said documents and such further details, plans and instructions as may be supplied from time to time and to furnish to Her Majesty the Queen in Right of Canada, all materials, plant, machinery, tools, labour and things necessary for the construction or carrying out and proper completion of the said work for the sums stated in the price schedule of this tender form. 3. We understand and agree that all applicable taxes, duties, permits and fees are our responsibility and are included in our Tendered Price. The exceptions to the foregoing are the Goods and Services Tax (GST). GST will be paid to the contractor by Defence Construction Canada in addition to any amounts due under the contract. 4. It is understood and agreed that, with respect to Building Permits only, General Conditions paragraphs pertaining to Law, Permits and Taxes, inclusive (Form DCL 32), shall not apply. 5. We certify that Bid Security, if required, in one of the forms outlined in paragraph 4 of the "Instruction to Tenderers", Form DCL 193 accompanies this Tender. 6. It is understood and agreed that in the event of this Tender being accepted within 15 (fifteen) calendar days of the date and time stated for closing of tenders and our failing or refusing to carry out the contract in accordance with the terms of our Tender, our bid security, if required by the tender, (i) if in the form of a certified cheque, bank draft, or bonds of, or bonds unconditionally guaranteed as to principal and interest by the Government of Canada, or (ii) if in the form of a Bid Bond, shall be forfeited to Her Majesty the Queen in Right of Canada and the Bonding Company shall be liable in accordance with the terms of the Bond. 7. It is further understood and agreed that notwithstanding (i) the forfeiture of the certified cheque or bonds of (ii) the liability of the Bonding Company, Her Majesty shall be entitled to the payment of any additional amounts that may be required to meet the cost of all loss and damage suffered by Her Majesty by reason of our default in carrying out the contract. 8. We understand this project must be completed no later than 21 calendar days after notification of contract award. If our Tender is accepted, we agree to start work immediately upon notification of contract award and to work vigorously and continuously to complete the project within this prescribed time. 9. Modifications set forth in the Amendments numbers (please list all amendments on the last page of this tender form) to the tender documents are reflected in the Firm Price/Total Tender.

N.B. There is no need to return the Amendment(s) with the tender.
10. By signing below we certify that we are authorized to sign this tender on behalf of the Corporation, Partnership, Joint Venture or Sole Proprietorship and bind the company to it. 11. We certify that we are in possession of all the tender documents listed in this tender form.

The quantities listed above are estimated quantities only and may be increased or decreased in accordance with the requirements of the work. All payments shall be based upon the actual quantity of materials supplied and work performed as approved by the DCC Representative in accordance with the General Conditions – DCL32. We hereby certify that no imbalances exist between our unit and lump sum prices, or between our individual unit prices, and further, we understand that any such imbalance(s) would be considered cause to render our Tender invalid. Where unit prices are required for individual items in the Tender Form (DCL 150), the "Unit Price" entered by the bidder shall take precedence over the extension price should an error in the extension be discovered. If an arithmetic error is noted in the addition of the line item prices in column (6) of the Tender Form (DCL 150), the line item prices shall take precedence and the “Total tender price” will be changed to reflect the correct sum .

TO ALL PROPONENTS: THE PURPOSE OF THIS AMENDMENT IS TO GIVE EFFECT TO THE FOLLOWING: 1. Bidders should note that the tender closing location for this project is the Winnipeg Construction Association as noted on the DLC150 Tender Board Tender Form. 2. Bidders are advised that Defence Construction Canada has issued new Standard Construction Contract Documents – Version 2008. These replace the documents that were issued in 1999 and take effect on all new tender calls issued after July 1, 2008. 3. Bidders are advised that the Performance Evaluation Guidelines - DCL 81 (R-0708) replaces the DCL 81 (R-02-08) in the Standard Construction Contract Documents - Version 2008. 4. Standard Construction Contract Documents are incorporated by reference in construction tenders and are available through MERX at 1-800-964-MERX (6379) or electronically at: www.merx.com and from the Supplier Home follow the links: Government Resources and then Defence Construction Canada (DCC) or from the Defence Construction Canada website at: http://www.dcccdc.gc.ca/english/cc_procurement.html. Reference General Conditions form (DCL32 (R-07-08)), Paragraph 5: Bidders are advised to ADD paragraph 5.2.4 as follows:
“5.2.4

The successful Contractor will be required to furnish a detailed cost breakdown of the Contract Amount for the approval of the DCC Representative. This cost breakdown, to be submitted prior to or concurrently with the first progress claim, must show separate prices for each phase of the work, as it is required as an agreed basis to check submitted progress claims. In addition, the Contractor will be required to furnish a complete time schedule of the various operations of the work.”

9. Reference General Conditions form (DCL32 (R-07-08)), Paragraph 10: Bidders are advised that the “Insurance Terms” referred to are contained in the contract document entitled, Insurance Conditions – DCL243 (R-07-08). 10. Reference Instructions to Tenderers form (DCL 193 (R-07-08)), Paragraph 2.1.3.2: Bidders are advised to DELETE “corporation” and REPLACE with “partnership”. 11. Reference Instructions to Tenderers form (DCL 193 (R-07-08)), Paragraph 4.1: Bidders are to ADD “Bid Security must be in the ORIGINAL form. Fax or photocopies are NOT acceptable.” 12. Reference Instructions to Tenderers Form (DCL193 (R-07-08)), Paragraph 11 Contract Security: Bidders are advised to DELETE Paragraph 11.1 and REPLACE with: “11.1 Contract security is required when the advertised project budget is greater than $100,000.00 or, if the advertised project budget is less than $100,000.00 when specifically called for in the Tender Documents. Contract security shall be submitted in accordance with the General Conditions form (DCL32 (R-07-08)).” 13. Reference Instructions to Tenderers Form (DCL193 (R-07-08)), Paragraph 4.1.1: Bidders are advised to DELETE “$500,00.00” and REPLACE with “$500,000.00”. 14. 16. The Contractor must provide a Fire Safety Plan in accordance with the National Fire Code of Canada (NFCC 2005) section 5.6.1.2. The contractor’s responsibility for a Fire Safety Plan is limited to their construction activities and not for the whole building. Responsibility for fire safety of the building areas outside of the construction limits will remain with DND. DND/CF is responsible for the Fire Safety Plan for the occupied portions of the building. The plan shall be submitted to DCC by the Contractor within 10 business days of award for approval by the Base Fire Chief prior to commencement of construction or demolition operations. A copy of the approved Fire Safety Plan shall be posted and maintained on site at all times during construction and the Contractor shall ensure all persons accessing the construction site are briefed and adhere to the requirements of the plan.
