JURISDICTION
2
1. This is an action to recover damages and for injunctive relief arising under
3
the patent laws and trademark laws of the United States and related state laws, and this
4
Court has original jurisdiction of the subject matter for each of the following claims:
5
a. Patent infringement in violation of the Patent Act, 35 U.S.C. § 1 et.
6
seq., with jurisdiction vested in this Court by virtue of 28 U.S.C. §§ 1331, 1332 and
7
1338(a).
b. Trademark/trade dress infringement in violation of the Lanham Act,
8
15 U.S.C. § 1051, et seq., with jurisdiction vested in this Court by virtue of 15 U.S.C. §
9
1121 and 28 U.S.C. § 1331, 1332 and 1338(a).
10
c. Trademark/trade dress infringement in violation of A.R.S. § 44-1453
11
with jurisdiction vested in this Court by virtue of 28 U.S.C. §§ 1332, 1338(b) and 1367(a).

5. Wheel Pros is a well-known vehicle wheel manufacturer and marketer.
2
Wheel Pros distributes more than two dozen brands of high-performance wheels and tires
3
for cars, trucks and SUVs, including a full line of company-branded wheel products,
4
which include (among others) the XD778 Rockstar (“Rockstar”), the XD811 Rockstar II
5
(“Rockstar II”), the XD827 Rockstar III (“Rockstar III”), the XD778 Monster
6
(“Monster”), and the XD822 Monster II (“Monster II”). In addition to one-piece and
7
multi-piece wheels with contemporary styling, Wheel Pros offers a selection of classic
wheel styles reminiscent of hot-rod happy days for racecar and drag racing enthusiasts. It
8
sells to customers in the United States and approximately 30 countries worldwide.
9
6. Upon information and belief, Defendant Wholesale Custom Tires and
10
Wheels LLC is a limited liability company duly organized and existing under the laws of
11
the State of Arizona having its principal place of business located at 4931 W. Indian
12
School Road, Phoenix, AZ 85031. Defendant Wholesale Custom Tires and Wheels LLC
13
does business under the trade name Phoenix Tires & Wheels Outlet. Wholesale Custom
14
Tires and Wheels LLC is hereinafter referred to as “Phoenix Tires.”
15
7. Upon information and belief, Phoenix Tires is a distributor and retailer of
16
wheels and tires that sells directly to consumers and retailers in the Phoenix area.
17
8. Upon information and belief, Defendant El Padrino Tires & Wheels LLC is
18
a limited liability company duly organized and existing under the laws of the State of
19
Arizona having its principal place of business located at 5946 N. Black Canyon Highway,
20
Phoenix, AZ 85017. Defendant El Padrino Tires & Wheels LLC does business under the
21
trade name El Padrino Tires $ Wheels. El Padrino Tires & Wheels LLC is hereinafter
22
referred to as “El Padrino.”
23
9. Upon information and belief, El Padrino is a retailer that purchases wheels
24
and tires from Phoenix Tires to sell directly to consumers in the Phoenix area.
25
10. Upon information and belief, Defendant Super Llantas Family LLC is a
26
limited liability company duly organized and existing under the laws of the State of
27
Arizona having its principal place of business located at 3803 N. 43rd Avenue, Phoenix,

AZ 85019. Defendant Super Llantas Family LLC does business under the trade name
2
Super Llantas. Super Llantas Family LLC is hereinafter referred to as “Super Llantas.”

11. Upon information and belief, Super Llantas is a retailer that purchases
4
wheels and tires from Phoenix Tires to sell directly to consumers in the Phoenix area.
5
12. Upon information and belief, Defendant Zhejiang Ivision Industry & Trade
6
Co., Ltd. is a limited company duly organized and existing under Chinese law having its
7
principal place of business in the Zhejiang Province, China. Upon information and belief,
Defendant Zhejiang Ivision Industry & Trade Co., Ltd. does business under the trade
8
name Ivision Wheel. Zhejiang Ivision Industry & Trade Co., Ltd. is hereinafter referred
9
to as “Ivision.”
10
13. Upon information and belief, Ivision is a Chinese manufacturer and trader
11
of wheels that imports its products into the United States and markets and sells its
12
products directly to Phoenix Tires in the regular course of business.
13
14. Fictitious Defendants, Does I-X, are individuals or entities which may have
14
liability with respect to the matters alleged herein., At such time as their liabilities and
15
identities become known, Wheel Pros may seek leave of Court to amend this Complaint
16
to add their true names.

