18 Plaintiff is appealing the trial court’s dismissal of her claims against all
19
Defendants. Defendants Diane Zumwalt, Matthew Todd Crawford, and Stender
20
Zumwalt, PLLC, not captioned, were Plaintiff’s criminal defense attorneys and
21
law firm in the matter giving rise to the underlying lawsuit. Plaintiff’s appeal, with
22

23 respect to Defendants Zumwalt, Crawford, and Stender Zumwalt, PLLC, should

24 be summarily dismissed because she does not provide any substantive basis for

25 appealing the trial court’s dismissal of them.

1 Defendants Zumwalt, Crawford, and Stender Zumwalt, PLLC filed an

2 FRCP 12(b)(6) motion to dismiss. Dkt # 71. Plaintiff failed to respond to the
3 motion. The court dismissed Defendants Zumwalt, Crawford and the firm
4
because she failed to respond. Dkt # 95.

In her opening brief, Plaintiff makes no mention of Defendants Zumwalt,
6
Crawford or their law firm, let alone any basis for overturning the trial court’s
7

8 order dismissing them. In fact, in the introduction and statement of jurisdiction,

9 Plaintiff specifically states that she is appealing the trial court’s dismissal of her

10 1983 civil action claim against the City of Federal Way police officers. Br. Of
11
Appellants, p. 6. In her statement of issue, the singular issue phrased as a
12
question is “should the trial court’s decision dismissing appellant’s claims against
13
the City of Federal Way police officers be affirmed that’s cognizable under 42
14
U.S.C. § 1983?” Br. Of Appellants, p. 12. Defendants Zumwalt and Crawford
15

16 are not City of Federal Way police officers, and are not employees of the City of

17 Federal Way. Given Plaintiff’s brief is completely devoid of any mention of


18 Defendants Zumwalt, Crawford, and Stender Zumwalt, PLLC, these defendants
19
have nothing to respond to.

Plaintiff’s appeal with respect to Defendants Zumwalt, Crawford and
21
Stender Zumwalt, PLLC should be summarily dismissed, and said Defendants
22

23 should not be required to respond to Plaintiff’s opening brief.
