BODY PARTS OF ANIMALS THAT ARE PROHIBITED FOR CONSUMPTION

The Fuqahaa (Jurists) of the Hanafi Mazhhab have ruled that seven parts of an animal are prohibited for
consumption. They are as follows:

1. Flowing blood
2. Male genitals
3. Female genitals
4. Testicles
5. Glands
6. Bladder
7. Gall bladder

As far as flowing blood is concern, the Fuqahaa have classified it as Haraam. They have classified the
remainder six parts of an animal as Makruh Tahrimi. Many Scholars have added an eighth part, called the
spinal marrow and have also classified it as Makruh Tahrimi as well, ie, a white cord that runs in the centre of
the neck that extends till the spinal column. (Takmila Fath Al-Qadeer, vol 8, pg 415, Rasheediyya).

However, none of the classical and reliable books of Hanafi Fiqh (Jurisprudence) have recorded the spinal
marrow as Makruh. It is only a few Indian prints of the jurisprudict book, Kanz Al-Daqaaiq by Allamah Nasafi,
that have recorded the spinal marrow as prohibited. The other copies of Kanz Al-Daqaaiq have not included
this addition. None of the old reliable manuscripts and commentaries of Kanz have this addition. Thus, the
prohibition of the spinal marrow was an addition made to the original text of Kanz and was not part of its
original text.

The author of Kanz, Allamah Nasafi, in his other works on Fiqh like Al-Wafi (of which Kanz is its concise
version) and Al-Kafi (commentary on Al-Wafi) has made no mention of the spinal marrow been Makruh.
Therefore, it is far fetched to assume that he mentioned the spinal marrow to be Makruh in his Kanz.

A few Indian scholars, like the authors of Nisab Al-Ihtisab and Mutalib Al-Mumineen have relied on the Indian
print of Kanz and classified the spinal marrow as Makruh. Also Al Fatawaa al-Hindiyya has recorded the spinal
marrow as Makruh quoting (the Indian print of) Kanz. It is for this reason that the editor of Al Fatawaa al-
Hindiyya states:

“And the spinal marrow: I have not found this in the text of Kanz and nor in its commentary, Tabyeen”

The author of the marginal notes of Kanz, Shaykh Muhammad Ahsan Nanotwi quotes Shaykh Habibullah as
saying:

“(brief translation) and the spinal marrow: which is called ‘Haraam Maghz’ in the Indian language. Know
well that the word ‘spinal marrow’ is not found in all the commentaries of the text (Kanz)……..”

The Hadith and books of the Hanafi Fuqahaa prohibit seven parts of an animal. By prohibiting the spinal
marrow, we will be prohibiting eight parts of an animal, which contradicts the Hadith and that which is
recorded in the books of the Fuqahaa. Therefore, Imam Tahtawi has inferred to the weakness of the view that
the spinal marrow is Makruh in his book, Hashiyya Al-Tahtawi ala al-Durr. He states:

It is for this reason as well, that some of our Akabireen (seniors), like Mufti Kifayatullah and Mawlana Zafar
Ahmad Uthmani have refuted the view that the spinal marrow
ma is prohibited.

In conclusion, we state that the spinal marrow is Halaal and not Makruh.

marrow as Haram, Makruh Tanzihi or Makruh Tahrimi have relied on books that relied on the Indian print of
Kanz, which was altered.