WHEEL PROS HAS EXCLUSIVE PATENT RIGHTS IN THE WHEEL DESIGN
18
OF THE ROCKSTAR II, ROCKSTAR III, MONSTER, AND MONSTER II
19
15. Wheel Pros is the exclusive assignee and owner, by assignment from
20
inventor Suny Chung, of all rights, title and interest in and to the following patents
21
(collectively, the “Rockstar II Patents”):
22
a. U.S. Patent No. D701,481, issued March 25, 2014, and which is
23
subsisting. A true and correct copy of such patent is attached hereto as Exhibit 1.
24
b. U.S. Patent No. D709,018, issued July 15, 2014, and which is
25
subsisting. A true and correct copy of such patent is attached hereto as Exhibit 2.
26
c. U.S. Patent No. D711,808, issued August 26, 2014, and which is
27
subsisting. A true and correct copy of such patent is attached hereto as Exhibit 3.

16. Wheel Pros is the exclusive assignee and owner, by assignment from

(collectively, the “Rockstar III Patents”):

subsisting. A true and correct copy of such patent is attached hereto as Exhibit 8.

b. U.S. Patent No. D786,168, issued May 9, 2017, and which is

18. Wheel Pros is the exclusive assignee and owner, by assignment from
9
inventor Suny Chung, of all rights, title and interest in and to the following patents

(collectively, the “Monster II Patents”):

24 20. Wheel Pros is the exclusive owner of all rights, title and interest in and to:
25 a. U.S. Trademark No. 4611509, registered on September 23, 2014. A
26 true and correct copy of such trademark is attached hereto as Exhibit 23.
27 b. U.S. Trademark No. 5001689, registered on July 19, 2016. A true
28 and correct copy of such trademark is attached hereto as Exhibit 24.

CONSUMER RECOGNITION OF WHEEL PROS’ PATENTED DESIGN,
9
TRADEMARKS AND TRADE DRESSES IS AN IMPORTANT PART OF
10 WHEEL PROS’ SUCCESS
11
21. Wheel Pros’ sales have been extensive, with a substantial portion of those
12
sales being of the Rockstar, Rockstar II, Rockstar III, Monster, and Monster II wheels.
13
22. The Rockstar wheels, first sold in 2004, Rockstar II wheels, first sold in
14
2013, Rockstar III wheels, first sold in 2016, Monster wheels, first sold in 2007, and
15
Monster II wheels, first sold in 2014, are widely recognized by consumers as emanating
16
from Wheel Pros, and the distinctive designs on such wheels are key to such extensive
17
consumer recognition.

23. In addition to the basic elements of the Wheel Pros trademarks and patents
19
described above, there are a number of other features which when used in combination
20
with such basic elements serve to identify and reinforce further to consumers that the
21
products are, in fact, products of Wheel Pros or are sponsored by, approved by, or
22
otherwise associated with Wheel Pros.

WHEEL PROS’ TRADEMARKS AND PATENTS ARE UNIQUE AND
24 INHERENTLY DISTINCTIVE
25
24. The patents-in-suit and trademarks-in-suit referred to above are arbitrary,
26
fanciful and inherently distinctive. The various trademarks-in-suit and patents-in-suit are

unique and unusual and no other manufacturer uses them, individually or collectively, to
2
denote the source in the automotive industry as does Wheel Pros.

