Sub : For making enquiry of Illegal Project of

construction of Boats and speed boats, which are
being supplied to the Home department of
Government of Maharashtra, on the creek of
Dharamtar –Shahabaj in Raigad District and
suspicion about the quality of the said boats ;

Honourable Sir,

The Government of Maharashtra, by its Home Department has

given contract to the Marine Frontiers Ltd. For supply and
construction of speed boats .The Honourable Home Minister of
Government of Maharashtra Mr. R.R.Patil, remained present to
headquarter at Alibag on 7-5-2010 for giving the said speed boats in
the services of Police Department.
No doubt about supply of such speed boats for the security of
the country . We are also of the opinion that it is the prime
importance to look after the safety of the country. However, it is
equally important to see to whom or to which Company, the
contract of such supply of implements is being given and the
background of the said Company. Because the enquiry was
required to be made for supply of bullet proof jacket given to
Mr. Hemant Karkare, Police Officer, in the attack of 26/11 at
Bombay and in that incident, the Government is unnecessarily
defamed. If such irregularities are committed in the contract of
supply of speed boats , then the said is required to be enquired at that
moment only and as such I am writing this letter.
I got information that the Government of Maharashtra has
already paid Rs. 55 Crores to the said Marine Frontier Co. Ltd. For
speed boats and against the contract of Rs. 150 Crores is to be given

the said Company that the said company is situate at Dharamtar

Shahabaj creek in Raigad District in Maharashtra State. However, it
is clear from the office of the Collector, Raigad that the Collector,
Raigad has not given any such permission to the said Marine
Frontiers Co.Ltd. In this connection I had called for the information
from the Collector Raigad Alibag on 25-10-2010 as to who has given
permission to the said Marine Frontiers Co. to construct speed boats
or boats at Dharamtar-Shahabaj creek. But I am of the opinion that
the Collector Raigad Alibag is not taking this issue seriously which
issue is very sensational and which is connected with the safety of
the country.Because the Collector is handing over this enquiry to the
Sub Divisional Officer, and when this issue went to Sub Divisional
Officer, he calls for information from concerned Tahasildar and
Tahasildar sent the matter to the Circle officer as to who has given
permission to the said Company. It is necessary to visit and inspect
the site by the Collector, or the Sub Divisional Officer or the
Tahasildar to see as to whether the said project of construction of
boat is going or not. But how the Govt. officers are avoiding or
shirking their responsibilities can be seen from this incident.
Further more , at Dharamtar Shahabaj creek in Alibag Taluka
in Raigad District, in Maharshtra State, PNP Company by violating
the rules of CRZ, 1991, has illegally cut the mangroves and
constructed four jetties, illegally and constructed three buildings
illegally. This PNP Company has also illegally encroached upon the
Govt land worth Rs. 2500 Crores. This Company has put and
spread such a terrorism in the said area that even Collector , Sub
Divisional Officer , Tahasildar or any Police Officer cannot visit
the site. I have made several complaints against the said Company,
being the Member of Legislative Assembly of this Constitutency. But
it is material to note that not a simple First Information Report is
being recorded by any of the Police Officer about it. This P.N.P.
Company has compelled this Marine Frontier Company to construct

speed boats and boats on this creek. On this jetties coal sulpher etc.
being unloaded which are dangerous chemicals. So also smuggling
is being conducted on this jetty which fact has been flashed in the
various news paper and there is also talk about it in the public at
large. However, due to owners /Directors of the P.N.P Company
nobody dares to make complaint about it.
It is very serious thing that the Home Department of
Government of Maharshtra has given such contract of construction of
boats and speed boats at Dharamtar Shahabaj creek in Alibag Taluka,
District Raigad, in Maharashtra State , to this Company . There is
also room to take doubt about the quality of construction of boats
and speed boats, because none of the department of the State
Government or the Central Government is taking care to look after
the quality of such boats which are being constructed for the safety
of the country. Because as per the news published in Times of India
on 27th November, 2010, it is published that on seeing the condition
of the boat on firing of self loading rifle SLR, the Police has asked
the said Company to take the boat back.
Honourable Sir, I, therefore, request you to make enquiry
as to who has given permission to this Marine Frontiers
Company Ltd. to construct speed boats at Dharamtar Shahabaj
creek in Alibag Taluka , District Raigad, Maharashtra State, and
supply the same to the Government, and if the said Company has
unauthorizedly started construction of such boats at Dharamtar
Shahabaj creek, then how the Home Department of Govt.
Maharashtra has given contract of supply of such boats ,when
there is suspicion about the quality of such boats

out by PNP Company at about 135 to 140
Meter from the high tide line ( by
committing breach of provisions of CRZ
Act, on Dharamtar creek at Shahabaj within
the limits of Alibag Taluka ,
District Raigad, Maharashtra State.

