Imposition of a public service obligation pursuant to Council Regulation (EEC) No 2408/92

1. Pursuant to Article 4(1)(a) of Council Regulation (EEC) No 2408/92 of 23 July 1992 on access for
Community air carriers to intra-Community air routes, the German Government has decided to
impose a public service obligation in respect of scheduled air services on the Erfurt–Berlin/Tempelhof,
Erfurt–Hamburg and Erfurt–Cologne/Bonn routes with effect from 1 August 2003. This public service
obligation cancels and replaces that published in the Official Journal of the European Communities (1).

2. The public service obligation is as follows:

2.1. Minimum frequency

A regular air service — in the form of a service at each end of the day — must be maintained on
weekdays throughout the year. ‘At each end of the day’ means that there will be a morning return
flight to and form the given destination between 6.00h and 10.00h and an evening return flight from
and to the given destination between 15.00h and 22.00h. The evening flight on a Friday can take
place from 1 p.m. onwards. This requirment applies throughout the year. A limited air service is
possible between Christmas and New Year.

2.2. Capacity

Aircraft having at least 18 passenger seats must be used for the flights involved.

2.3. Flight times

Flights must be operated as morning and evening services between 6.00h and 22.00h.

2.4. Aircraft types

Flights from/to Erfurt airport must be carried out in accordance with the instrument flight rules (IFR).
The aircraft types used are to have adequate cabin headroom.

2.5. Fares

The maximum basic fare for a single flight on the individual routes may not exceed EUR 86,92 plus
EUR 0,26 per kilometre of linear distance between the airport reference points concerned.

2.6. Continuity of air services

The number of flights cancelled for reasons that can be directliy attributed to the air carrier may not
exceed 2 % of the estimated annual number of flights.

3. Air carriers are informed that the operation of the scheduled air services will be put out to tender and
that contracts are to be awarded with effect form 1 August 2003. An appropriate invitation to tender
pursuant to Article 4(1)(d) of Regulation (EEC) No 2408/92 will shortly by published in the Official
Journal of the European Union.