25. In addition to the inherent distinctiveness of Wheel Pros’ trademarks-in-suit
4
and patents-in-suit, such trademarks and patents have been marketed so extensively, and
5
have been so favorably received by the public that such trademarks have achieved
6
tremendous consumer recognition in the marketplace.
7
26. Wheel Pros’ sales success came after expending great amounts of time,
effort, and money in the promotion and advertisement of its goods under its trademarks
8
and patents. This promotional effort includes extensive internet, social media, and print
9
media advertisements, promotion of products by Wheel Pros personnel, suppliers,
10
dealers, and other promotional events and activities, sponsorships, and the like.
11
27. The widespread recognition and popularity of Wheel Pros Rockstar,
12
Rockstar II, Rockstar III, Monster, and Monster II wheels have been unwavering. Wheel
13
Pros popularized these brands through extensive advertising and promotion so that
14
consumers would recognize the unique trade dresses, appearances and trademarks of
15
these wheels.
16
28. As a result of the widespread and continuous use and promotion of the
17
trademarks and patents described above, such trademarks and patents are well known
18
throughout the United States and have become widely known and recognized as
19
identifying Wheel Pros as the source of a variety of products including, without
20
limitation, the Rockstar, Rockstar II, Rockstar III, Monster and Monster II wheels and as
21
distinguishing the source of these goods from those of others. These trademarks and
22
patents have come to and now do represent and symbolize the enviable reputation and
23
very valuable goodwill of Wheel Pros among advertisers, consumers and retail
24
establishments.
25
29. The Rockstar, Rockstar II, Rockstar III, Monster, and Monster II design,
26
trademarks and trade dresses today are almost universally recognizable within the wheel
27
industry and have one of the most stable and loyal customer bases in the industry.

30. The aforementioned trademarks and patents represent and symbolize one of
2
the highest quality and most durable wheels in the industry.
3
31. The trademarks and trade dresses referred to above are primarily non-
4
functional and are used for product identification purposes. The Rockstar, Rockstar II,
5
Rockstar III, Monster and Monster II design trademarks are non-functional.

34. Defendants are selling wheels bearing knock-offs of Wheel Pros’ highly
3
coveted Rockstar, Rockstar II, Rockstar III, Monster, and Monster II patented design,
4
trademark and trade dress. Specifically, Defendants have infringed, and are continuing to
5
infringe, by creating and offering for sale, and based upon information available to Wheel
6
Pros’ and believed to be true, Defendants are selling at least the following counterfeit
7
wheels:

39. Upon information and belief, Defendants sell the infringing designs
13
(sometimes referred to as “Imitations”) through the same channels of trade as Wheel
14
Pros including through retailers to consumers throughout the United States.
15
40. The Imitations are confusingly similar to Wheel Pros’ Rockstar, Rockstar
16
II, Rockstar III, Monster and Monster II design, trademarks and trade dress, and are likely
17
to cause confusion, to cause mistake, or to deceive as to their sponsorship or origin.
18
41. Defendants have advertised and promoted, are advertising and promoting,
19
and will continue to advertise, promote and distribute the Imitations unless enjoined by
20
this Court.
21
42. Wheel Pros is further informed and believes, and thereon alleges, that
22
unless enjoined and restrained by the Court, Defendants will continue to manufacture,
23
purchase, import, advertise, promote, offer for sale, sell and distribute the Imitations.
24
43. The advertisements, promotions, sales, distributions and offers for sale of
25
the Imitations are causing and will continue to cause a likelihood of confusion, mistake or
26
deception and actual confusion among purchasers of wheels as to the source of those
27
products. Such advertisements, promotions, sales, distributions and offers for sale are

diminishing, and/or will continue to diminish, the distinctiveness and the valuable
2
goodwill and reputation of the Wheel Pros patents, trademarks, and trade dress, and are
3
resulting in, and will continue to result in, lost sales of wheels by Wheel Pros. Such acts
4
will also continue to cause irreparable harm to Wheel Pros.
5
44. Defendants have used, are using, and, upon information and belief,
6
Defendants will continue to use the trademarks and trade dress in connection with the
7
Imitations, which have created, are creating, and will continue to create a strong
likelihood of confusion, mistake, or deception among purchasers of Defendants’ goods
8
and with the goods advertised, promoted, distributed and sold by Wheel Pros.