Respected Sir,

I am one of the Ex – M.L.A.( Maharashtra Legislative

Assembly_ from (old)Alibag Uran Constituency and now Alibag
Murud Constituency, in District Raigad, Maharashtra State, prefers
this Representation cum complaint for taking immediate action on the
above mentioned subject at the Central Government level.
At Shahabaj Dharamtar near the creek , in Alibag Taluka and
in Raigad District, in the State of Maharashtra, P.N.P. Maritimes
Services company by transgressing the provisions of environment,
pollution and CRZ openly , constructed two buildings without
obtaining any permission from the competent authorities. So also
construction of third building is going on . Two jetties have also
constructed by flouting the provisions of CRZ Act. For taking action
against the said Company I have already moved by filing complaint
to the Honourable Collector, Raigad Alibag, the President of
Maharashtra Coastal Zone Management Authority, Chief Secretary
Environment , Chief Secretary, Revenue, Commissioner, Konkan
Regiosn, and Honourable Revenue Minister, Maharashtra State and
to the Honourable Chief Minister, Maharashtra State .
Though the said matter is going on since year 2000, the
Honourable Collector, by his letter dated 26-10-2010 had asked the

Sub Divisional Officer, whether there is any breach of CRZ and
environment problem . This act on the part of the Collector is grossly
carelessness . Because, the then Sub Divisional officer of Revenue
by his letter dated 28-12-2006 has already submitted his report
contending interalia that in the area of PNP Jetty, the Director Mr.
Nrupal Patil of PNP Company has illegally and unauthorizedly made
construction of Ground + two upper floors and due to construction of
this building there is breach of CRZ. This report is self explanatory.
The copy of this report is enclosed herewith for kind perusal. The
Asstt. Director, Town Planning Alibag Raigad by letter dated 7-5-
2007 has already submitted report to the Tahasildar Alibag and
Collector Alibag that the illegal construction of P.N.P. Company
falls in CRZ-3 division . The Collector, Raigad Alibag has also
informed me by his letter dated 6-10-2010 that as per the letter and
report of the Asstt. Director, Town Planning Raigad Alibag by letter
dated 7-5-2007, report to the Government of Maharashtra has been
made by letter dated 11-9-2010.
In spite of all these things, the Collector, Raigad and the
Revenue Officers, purposely neglecting this issue and though there is
breach of the Environment and the CRZ Act, the enquiry at your
level is necessary to be carried out as to why these responsible
Officers of the Government are not taking any action against the
P.N.P. Company.
In addition to this, this Company totally in the area of 20
hectors has cut down the Mangroves in the land bearing S.No. 247
and in the Government land bearing S.No. at village
Shahabaj, Taluka alibag in the year 2005. The report to that effect
has been given by Range Forest Officer Alibag to the Tahasildar
Alibag by letter dated 5-3-2010. But at that time also, under the
political pressure without registering the offence against the Officers
of PNP Company, the Revenue officer has filed complaint on 29-1-
2005 under Forest Act, against and in the name of unidentified
persons.

Today also at village Shahabaj, Tal. Alibag, near the creek and
within the limits of CRZ , P.N.P. Company, Dharmtar Infra and
Marine Frontiers are working . Out of them P.N.P. Company has
illegally and unauthorizedly constructed three buildings by
committing breach of CRZ and Pollution and Environment Act .In
spite of all these illegal activities of the said company, the
Government of Maharashtra through its Home department is
providing contract construction of speed boat to the Marine Frontiers
worth Rs. 150 Crores. The Government of Maharashtra thus
affording protection to these Companies and its directors. I
personally, being the then member of the Legislative Assembly ,
since year 2005 making complaints to the Government level, but all
the responsible Officers and the Government Officers supporting
such activities of the said PNP Company purposely and sine there is
chain of such persons in the Government, there is likelihood of
happening anything which is against the protection of interest of
India and further there is likely that anti terrorist may have an access
to come over there and still none of the Government Officers is not
taking action against any of the above Companies, for their illegal
and unauthorized activities .
Honourable Minister Sir, though I am Ex member of
Legislative Assembly of this Constituency, of Maharashtra, no any
action is taken by the Government of Maharashtra, in this matter,.
Therefore, I am humbly submitting this my representation and
hoping that necessary immediate action will be taken from your end .
I also request you to communicate me as to what action has been
taken in the matter at your end.

Subject : Regarding unauthorized construction made

at PNP Jetty , at Shahabaj, Tal. Alibag

Sir,
As per your Telephonic message dated 27-12-2006, I along
with Tahasildar Alibag, Circle Offier, Poynad and Talathi Saja
Shahabaj inspected the spot and I am submitting the report about the
same.
In the area of P.N.P. Jetty , the Director Nrupal Patil of P.N.P.
Company has made illegal construction of Ground + two floors. The
said construction is within the area of MMRDA. On enquiry with
Manager Shri Malvi of the said Company, he told that the said
construction is made in S.No. 171/1 of village Shahabaj which is a
private property. The said constructions seems to be within 135 to
140 Meters from CRZ of Dharamtar creek. By this construction,
there is breach of CRZ Act. At the time of the visit of the spot of
construction, the spades, iron pot (Ghamela) etc. were seized along
with the persons /labourers working there and the same were handed
over in possession of Talathi Saja Shahabaj. The persons present
there viz. Shri Malvi and construction Supervisor viz.Mr. Pavan R.
Sharma have been given understanding that unless permission is
received, no any construction should be made and the construction
work has been stopped and the Panchanama to that effect has been
prepared by Talathi Saja Shahabaj.
