Judge consolidates Leon Koziol's lawsuits

UTICA — A federal judge last week consolidated the most recent parental rights lawsuit from attorney Leon Koziol with an earlier suit Koziol filed in 2009. Koziol, whose law license was suspended indefinitely earlier this year for failure to pay child support, filed a lawsuit on Nov. 10 seeking $25 million in damages from the New York Unified Court System and 24 other defendants. Koziol claims that the state’s handling of custody and child support cases “systematically destroyed productive parent-child relationships” between him and his children. U.S. District Court Judge David Hurd consolidated the suit with one from 2009 that lists 19 of the same defendants and is based on “common questions of law and fact,” according to the decision. Hurd also denied all pending motions in the earlier case, including motions for dismissal and summary judgment, in order to “promote efficiency and economy for both the parties and the judiciary.” Both sides may re-file those motions for the consolidated case, he said.

If anyone else stopped paying Child Support they would've been sent to jail, yet somehow he just loses his law license. How does that work? I would be interested to know if he has paid any child support since he started this fight-If not, that would make the children's mother their sole support. Now, if Dad doesn't care enough about them to kick in his share, that alone would damage any parent-child relationship. Since he would rather fight the support than pay it, how can he go in front of a judge and say how much he loves his kids, but will not help take care of them? The real issue is about deadbeat fathers desperately trying to skirt their obligations by fighting for a factually false visitation-custody arrangement. There are many good fathers who are erroneously included in this ''fight'' by deadbeat fathers who ruin the fight's cause and support. Outside koziol's fantasy, there is almost always a parent who is the primary caretaker and so is rightly determined to have primary residence. And the biggest supporters of this sham case appear to be deadbeat parents. I have helped many good fathers walk out of a custody case with equal visitation (where appropriate) or primary residence. This lawsuit is poorly motivated by someone who himself cannot follow the law because he does not want to. As someone else pointed out, by now, a normal person would have spent six months in jail for contempt! But not leon; he's managed to only lose his law license... Others would have lost their driver's license by now too.