45. Defendants’ use of trademarks and trade dress virtually identical to Wheel
10
Pros’ distinctive trademarks and trade dress creates a likelihood that a false and unfair
11
association will be made between the Imitations and the goods of Wheel Pros so that the
12
purchasing public is likely to believe that the Imitations are products of Wheel Pros or are
13
associated with, affiliated with or otherwise sponsored by Wheel Pros.
14
46. Defendants’ unlawful acts, unless restrained, are likely to continue to cause
15
actual confusion, mistake or deception as to the purchasers of the Imitations and Wheel
16
Pros’ goods.

DEFENDANTS’ CONDUCT IS CAUSING IRREPARABLE HARM TO WHEEL

PROS
19
47. Defendants’ acts have caused and, unless restrained, will continue to cause
20
Wheel Pros to suffer substantial irreparable damages and injury through, inter alia, a
21
likelihood of confusion, deception and mistake among the relevant purchasing public and
22
the wheel trade as to the source, origin, sponsorship or approval of the goods associated
23
with Wheel Pros’ Rockstar, Rockstar II, Rockstar III, Monster, and Monster II patented
24
design, trademarks and trade dress, and devaluation of Wheel Pros’ valuable goodwill
25
and business reputation symbolized by its distinctive patented design, trademarks and
26
trade dress.

48. Wheel Pros has suffered loss of profits and other damages from the
2
confusion, mistake and deception resulting from the acts of Defendants, and Wheel Pros
3
is informed and believes, and thereon alleges, that Wheel Pros will continue to suffer
4
such damages unless and until Defendants are enjoined and restrained by this Court from
5
engaging in the acts complained of herein.

49. Wheel Pros has no adequate remedy at law because injury to its reputation
7
and goodwill cannot be quantified and such injury cannot be compensated by monetary
amounts.

FIRST CLAIM FOR RELIEF – FEDERAL PATENT INFRINGEMENT

50. Wheel Pros realleges and incorporates herein by this reference each and
10
every one of the allegations contained in each of the above paragraphs as though fully set
11
forth herein.

51. Defendants’ infringing products mimic Wheel Pros’ designs and are
13
substantially similar and/or the same as those designs claimed in U.S. Patent Nos.
14
D558,115, D701,481, D709,018, D709,020, D711,808, D712,333, D730,260, D733,026,
15
D736,137, D742,293, D747,253, D786,167, D786,168, D792,831, D794,533, D794,534,
16
D801,903, D805,456, D811,980, D811,981, D812,540, and D812,541.
17
52. The ordinary observer would justifiably believe, after viewing the
18
differences between the patented designs and the Defendants’ wheels, that Defendants’
19
wheels are substantially similar and/or the same as the patented designs.
20
53. Defendants have offered for sale the infringing products in the United
21
States. Specifically, at a minimum, Defendants have engaged in the following:
22
a. Offered for sale products that infringe upon the Rockstar II Patents;
23
b. Ivision has offered for sale products that infringe upon the Rockstar III
24
Patents and Monster II Patents; and
25
c. Ivision and Super Llantas have offered for sale products that infringe upon
26
the Monster Patent.

54. Defendants were placed on notice of Wheel Pros’ patents but Defendants
2
continue to engage in infringing activities.

55. Defendants’ awareness of Wheel Pros’ patents and Defendants’ continued
4
infringement makes such infringement willful, entitling Wheel Pros to enhanced damages
5
and an award of attorneys’ fees pursuant to 35 U.S.C. §§ 284 & 285.
6
56. Upon information and belief, Defendants have further made substantial
7
profits to which they are not equitably entitled.
57. Defendants’ acts and products complained of herein constitute patent
8
infringement in violation of Title 35 of the United States Code.

