or not he/she has been admitted.

5.ÙOn the basis of the preselection tests the selection board will draw up the list of candidates
to be admitted to the written tests, i.e. those who both meet all the conditions for admission
set out at III above and have obtained the following results in the preselection tests:

6.ÙBefore candidates are admitted, their profile will be checked to ensure that it corresponds to
the conditions specified in the notice of competition. The initial check will be based on the
information provided by candidates on their application form. There will be a further,
detailed check based on the supporting documents accompanying the application form after
the preselection tests. Should the selection board discover at this stage or at any subsequent
stage that the candidate does not meet one or more of the general or special conditions for
admission to the competition or that the information on the application form does not tally
with the supporting documents, the candidate will be disqualified. Candidates are
accordingly requested to complete their applications with the utmost accuracy.

7.ÙCandidates who have failed to submit all the supporting documents specified at III above by
the deadline will not be admitted to the tests.

V.ÙRECONSIDERATION OF APPLICATIONS

Any candidate who feels that a mistake has been made regarding eligibility may ask to have
his/her application reconsidered. Within thirty calendar days of the date postmarked on the
letter stating that he/she has not been admitted to the competition, the candidate should send a

The selection board will reconsider the application and notify the candidate of its decision
within forty-five calendar days of receipt of the letter.

VI.ÙINVITATION TO PRESELECTION TESTS AND WRITTEN AND ORAL TESTS

Invitations to attend the preselection tests and the written and oral tests are sent by letter. For
the preselection tests, there will be one or more test centres in each Member State. Candidates
will be asked to attend the centre closest to the address given on their application form. It is
not possible to change from one test centre to another.

Candidates admitted to the written and oral tests will be notified of the arrangements at a later
date.

Candidates are responsible for notifying the secretariat of the selection board of any changes of
address. Bearing in mind the time mail takes to arrive and the information contained in the
timetable, candidates should contact the Recruitment Policy; Competitions and Selection
Procedures Unit by faxØ(Î) or letter if they have not received the letter inviting them to attend
or informing them that they have not been admitted.

VII.ÙTESTS (Ï)

THE TESTS WILL BE ORGANISED AS FOLLOWS:

A. PRESELECTION TESTS

(a)ÙA test comprising a series of multiple-choice questions to assess the candidate’s


specialised knowledge of law,

or,

for the European public administration option, a series of multiple-choice questions on


the structure of the European institutions and the way in which they work.

This test will be marked out of 40 (pass mark: 20).

(b) A test comprising a series of multiple-choice questions to assess the candidate’s general
skills and suitability, with particular reference to ability to analyse and comprehension
skills.

This test will be marked out of 30 (pass mark: 15).

(c) The third preselection test will comprise a series of multiple-choice questions relating to
the main developments in European unification and in the various Community policies.

This test will be marked out of 20 (pass mark: 10).

(d) The fourth preselection test will comprise a series of multiple-choice questions to test
the candidate’s understanding of a second Community language (chosen by the
candidate and specified on his/her application form).

This test will be marked out of 20 (pass mark: 10).

The four preselection tests will last no longer than half a day.

B. WRITTEN TESTS

(e) A case study designed to test the candidate’s knowledge in the field chosen for the
competition and his/her drafting ability.

This test will be marked out of 60 (pass mark: 30).

(f) A case study designed to assess the candidate’s sense of judgment and ability to analyse
and summarise, as well as his/her suitability for category A duties as described at II
above.

This test will be marked out of 40 (pass mark: 20).

C. ORAL TEST

(g)ÙInterview with the selection board to enable it to complete its assessment of the
candidate’s suitability to carry out the duties described at II above in a multicultural
environment. The interview will also focus on the candidate’s knowledge of the insti-
tutions and policies of the European Union and on his/her knowledge of languages.

This test will be marked out of 50 (pass mark: 25).

X. RECRUITMENT

XI. APPLICATIONS

Before completing the application form, candidates should read the Guide contained in this issue
of the Official Journal.

1.ÙThe application form accompanying this notice of competition must be duly completed and
signed by the candidate, failing which the application will be invalid. The required enclosures
and photocopies of documents showing that candidates satisfy the conditions for admission to
the competition must be attached so that the selection board can check that they correspond to
the information provided on the application form. Candidates who do not have their degree
certificate or diploma may submit a document issued by the university certifying that they have
obtained the qualification in question.

All material to be placed on candidates’ files must be submitted afresh. Reference may not be
made to earlier applications. These provisions also apply to officials and other servants of the
European Communities or organisations devoted to furthering the Community’s interests, who
may not refer to documents in their personal file either.

No material contained in candidates’ files will be returned.

3.ÙApplications from officials or other servants of the European Communities working in external
delegations or in Commission and Parliament offices in the Member States may be postmarked
up to ten working days after the closing date for the submission of applications on condition
that candidates notify the Recruitment Policy; Competitions and Selection Procedures Unit by
fax (numbers given above) bearing a date and time not later than 16.00 hours (Brussel time) on
4 May 1998, that they intend to submit an application. Applications must be sent by registered
post.

4.ÙCandidates are asked to quote the name given on the application form and the number of the
competition in all correspondence.

5.ÙCandidates with a physical handicap are asked to attach a sheet to their application form
setting out the arrangements they feel are needed to make it easier for them to take part in the
tests.

6.ÙCandidates who are placed on the reserve list and offered a post will subsequently be asked to
produce the originals of diplomas, degrees and statements of employment so that copies can be
authenticated.

ANNEX

SPECIFIC CONDITIONS APPLICABLE TO OFFICIALS AND OTHER SERVANTS OF THE


EUROPEAN COMMUNITIES

1.ÙThe age limit referred to at III.C.1 does not apply to candidates who, on the closing date for the submission
of applications, will have been serving continuously as officials or other servants of the European
Communities for more than one year.

2.ÙThe cut-off date for the university degree referred to at III.C.2 for competition COM/A/11/98 (AØ8) does
not apply to candidates who, on the closing date for the submission of applications, will have been serving
continuously as officials or other servants of the European Communities for at least one year.

3.ÙThe professional experience referred to at III.C.3 for competition COM/A/12/98 (AØ7/AØ6) is not required
in the case of officials and other servants of the European Communities who, on the closing date for the
submission of applications, will have been serving in category B for at least three years and have completed
a course of university education and obtained a degree, as set out at III.C.2 (a photocopy of the degree
must be attached to the application form).

4.ÙThe degree referred to at III.C.2 is not required in the case of officials or other servants of the European
Communities who, on the closing date for the submission of applications, will have been serving in category
B for at least eight years.

5.ÙFor the purpose of calculating the periods specified at 1, 2, 3 and 4 above, only time spent in active
employment, on secondment and/or on leave for military service (points (a), (b) and (e) of Article 35 of the
Staff Regulations) will be taken into consideration; time spent on leave on personal grounds, on unpaid
leave or in non-active status will not be included.

6.ÙIt will be for the officials and other servants applying for the competition to provide all the information
needed to confirm that they meet the conditions of seniority referred to at 1, 2, 3 and 4 above, i.e. a copy
of the document appointing them officials or a copy of their contract and a copy of their last payslip.
