Indirect taxation (VAT) (procedure without debate)

European Parliament resolution on the change of legal basis of the proposal for a European Parlia-
ment and Council regulation amending Regulation 218/92/EEC on administrative co-operation in
the field of indirect taxation (VAT) (C5-0103/2002  2000/0147(COD)

The European Parliament,

 having regard to the proposal from the Commission to the European Parliament and to the Council
(COM(2000) 349  C5-0298/2000  2000/0147(COD)) (1),

 having regard to the European Parliament’s position at first reading (2),

 having been consulted by the Council on the change of legal basis (C5-0103/2002),

 having regard to Rule 70 of its Rules of Procedure

 having regard to the opinion of the Committee on Legal Affairs and the Internal Market on the
changement of the legal basis

 having regard to the report of the Committee on Economic and Monetary Affairs (A5-0140/2002),

1. Confirms its position at first reading;

2. Disputes the appropriateness of the new legal basis proposed by the Council,

3. Insists that Article 95 of the EC Treaty is the appropriate legal basis;

4. Calls on the Council therefore to forward its common position to Parliament;

5. Instructs its President to forward this resolution to the Council and Commission.

 having regard to its position at second reading (1) on the Council common position (2),

 having regard to the Commission’s opinion on Parliament’s amendments to the common position
(COM(2001) 730  C5-0616/2001),

 having regard to Article 251(5) of the EC Treaty,

 having regard to Rule 83 of its Rules of Procedure,

 having regard to the report of its delegation to the Conciliation Committee (A5-0111/2002),

1. Approves the joint text and draws attention to the Commission statement thereon;

2. Instructs its President to sign the act with the President of the Council pursuant to Article 254(1) of
the EC Treaty;

3. Instructs its Secretary-General duly to sign the act and, in agreement with the Secretary-General of
the Council, to have it published in the Official Journal of the European Communities;

4. Instructs its President to forward this legislative resolution to the Council and Commission.