SECOND CLAIM FOR RELIEF – FEDERAL TRADEMARK/TRADE DRESS

INFRINGEMENT

58. Wheel Pros realleges and incorporates herein by this reference each and
13
every one of the allegations contained in each of the above paragraphs as though fully set
14
forth herein.

59. Defendants have offered for sale wheels with infringing “star” marks in the
16
United States through retail outlets infringing on U.S. Trademark Nos. 4611509 and
17
5001689.
18
60. Defendants have offered for sale wheels with infringing vertical “XD
19
Series” marks in the United States through retail outlets infringing on U.S. Trademark
20
Nos. 4513500 and 4919483.
21
61. Defendants have offered for sale wheels with infringing horizontal “XD
22
Series” marks in the United States through retail outlets infringing on U.S. Trademark
23
No. 4947750
24
62. Defendants have infringed Wheel Pros’ Rockstar I, Rockstar II, Rockstar
25
III, Monster and Monster II trademark and trade dress rights, competed unfairly with
26
Wheel Pros and misappropriated and traded upon Wheel Pros’ goodwill and business

reputation by falsely representing its goods as being sponsored by, approved by, or
2
connected with Wheel Pros.

63. Upon information and belief, Defendants are, in various ways, through their
4
agents and employees, falsely representing to potential purchasers of their goods that
5
such goods are affiliated, connected or associated with Wheel Pros by reason of the

infringing use of Wheel Pros’ distinctive Rockstar, Rockstar II, Rockstar III, Monster,
7
and Monster II trademarks and trade dress.
64. Defendants are making false and misleading representations by engaging in
8
commercial advertising using a trademark and trade dress which are identical or virtually
9
identical to Wheel Pros’ Rockstar, Rockstar II, Rockstar III, Monster and Monster II
10
trademark and trade dress.

65. Defendants are using in commerce false designations of origin, false and
12
misleading descriptions of fact or false or misleading representations of fact which are
13
likely to cause confusion, or to cause mistake, or to deceive as to the affiliation,
14
connection or association of Defendants with Wheel Pros and as to the origin,
15
sponsorship or approval of Defendants’ goods, services or commercial activities by
16
Wheel Pros.

66. Defendants were placed on notice of Wheel Pros’ trademarks but
18
Defendants continue to engage in infringing activities.
19
67. Defendants’ awareness of Wheel Pros’ trademarks and Defendants’
20
continued infringement makes such infringement willful, entitling Wheel Pros to
21
enhanced damages pursuant to and an award of attorneys’ fees pursuant to 15 U.S.C. §
22
1117.

68. Upon information and belief, Defendants have further made substantial
24
profits to which they are not equitably entitled.

69. As the result of the foregoing, Defendants are infringing on Wheel Pros’
26
trademarks in violation of the Lanham Act, 15 U.S.C. § 1051 et seq.

INFRINGEMENT (A.R.S. § 44-1453)

3 70. Wheel Pros realleges and incorporates herein by this reference each and
4 every one of the allegations contained in each of the above paragraphs as though fully set
5 forth herein.
71. Defendants knowingly and with intent to sell or distribute offered for sale
6
wheels bearing an unauthorized reproduction or copy of Wheel Pros’ intellectual
7
property; specifically, Wheel Pros’ distinctive trade dress and the infringing “star” and
8
“XD Series” marks.
9
72. Ivision knowingly and with intent to sell or distribute manufactured or
10
produced wheels bearing an unauthorized reproduction or copy of Wheel Pros’
11
intellectual property; specifically, Wheel Pros’ distinctive trade dress and the infringing
12
“star” and “XD Series” marks.
13
73. Wheel Pros sustained a loss as a result of Defendants’ infringement,
14
including, but not limited to, loss of profits, and devaluation of Wheel Pros’ valuable
15
goodwill and business reputation symbolized by its distinctive patented design,
16
trademarks and trade dress.
17
74. As the result of the foregoing, Defendants are infringing on Wheel Pros’
18
trademarks and trade dress in violation of A.R.S. § 44-1453(A) and (C).
19
75. Wheel Pros is entitled to enhanced damages and an award of attorneys’ fees
20
and costs pursuant to A.R.S. § 44-1453(J).

