State  Judicial  Nominating  Commission  

Minutes  of  teleconference  meeting  

November  15,  2010  

Members  Present  on  the  Call:    David  Wiggins,  Chair;  Steven  Brody;  Guy  Cook;  Coleen  Denefe;  
Jean  Dickson;  Joe  Fitzgibbons;  Dan  Holm;  Mary  Beth  Lawler;  Tim  Mikkelsen;  Steve  Pace;    
Margaret  Redenbaugh;  Amy Skogerson; Beth  Walker;  Madalin  Williams.  

Members  Absent:    David  Cochran.        


 

The  Commission  held  an  informational  teleconference  to  review  the  logistics  for  nominating  
candidates  to  fill  the  three  vacancies  on  the  Iowa  Supreme  Court  created  by  the  failure  of  Justices  
Marsha  Ternus,  Michael  Streit  and  David  Baker  to  receive  sufficient  votes  at  the  November  2,  2010  
general  election  in  favor  of  their  retention  in  office.      

The  Commission  was  advised  the  formal  process  could  not  commence  until  the  statutory  notice  
from  the  Secretary  of  State  is  received  by  the  Chair  of  the  Commission.    Furthermore,  the  Secretary  of  
State  cannot  send  that  notice  until  the  results  of  the  November  2nd  election  are  officially  certified.    This  
is  expected  to  happen  November  29,  2010.    So  the  notice  will  not  be  sent  until  sometime  after  
November  29th.      

Once  the  notice  from  the  Secretary  of  State  is  received,  the  Commission  will  have  60  days  to  
complete  its  work.      Since  all  three  vacancies  will  occur  at  the  same  time,  nominations  for  all  three  
positions  must  be  made  within  the  same  60-­‐day  window.    Assuming  the  notice  from  the  Secretary  of  
State  arrives  in  early  December,  based  on  past  practice  the  Commission  would  be  meeting  to  interview  
applicants  and  nominate  candidates  in  mid  to  late  January.      

The  Commission  briefly  discussed  other  matters  regarding  how  to  proceed  with  the  process,  but  
made  no  decisions.    The  Commission  agreed  to  meet  in  person  on  November  29,  2010,  in  the  Judicial  
Branch  Building.