FOURTH CLAIM FOR RELIEF –UNFAIR COMPETITION

76. Wheel Pros realleges and incorporates herein by this reference each and

every one of the allegations contained in each of the above paragraphs as though fully set

77. Defendants made false representations through the Imitations.

78. Defendants’ false representations induced buyers to believe that the

Imitations are genuine Wheel Pros’ Rockstar I, Rockstar II, Rockstar III, Monster, and

Monster II wheels.

79. Upon information and belief, consumers have purchased and continue to
5
purchase the Imitations in reliance upon Wheel Pros’ goodwill and business reputation.
6
80. Upon information and belief, Defendants knew that consumers were relying
7
upon Wheel Pros’ reputation for quality and integrity.
81. Defendants’ conduct alleged herein constitutes unfair competition, which
8
has damaged and will continue to damage irreparably Wheel Pros’ goodwill and
9
reputation unless restrained by this Court because Wheel Pros has no adequate remedy at
10
law for Defendants’ conduct.

WHEREFORE, Plaintiff Wheel Pros requests the following relief:

A. A judgment that Defendants have infringed the patents-in-suit;
13
B. A judgment that Defendants’ infringement of the patents-in-suit was
14
willful, intentional, and malicious;
15
C. A judgment that Defendants have infringed the trademarks-in-suit;
16
D. A judgment that Defendants’ infringement of the trademarks-in-suit was
17
willful, intentional, and malicious;
18
E. A judgment that Defendants violated A.R.S. § 44-1453(A);
19
F. A judgment that Ivision violated A.R.S. § 44-1453(C);
20
G. A judgment that Defendants unfairly competed with Wheel Pros in
21
violation of Arizona common law;

H. That Defendants, and each of their agents, servants, employees, attorneys,
23
successors and assigns and all persons in active concert or participation be enjoined and
24
restrained preliminarily and perpetually and permanently from:

designs, any of the Wheel Pros trademarks or trade dress (including, without limitation,
7
the Rockstar, Rockstar II, Rockstar III, Monster, and Monster II trademark and trade
dress), alone or in combination with any word or words, or using any other words,
8
symbols, configurations or designs which so resemble said marks or trade dress as to be
9
likely to cause confusion, deception or mistake, on or in connection with the advertising,
10
offering for sale or sale of any product which is not manufactured, distributed or
11
otherwise authorized by or for Wheel Pros;
12
4. Attempting to or passing-off, inducing or enabling others to sell or
13
pass-off any product as a product affiliated with or sponsored by Wheel Pros, which
14
product is not produced under the authorization, control and supervision of Wheel Pros
15
and approved by Wheel Pros for sale under the Wheel Pros patents, trademarks or trade
16
dress;
17
5. Committing any acts calculated or intended to cause purchasers to
18
believe falsely that any of Defendants’ products are associated with, sponsored by,
19
approved by, guaranteed by, connected with or produced under the control and
20
supervision or within the authority of Wheel Pros;
21
6. Otherwise competing unfairly with Wheel Pros in any manner;
22
7. Obtaining, possessing, shipping, delivering, distributing, returning or
23
otherwise disposing of in any manner advertising materials, goods or inventory bearing
24
any of the patented designs, any of the Wheel Pros trademarks or trade dress (including,
25
without limitation, the Rockstar, Rockstar II, Rockstar III, Monster, and Monster II
26
trademark and trade dress), which materials, goods or inventories were not manufactured
27

by or for Wheel Pros or authorized by Wheel Pros to be used, sold or offered for sale in

8. Obtaining, possessing, manufacturing or using any tools, dies,

stamping, machining, mixing, embossing, printing, labeling, packaging, silk screening,
5
molding equipment or any other apparatus designed for the manufacture or labeling of
6
unauthorized products bearing the Wheel Pros patented designs, trademarks or trade dress
7
and packaging and advertising or display material relating thereto; or
9. Continuing to perform in any manner whatsoever any infringing
8
acts.

I. That Defendants be required to deliver immediately to Wheel Pros or its
10
attorneys for destruction any and all products, guarantees, warranties, circulars, price
11
lists, labels, signs, prints, packages, wrappers, pouches, receptacles, advertising matter,
12
promotional and other material in its possession or control bearing the Wheel Pros
13
patented designs;
14
J. That Defendants be required to deliver immediately to Wheel Pros or its
15
attorneys for destruction any and all products, guarantees, warranties, circulars, price
16
lists, labels, signs, prints, packages, wrappers, pouches, receptacles, advertising matter,
17
promotional and other material in its possession or control bearing the Wheel Pros
18
trademarks or trade dress, alone or in combination with any other words, or trade dress or
19
any other words or symbols which so resemble the Wheel Pros trademarks or trade dress
20
as to be likely to cause confusion, mistake or deception, which is or can be used in
21
connection with the advertising, offering for sale, or sale of any product or service which
22
is not manufactured, distributed or otherwise authorized by Wheel Pros;
23
K. That Defendants be required to deliver immediately to Wheel Pros or its
24
attorneys for destruction any and all disks, drives, tapes, computer and electronic storage
25
devices, computer graphics files, molds, plates, screens, graphics, matrixes, patterns and
26
any other means of making simulations, reproductions, counterfeits, copies or colorable
27
imitations of the Wheel Pros patented designs, which are for use on products, containers,

packaging, disks, tapes, labeling, advertising and display literature or other material not

authorized by Wheel Pros;

L. That Defendants be required to deliver immediately to Wheel Pros or its

attorneys for destruction any and all disks, drives, tapes, computer and electronic storage

devices, computer graphics files, molds, plates, screens, graphics, matrixes, patterns and
6
any other means of making simulations, reproductions, counterfeits, copies or colorable
7
imitations of the Wheel Pros trademarks and trade dress which are for use on products,
containers, packaging, disks, tapes, labeling, advertising and display literature or other
8
material not authorized by Wheel Pros;
9
M. That Defendants be required to supply Wheel Pros or its attorneys with a
10
complete list of entities from whom it purchased and to whom it distributed and sold
11
products, in bulk, in connection with the unauthorized simulation of Wheel Pros patented
12
designs, trademark or trade dress;
13
N. That Wheel Pros be awarded damages against Defendants adequate to
14
compensate Wheel Pros for Defendants’ infringement of the patents-in-suit;
15
O. That all patent damages against Defendants be trebled on the basis of
16
Defendants’ willful infringement of the patents-in-suit;
17
P. That Wheel Pros be awarded damages against Defendants adequate to
18
compensate Wheel Pros for Defendants’ infringement of the trademarks-in-suit;
19
Q. That all trademark damages against Defendants be trebled on the basis of
20
Defendants’ willful infringement of the trademarks-in-suit and/or violation of A.R.S. §
21
44-1453(A) or (C);
22
R. That Defendants be required in accordance with 15 U.S.C. § 1117 to
23
account for and pay to Wheel Pros the greater of the following, as determined by the
24
Court:

1. Three times all gains, profits, benefits and advantages derived by
26
Defendants from the above-described acts of trademark infringement, misrepresentation,
27
unfair trade practices and unfair competition; or

2. Three times all damages suffered by Wheel Pros from the above-

U. That Defendants be required to pay Wheel Pros punitive and enhanced
7
damages in an amount as the Court may determine for malicious, willful, intentional,
deliberate and tortious conduct of Defendants; and
8
V. That Wheel Pros have such other and further relief as the Court deems just
9
and proper.
